evidence developed in connection with the processing of the complaint, the entire complaint file, in which names and identifying information are not deleted, must be made available for his or her review. For this purpose, disciplinary action includes any action, (e.g., a requirement that the official undergo EEO training) which would constitute censure of the ADO's conduct or competence.
Appeals to the EEOC
If a complainant appeals an agency decision to the EEOC, the agency must provide a copy of the EEOC decision to the ADO. If the EEOC's decision reverses or modifies that of the agency in a manner affecting the ADO, the instructions in the previous paragraph apply.
