P. Executive order re fishery conservation zones

Executive Order 9634 (3 CFR 437, 1943-48 Comp.)

PROVIDING FOR THE ESTABLISHMENT OF FISHERY CONSERVATION ZONES

By virtue of and pursuant to the authority vested in me as President of the United States, it is hereby ordered that the Secretary of State and the Secretary of the Interior shall from time to time. jointly recommend the establishment by Executive orders of fishery conservation zones in areas of the high seas contiguous to the coasts of the United States, pursuant to the proclamation entitled "Policy of the United States With Respect to Coastal Fisheries in Certain Areas of the High Seas," this day signed by me, and said Secretaries shall in each case recommend provisions to be incorporated in such orders relating to the administration, regulation and control of the fishery resources of and fishing activities in such zones, pursuant to authority of law heretofore or hereafter provided.

Q. Dogfish shark eradication

Act of September 2, 1958 (72 Stat. 1710; 16 U.S.C. 758a note)

DOGFISH SHARK ERADICATION

SECTION 1. The Secretary of the Interior is hereby authorized and directed to prosecute, for a period of not to exceed four years from the date of approval of this Act, investigations of the abundance and distribution of dogfish sharks, experiments to develop control measures, and a vigorous program for the elimination and eradication or development of economic uses of dogfish shark populations.

COOPERATION

SEC. 2. In carrying out the foregoing purposes and objectives the Secretary of the Interior is authorized to cooperate with the official conservation agencies of the States bordering on the Pacific coast, with the commercial fishing industry, and with other governmental or private agencies, organizations, or individuals having jurisdiction over or an interest in the fisheries of the Pacific coast.

APPROPRIATIONS

SEC. 3. There are authorized to be appropriated from time to time, out of any moneys in the Treasury not otherwise appropriated, such sums as may be necessary not to exceed $95,000 per annum to carry out the purposes and objectives of this Act.

AGENTS TO BE DISINTERESTED

The persons charged with the management of the seal fisheries in Alaska, and the performance of such other duties as may be assigned to them by the Secretary of the Interior, shall never be interested directly or indirectly in any lease of the right to take seals, nor in any proceeds or profits thereof either as owner, agent, partner, or otherwise. Derivation.-Act Mar. 5, 1872, c. 31, § 1, 17 Stat. 35.

R.S. § 1973 read as follows: "The Secretary of the Treasury is authorized to appoint one agent and three assistant agents, who shall be charged with the management of the seal fisheries in Alaska, and the performance of such other duties as may be assigned to them by the Secretary of the Treasury".

R.S. 1975 read as follows: "Such agents shall never be interested, directly or indirectly, in any lease of the right to take seals, nor in any proceeds or profits thereof, either as owner, agent, partner, or otherwise."

Act Feb. 14, 1903, transferred jurisdiction, supervision, and control over the fur seal, salmon and other fisheries of Alaska from the Department of the Treasury to the Department of Commerce and Labor.

Act Mar. 4, 1913, changed the designation of the Department of Commerce and Labor to the Department of Commerce and provided that the Secretary thereof should be called the Secretary of Commerce.

Responsibility for Matters Relating to Seals.-Bureau of Commercial Fisheries within the Fish and Wildlife Service as responsible for matters relating to commercial fisheries and to seals.

ADMINISTERING OATHS AND TAKING TESTIMONY

R.S. § 1976. The agents are empowered to administer oaths in all cases relating to the service of the United States, and to take testimony in Alaska for the use of the Government in any matter concerning the public revenue. (R.S. § 1976.)

TRAVELING EXPENSES

R.S. § 1974. The persons charged with the management of the seal fisheries in Alaska shall be allowed, in addition to their salaries, their necessary traveling expenses in going to and returning from Alaska, for which expenses vouchers shall be presented to the General Accounting Office. (R.S. § 1974; June 10, 1921, c. 18, § 304, 42 Stat. 24.)

Act June 10, 1921, § 304, incorporated in section 44 of Title 31, Money and Finance, U.S. Code, is basis for the use of the words "General Accounting Office" in lieu of the provision of R.S. § 1974.

VESSELS OF FISH AND WILDLIFE SERVICE

The Secretary of the Navy is authorized to place the vessels of the United States Fish and Wildlife Service on the same footing with the Navy Department as those of the United States Coast and Geodetic Survey.
