Senate Chamber, Lansing, February 24, 1925. 9:00 o'clock a. m.

The Senate met pursuant to adjournment and was called to order by the President.

The roll of the Senate was called by the Secretary.

Present: Senators Baxter, Bohn, Butler, Bernie L. Case, Cummings, Gansser. Gettel, Greene, Herald, Herrick, Horton, Hunter, Karcher, Leland, Martin, Penney, Quinlan, Truettner, Whiteley, Wilcox. Wood, Woodruff, Young-23; a quorum.

Absent with leave: Senators Atwood and Pearson.

Absent without leave: Senators Bahorski, Brower, William L. Case, Condon, Hinkley and Howarth.

Mr. Gansser moved that the absentees without leave be excused from today's session.

The motion prevailed.

Presentation of Petitions.

Petition No. 159. By Mr. Cummings. Petition of Mrs. Alice Eberhard and fortyeight other members of the Three Rivers Woman's Club praying for legislation to accept provisions of Public Act No. 97, passed by the 67th Congress of United States.

The petition was referred to the Committee on Public Health.

Introduction of Bills.

Mr. Herald introduced

Senate bill No. 126, entitled

A bill to provide for terms for the trial of jury cases in justice courts in cities and to provide for the selection of jurors to try such cases.

The bill was read a first and second time by its title, ordered printed, and referred to the Committee on Judiciary.

Third Reading of Bills.

The following entitled bill was read a third time:

Senate bill No. 75 (file No. 37), entitled

A bill to amend sections 2 and 6 of Act No. 81 of the Public Acts of 1903, entitled "An act to provide for the care and preservation of cemetery lots," being sections 2398 and 2402 of the Compiled Laws of 1915.

The question being on the passage of the bill, the roll was called and the Senators voted as follows:

The Senate agreed to the title of the bill.

The following entitled bill was read a third time:

Senate bill No. 18 (file No. 20), entitled

A bill to amend section 1 of Act No. 266 of the Public Acts of 1917, entitled, as amended, "An act to provide for a sinking fund in certain school districts and the investment thereof and to authorize the levy of taxes to pay principal and interest of bonds issued under the provisions of Act No. 150 of the Public Acts of 1915, entitled, 'An act to prescribe and limit the power of school districts having a population of more than fifteen thousand and less than one hundred thousand to borrow money and issue bonds of such district therefor, and to repeal all acts and parts of acts inconsistent herewith,' approved May 7, 1915, and to repeal all acts and parts of acts inconsistent herewith."

The question being on the passage of the bill, the roll was called and the Senators voted as follows:

Mr. Gansser submitted the following report:

The Committee on Military Affairs respectfully reports back to the Senate the following entitled bill, without amendment, and with the recommendation that the bill do pass:

Senate bill No. 46 (file No. 33)

A bill to make appropriations for the Michigan Naval Militia for the fiscal year ending June 30, 1926, and June 30, 1927, for maintenance and operation. AUGUSTUS H. GANSSER, Chairman.

The report was accepted.

The bill was referred to the Committee on Finance and Appropriations.

Mr. Hunter moved that the Senate adjourn.
The motion prevailed.

Accordingly, and in pursuance of the order previously made, the President declared the Senate adjourned until Thursday, February 26, 1925, at 4 o'clock p. m.

Petition No. 161. By Mr. Young, Petition of many citizens of the State of Michigan opposing Senate bill known as the Election Bill.

The petition was referred to the Committee on Elections.

Petition No. 162. By Mr. Quinlan. Petition of F. E. Drake and fifty other voters of Grand Rapids opposing any bill that proposes party enrollment or in any way restricts freedom of a citizen to vote for any candidate. The petition was referred to the Committee on Elections.

Petition No. 163. By Mr. Quinlan. Petition of Grand Rapids Bar Association opposing passage of Senate bill No. 73, providing for the government of Michigan State Bar.

The petition was referred to the Committee on Judiciary.

House bill No. 54 (file No. 51), entitled

A bill to provide for locating and establishing a normal school in the county of Gogebic in the Upper Peninsula of this State; to make an appropriation therefor.

House bill No. 107 (file No. 52), entitled

A bill to amend Act No. 334 of the Public Acts of 1913, entitled "An act to provide for the establishment, survey, improvement and maintenance of State reward trunk line highways, to provide for the payment of triple State reward thereon, to define the duties of State, county, good roads district and township officers in regard thereto, and to apropriate funds to carry out the provisions thereof," being sections 4851 to 4859 inclusive of the Compiled Laws of 1915, by amending the title of said act and adding a new section to stand as section 10, for the purpose of requiring the State Highway Department to maintain the continuations of such highways, lying within the limits of incorporated cities. House bill No. 178 (file No. 53), entitled

A bill to amend section 34 of Act No. 206 of the Public Acts of 1893, entitled "An act to provide for the assessment of property and the levy (and collection) of taxes thereon, and for the collection of taxes heretofore and hereafter levied; making such taxes a lien on the lands taxed, establishing and continuing such lien, providing for the sale and conveyance of lands delinquent for taxes, and for the inspection and disposition of lands bid off to the State and not redeemed or purchased; and to repeal Act No. 200 of the Public Acts of 1891, and all other acts and parts of acts in anywise contravening any of the provisions of this act," being section 4028 of the Compiled Laws of 1915, as amended by Act No. 380 of the Public Acts of 1921.

House bill No. 180 (file No. 54), entitled

A bill to provide for the taxation of shares of stock in investment companies; to prescribe the duties of the board of State tax commissioners relating thereto; and to provide penalties for violation of any of the provisions of this act. House bill No. 188 (file No. 55), entitled

A bill to amend section 7 of Act 206 of the Public Acts of 1893, entitled "An act to provide for the assessment of property and the levy and collection of taxes thereon, and for the collection of taxes heretofore and hereafter levied; making such taxes a lien on the lands taxed, establishing and continuing such lien, providing for the sale and conveyance of lands delinquent for taxes, and for the inspection and disposition of lands bid off to the State and not redeemed or purchased; and to repeal Act No. 200 of the Public Acts of 1891, and all other acts and parts of acts in anywise contravening any of the provisions of this act," being compiler's section 4001 of the Compiled Laws of 1915, as amended.

A bill to amend section 2 of Act No. 188 of the Public Acts of 1899, entitled "An act to provide for the taxation of inheritances, transfers of property by will, transfer of property by the intestate laws of this State, or transfers of property by deed, grant, bargain, sale or gift, made in contemplation of the death of the grantor, vendor or donor, or intended to take effect in possession or enjoyment at or after such death," same being section 14525 of the Compiled Laws of 1915, as last amended by Act No. 257 of the Public Acts of 1923. Senate bill No. 121 (file No. 84), entitled

A bill to amend section 5 of chapter 52 of Act No. 314 of the Public Acts of 1915, "The Judicature Act of 1915," being section 13777 of the Compiled Laws of 1915, as amended by Act No. 281 of the Public Acts of 1923.

Senate bill No. 122 (file No. 85), entitled

A bill to accept the provisions, requirements and benefits of an Act of the Sixty-seventh Congress of the United States, approved November 23, 1921, known and designated as Public Act No. 97, entitled "An act for the promotion of the welfare and hygiene of maternity and infancy, and for other purposes"; to promote the purposes of said act within the State of Michigan; to provide for the

administration thereof and for the custody and administration of funds received by the State of Michigan thereunder, or under the provisions of this act; and to make an appropriation to meet the terms and conditions imposed by said act of Congress and for the carrying out of the purposes thereof.

House bill No. 192 (file No. 56), entitled

A bill to amend section 1 of Act No. 255 of the Public Acts of 1899, entitled "An act to prevent trusts, monopolies and combinations of capital, skill or arts, to create or carry out restrictions in trade or commerce; to limit or reduce the production, or increase or reduce the price of merchandise or any commodity; to prevent competition in manufacturing, making, transportation, sale or purchase of merchandise, produce or any commodity; to fix at any standard or figure whereby its price to the public or consumer shall be in any manner controlled or established, any article or commodity of merchandise, produce or commerce intended for sale, barter, use or consumption," being section 15013 of the Compiled Laws of 1915.

House bill No. 199 (file No. 57), entitled

A bill to amend the title and sections 1, 2, 3 and 4 of Act No. 187 of the Public Acts of 1905, entitled "An act to insure the payment of subcontractors and wages earned and material used in constructing, repairing or ornamenting public buildings and public works," same being compiler's sections 14827, 14828, 14829 and 14830 of the Compiled Laws of 1915, and to add a new section thereto to stand as section 5.

Senate bill No. 123 (file No. 86), entitled

A bill to amend section 1 of Act No. 302 of the Public Acts of 1915, entitled, as amended, "An act to provide for the registration, identification and regulation of motor vehicles and trailers attached thereto operated upon the public highways of this State, and of the operators of such vehicles, and to provide for levying specific taxes upon such vehicles, so operated, and to provide for the disposition of such funds, and to repeal all other acts or parts of acts inconsistent herewith or contrary hereto," being section 4797 of the Compiled Laws of 1915, as last amended by Act No. 383 of the Public Acts of 1919. Senate bill No. 124 (file No. 87), entitled

A bill to amend section 3 of Act No. 267 of the Public Acts of 1923, entitled "An act to provide for the protection of game and birds; to regulate the taking, possession, use and transportation of same; to prohibit the sale thereof; to regulate the manner of hunting, pursuing and killing game or birds; to provide a penalty for the violation of any of the provisions of this act," approved May 24, 1923.

Senate bill No. 125 (file No. 88), entitled

A bill to amend section 95 of chapter 16 of the Revised Statutes of 1846, entitled "Of the powers and duties of townships, and election and duties of township officers," being section 2154 of the Compiled Laws of 1915, as last amended by Act No. 291 of the Public Acts of 1923.

Senate bill No. 126 (file No. 89), entitled

A bill to provide for terms for the trial jury cases in justice courts in cities and to provide for the selection of jurors to try such cases.

House bill No. 39 (file No. 58), entitled

A bill to amend section 7 of Act No. 6 of the Public Acts of 1907, Extra Session, entitled "An act to define and to regulate the treatment and control of dependent, neglected and delinquent children, to prescribe the jurisdiction of the probate court, and the powers, duties and compensation of the probate judge and the probate register with regard thereto; to provide for the appointment of county agents, register of the juvenile division and probation officers, and to prescribe their powers, duties and compensation, and to provide for the granting of rehearings and modifications of orders, sentences and decrees of said court," being section 2017 of the Compiled Laws of 1915, as amended by Act No. 16 of the Public Acts of 1921, First Extra Session, and Act No. 294 of the Public Acts of 1923.
