An Ordinance Granting a Right-of-Way to the Detroit

& Mackinac Railway Company, Its Successors and Assigns, to Construct, Maintain and Operate Railroad Tracks Along and Upon Water and Jefferson Streets in Bay City.

It is hereby ordained by the Common Council of Bay City:

Section 1. That a right of way is hereby granted to the Detroit and Mackinac Railway Company, a corporation formed and existing under the laws of the State of Michigan, and its successors and assigns, to construct, maintain and operate railroad tracks upon and along Water street in the City of Bay City, from a point where the same is intersected by the easterly side line of Trumbu¡l street to the westerly side line of Washington avenue, and on Jefferson street from a point where the same is intersected by the northerly side line of Water street to a point where the same is intersected by the southerly side line of Third street, subject to the rights of owners and persons interested in property along said street.

Sec. 2. Said grantee, its successors and assigns, shall and will construct its tracks upon the proper grade as now established, or as hereafter may be established by the common council of Bay City, under the supervision of the city surveyor of said city.

Sec. 3. In case the said grantee, its successors and assigns, shall make an arrangement for the joint use of the railroad track of any other company on the streets above named, it shall not be required to build or maintain any track of its own thereon. The said grantee, its successors and assigns, shall bear its proper proportion of the cost

and expense of placing safety gates and maintaining flagmen at such street crossings upon the streets above named, as the common council may order and direct: Provided, however, That is shall not be required to bear such expense at any street crossings where it does not own or operate tracks on its own account. And the fact that the said grantee, its successors and assigns, does not construct any track upon any or all the portions of the streets above mentioned, shall not be construed as a waiver of any of the rights and privileges granted hereby.

Sec. 4. The said grantee, its successors and assigns, shall and will obey all ordinances of said city now in force, or that may hereafter be enacted, regulating the running and operating of railroad trains in Bay City.

FLINT & PERE MARQUETTE RAILROAD CO.

An Ordinance Granting a Right-of-Way to the Flint & Pere Marquette Railroad Company to Construct, Maintain and Operate a Single Track Along and Upon the North Side of Water Street, from the Present Terminus of Its Tracks Near Seymour Street, to Trumbull Street.

It is hereby ordained by the Common Council of Bay City:

Section 1. That upon compliance with all the provisions of the charter of Bay City, a right of way is hereby granted to the Flint & Pere Marquette Railroad Company, its successors and assigns, to construct, maintain and operate its track upon and along Water street in the City of Bay City, from its present easterly terminus of the same, near Seymour street, east to Trumbull street, subject to the rights of owners and persons interested in property along said street.

Sec. 2. The said railroad company, its successors and assigns, shall and will, when directed by the common council of said city, place proper gates and safeguards at any street crossing on its said track and station and maintain at such crossings, when so directed, flagmen or watchmen to secure the safety of the public.

Sec. 3. Said grantee, its successors and assigns, shall and will construct its track upon the proper grade as now established or as hereafter may be established by the common council of Bay City, under the supervision and direction of the city surveyor of said city.

Sec. 4. The said grantee, its successors and assigns, shall and will observe and obey all ordinances of said city now in force or that may here

after be enacted regulating the running and operating of railroad trains.

Sec. 5. The common council reserves the right to make such amendments to this ordinance as it may deem proper and necessary. Nothing herein shall be construed as granting an exclusive franchise.

An Ordinance Granting a Right-of-Way to the Flint & Pere Marquette Railroad Company, Its Successors and Assigns, to Construct, Maintain and Operate a Single Track Along and on Bismarck Street, as Laid Out and Established, Through Duncan's SubDivision, According to the Plat Thereof on Record and in Common Use.

It is hereby ordained by the Common Council of Bay City:

Section 1. That upon the compliance with all the provisions of the charter of Bay City, a right of way is hereby granted to the Flint & Pere Marquette Railway Company, its successors and assigns, to construct, maintain and operate its track upon and along Bismarck street, as laid out and established through Duncan's subdivision, as per plat of same on record and in common use, subject to the rights of owners and persons interested in property along said street.

Sec. 2. Said railroad company, its successors and assigns, shall and will, when directed by the common council of said city, place proper gates and safeguards at any street crossing on its said track, and station and maintain at such crossings, when so directed, flagmen or watchmen to secure the safety of the public.

Sec. 3.

Said grantee, its successors and assigns, shall and will construct its track upon the proper grade as now established, or as hereafter may be established, by the common council of Bay City, under the supervision and direction of the city surveyor.
