The Senate met pursuant to adjournment and was called to order by the President.

The Reverend E. E. Burdick of Lansing offered prayer.

The roll of the Senate was called by the Secretary.

Presentation of Petitions.

Petition No. 215. By Mr. Herrick. Petition of John C. Smith and twenty-eight other residents of Saranac favoring Sunday Closing Bill.

The petition was referred to the Committee on State Affairs.

Petition No. 216. By Mr. Woodruff. Petition of the Highland Park League of Women Voters favoring ratification of Child Labor Amendment.

The petition was referred to the Committee on Labor.

Petition No. 217. By Mr. Young. Petition of Mabel Ashburn of Bay City and two thousand three hundred and ninety other residents of Michigan favoring Sunday Closing Bill.

The petition was referred to the Committee on State Affairs.

Petition No. 218. By Mr. Cummings. Petition of Kalamazoo County Farm Bureau favoring the repeal of the Covert Road Act.

House bill No. 121 (file No. 63), entitled

A bill to amend the title and section 2 of Act No. 147 of the Public Acts of 1891, entitled "An act to provide for the election of a county commissioner of schools, for the appointment of school examiners, (and) to define the duties and fix the compensation for the same and to repeal all existing acts or parts of acts conflicting with the provisions of this act," as contained in chapter 109 of the Compiled Laws of 1915.

House bill No. 22 (file No. 64), entitled

A bill to amend sections 7 and 9, Act No. 259, Public Acts of 1919, entitled, "An act to regulate the manufacture and sale of soft drinks, syrups, extracts, and all other non-alcoholic beverages within the state and prescribe penalties for violation thereof, and repeal Act No. 288 of the Public Acts of 1915."

The Secretary announced the printing of the following entitled bills and that the said printed bills were placed on file in the Document Room of the Senate March 4, 1925.

Senate bill No. 130 (file No. 93), entitled

A bill to amend section 15 of Act No. 105 of the Public Acts of 1913, entitled "An act to provide a uniform system of probation throughout the State of Michigan; the appointment of probation officers and to prescribe the powers, duties and compensation of such officers; to provide a penalty for the violation of his duties; and to repeal Act No. 91 of the Public Acts of 1903, as amended", being section 2043 of the Compiled Laws of 1915, as amended by Act No. 143 of the Public Acts of 1921.

Senate bill No. 131 (file No. 94), entitled

A bill to amend section 40 of chapter 35 of Act No. 314 of the Public Acts of 1915, "The Judicature Act of 1915", being section 13432 of the Compiled Laws of 1915, as amended by Act No. 165 of the Public Acts of 1921.

Senate bill No. 132 (file No. 95), entitled

A bill to regulate the taking of fish in the inland waters of this State located in the west one-half of the southwest one quarter of section 15 and the east one-half of the southeast one quarter of section 16 in the township of Lockport, St. Joseph County, and also in that part of the waters of Palmer Lake in the township of Colon which lies between the south line of the north one-half of the north one-half of section 14 and the south line of State Street in the village of Colon, St. Joseph County.

Messages from the House.

A mesage was received from the House of Representatives transmitting
House bill No. 37 (file No. 24), entitled

A bill to amend section 4 of Act No. 65 of the Public Acts of 1909, as amended, entitled "An act to provide for the payment of tuition in and transportation to another district, of children who have completed the eighth grade in any school district; and to repeal Act No. 190 of the Public Acts of 1903, and all other acts and parts of acts in anywise contravening the provisions of this act;" being section 5833 of the Compiled Laws of 1915.

The message informed the Senate that the House of Representatives had passed the bill, in which action the concurrence of the Senate was requested.

The bill was read a first and second time by its title and referred to the Committee on Education.

A mesage was received from the House of Representatives transmitting
House joint resolution No. 2 (file No. 37), entitled

A joint resolution proposing an amendment to section 5 of article 8, of the State Constitution, relative to the term of office of county sheriffs.

The message informed the Senate that the House of Representatives had passed the joint resolution, in which action the concurrence of the Senate was requested. The joint resolution was read a first and second time by its title and referred to the Committee on State Affairs.

A mesage was received from the House of Representatives transmitting
House bill No. 103 (file No. 50), entitled

A bill to amend section 5 of Act No. 278 of the Public Acts of 1909, entitled "An act to provide for the incorporation of villages and for revising and amending their charters, as last amended by Act No. 395 of the Public Acts of 1919, same being section 2847 of the Compiled Laws of 1915.

The message informed the Senate that the House of Representatives had passed the bill, in which action the concurrence of the Senate was requested.

The bill was read a first and second time by its title and referred to the Committee on Towns and Counties.

Senate bill No. 109 (file No. 72), entitled

A bill to suppress gaming and to prohibit the publication and furnishing of information concerning gaming.

The following is the amendment recommended by the committee: Section 5, line 11, after the word "complaint", strike out the word "of" and insert in lieu thereof the word "or".

A bill to define and extend the powers of circuit judges.

Section 2, line 7, after the word "said", strike out the word "certificates" and insert in lieu thereof the word "certificate".

A bill to accept the provisions, requirements and benefits of an Act of the Sixty-seventh Congress of the United States, approved November 23, 1921, known and designated as Public Act No. 97, entitled "An act for the promotion of the welfare and hygiene of maternity and infancy, and for other purposes"; to promote the purposes of said act within the State of Michigan; to provide for the administration thereof and for the custody and administration of funds received by the State of Michigan thereunder, or under the provisions of this act; and

to make an appropriation to meet the terms and conditions imposed by said act of Congress and for the carrying out of the purposes thereof.

A bill to make appropriations for the State Banking Department for the fiscal years ending June 30, 1926, and June 30, 1927, for maintenance and operation. The following are the amendments recommended by the committee:

(1) Section 1, lines 10 and 11, strike out the words "two hundred twelve thousand three hundred sixty-five dollars" and insert in lieu thereof the words "two hundred thousand dollars".

(2) Section 1, lines 13 and 14, strike out the words "two hundred twelve thousand three hundred sixty-five dollars" and insert in lieu thereof the words "two hundred thousand dollars".

Section 1, line 19, strike out the figures "$132,350.00-$132,350.00" and insert in lieu thereof the figures "$124,985.00-$124,985.00".

(4) Section 1, line 21, strike out the figures "$78,515.00-$78,515.00" and insert in lieu thereof the figures "$73,515.00-$73,515.00"

(5) Section 1, line 23, strike out the figures "$212,365.00-$212,365.00" and insert in lieu thereof the figures "$200,000.00-$200,000.00"
