The Senate met pursuant to adjournment and was called to order by the President.

Reverend R. V. Starr of the Nazarene Church of Lansing offered prayer.

The roll of the Senate was called by the Secretary.

Present: Senators Atwood, Bahorski, Baxter, Bohn, Brower, Butler, Bernie L. Case, William L. Case, Condon, Cummings, Gansser, Gettel, Greene, Herald, Herrick, Hinkley, Horton, Howarth, Hunter, Karcher, Leland, Martin, Pearson, Penney, Quinlan, Truettner, Whiteley, Wilcox, Wood, Woodruff, Young-31; a quorum.

Absent with leave: Senator Henry-1.

Mr. Brower offered the following concurrent resolution:
Senate concurrent resolution No. 7.

Providing for adjournment of the two houses of the Legislature from January 22 to January 27, 1925.

Resolved by the Senate

(the House of Representatives concurring), That when the two houses of the Legislature adjourn January 22, they stand adjourned until Tuesday, January 27, 1925, at 8:30 o'clock p. m., eastern standard time. Pending the order that, under rule 59, the concurrent resolution lie over one day,

Mr. Brower moved that rule 59 be suspended.

The motion prevailed.

The concurrent resolution was then considered and agreed to.

Presentation of Petitions.

Petition No. 46. By Mr. Martin. Petition of National Republican party recommending the ratification of the Child Labor Amendment.

The petition was referred to the Committee on Labor.

Announcements by the Secretary.

The Secretary of the Senate, pursuant to the requirements of Senate rule No. 10 and Senate resolution No. 9, announced the following appointments: Secretary's Stenographer-Miss Norena Weller.

Reports of Standing Committees.

Mr. Condon submitted the following report:

The Committee on Judiciary respectfully reports back to the Senate the following entitled bill, without amendment, and with the recommendation that the bill do pass:

Senate bill No. 10 (file No. 8), entitled

A bill to amend section 11 of chapter 54 of Act No. 314 of the Public Acts of 1915, "The Judicature Act of 1915," being section 13855 of the Compiled Laws of 1915.

Mr. Condon submitted the following report:

The Committee on Judiciary respectfully reports back to the Senate the following entitled bill with amendment, recommending that the amendment be agreed to and that the bill, as thus amended, do pass:

Senate bill No. 6 (file No. 5), entitled

A bill to amend sections 1, 7 and 8 of Act No. 369 of the Public Acts of 1919, entitled "An act to supplement existing laws providing for the establishment and maintenance of municipal courts of record and defining the jurisdiction of such courts; to fix the number of judges thereof; to provide a presiding judge; to define the privileges of such presiding judge; to modify the procedure in and extend the jurisdiction of said courts in certain respects, and to provide for the abolishing of any police courts or other courts not of record having exclusive criminal jurisdiction existing in any city in which the provisions of this act become operative," as amended by Act No. 364 of the Public Acts of 1921, approved May 13, 1919.

The following is the amendment recommended by the committee:
Section 7, line 20, after the figures "1925," insert the following:

"Provided, however, that if for any reason this Act is not submitted at said election, it may be submitted at any regular, municipal or primary election held thereafter."

The report was accepted.

Mr. Case submitted the following report:

The Committee on Public Health respectfully reports back to the Senate the following entitled bill with amendment, recommending that the amendment be agreed to and that the bill, as thus amended, do pass:

Senate bill No. 16 (file No. 18), entitled

A bill to authorize the employment of public health nurses by counties.

The following is the amendment recommended by the committee: Amend Section 3, lines 8 to 16 inclusive, by striking out the following: "Provided, That no person employed or appointed under the provisions of this act shall diagnose or attempt to diagnose any case, prescribe or attempt to prescribe drugs or treatment other than ordinary and temporary means, nor use his or her position to promote the business or for the financial gain of any particular physician, surgeon, osteopath, dentist, oculist, optometrist, or any other specialist or practitioner, or in discrimination for or against any particular method or schools of healing, the practitioners of which are legally practicing in this State in the treatment of human abnormalities."

The report was accepted.

Mr. Condon introduced

Introduction of Bills.

Senate joint resolution No. 2, entitled

A joint resolution proposing an amendment to Article VIII of the State Constitution by adding thereto a new section to stand as section 31, with reference to the creation of metropolitan districts.

The joint resolution was read a first and second time by its title, ordered printed, and referred to the Committee on Towns and Counties.

Mr. Wilcox introduced

Senate bill No. 28, entitled

A bill to authorize and direct the State Highway Commissioner to lay out and establish a trunk line highway beginning at a point from the terminus of trunk line highway No. 68 in the township of Carp Lake, Ontonagon County, thence west to Silver City, thence south to the village of White Pine, thence south to the village of Bergland, connecting with trunk line highway No. 28 at the village of Bergland, Ontonagon County.

This bill was read a first and second time by its title, ordered printed, and referred to the Committee on Highways.

Mr. B. L. Case introduced

Senate bill No. 29, entitled

A bill to amend section 4 of Act No. 85 of the Public Acts of 1921, entitled "An act prescribing the fees, taxes and charges to be paid to the State by corporations doing or seeking to do business in this State; prescribing the method and basis of computing such fees, taxes and charges, requiring certain annual reports to be filed by corporations; providing for the disposition of the moneys received under this act and prescribing penalties for non-compliance with the provisions thereof," approved April 27, 1921, as amended by Act No. 233 of the Public Acts of 1923.

The bill was read a first and second time by its title, ordered printed, and referred to the Committee on Banks and Corporations.

General Orders.

Mr. Brower moved that the Senate resolve itself into Committee of the Whole for consideration of the general orders.

The motion prevailed and the President designated Mr. Brower as chairman.

Accordingly the Senate resolved itself into Committee of the Whole, with Mr. Brower in the chair.

After some time spent therein the committee rose; and, the President having resumed the chair, the committee, through its chairman, reported back to the Senate, favorably and without amendment, the following entitled bill:

Senate bill No. 5 (file No. 4), entitled

A bill to amend section 3 of Act No. 128 of the Public Acts of 1887, entitled "An act for the requiring of a civil license in order to marry, and the due registration of the same, and to provide a penalty for the violation of the provisions of the same," being section 11378 of the Compiled Laws of 1915, as amended by Act No. 195 of the Public Acts of 1917.

The bill was placed on the order of Third Reading of Bills.

Recess.

Mr. Herald moved that the Senate take a recess until 4:35 o'clock p. m. The motion prevailed, the time being 2:20 o'clock p. m.

The Senate reconvened at the expiration of the recess and was called to order by the President.

Mr. Condon moved that the Senate take a recess until 8:00 o'clock p. m.
The motion prevailed, the time being 4:40 o'clock p. m.

Designation of Presiding Officer.

The Secretary read the following communication:

"I hereby designate Senator Walter F. Truettner as presiding officer of the Senate for the session this evening."

Senator Truettner then took the Chair and the Senate took up the order of

Messages from the House.

A message was received from the House of Representatives transmitting House bill No. 15 (file No. 1) entitled

A bill to amend sections 2, 4, 6, 7, 8 and 34 of Act No. 302 of the Public Acts of 1915, entitled, "An Act to provide for the registration, identification and regulation of motor vehicles and trailers attached thereto operated upon the public highways of this state, and of the operators of such vehicles, and to provide for levying specific taxes upon such vehicles, so operated and to provide for the disposition of such funds, and to repeal all other acts or parts of acts inconsistent herewith or contrary hereto," and to add a new section thereto to stand as section 39.

The message informed the Senate that the House of Representatives had passed the bill and had ordered that it take immediate effect; in which action the concurrence of the Senate was requested.

The bill was read a first and second time by its title and referred to the Committee on Taxation.

A message was received from the House of Representatives returning
Senate concurrent resolution No. 7.

Providing for adjournment of the two houses of the Legislature from January 22, to January 27, 1925.

The message informed the Senate that the House of Representatives had concurred in the adoption of the resolution.

Mr. William L. Case asked and was granted leave of absence from the sessions of Tuesday and Wednesday.

Mr. Atwood moved that the Senate adjourn.
The motion prevailed.

Accordingly, and in pursuance of the order previously made, the Presiding Officer declared the Senate adjourned until Tuesday, January 27, 1925, at 8:30 o'clock p. m.
