A bill to amend sections 1, 3, 5, 11, 12, 15, 16, 17, 18, 20, 21, 23, 24, 26, 28, 29, 30 and 38 of Act No. 302 of the Public Acts of 1915, entitled "An act to provide for the registration, identification and regulation of motor vehicles and trailers attached thereto operated upon the public highways of this State, and of the operators of such vehicles, and to provide for levying specific taxes upon such vehicles so operated, and to provide for the disposition of such funds, and to repeal all other acts or parts of acts inconsistent herewith or contrary hereto," being sections 4797, 4799, 4801, 4807, 4808, 4811, 4812, 4813, 4814, 4816, 4817, 4819, 4820, 4822, 4824, 4825, and 4826 of the Compiled Laws of 1915, as amended and added to said act by Act No. 383 of the Public Acts of 1919; and to repeal sections 10, 13, 14, 19, 22, 25, 27, 31 and 32 of said act, being sections 4806, 4809, 4810, 4815, 4818, 4821, 4823, 4827 and 4828 of the Compiled Laws of 1915.

The House has ordered that the bill be known as the "Wells-Horton-Jewell Bill."

A message was received from the House of Representatives returning
Senate bill No. 79 (file No. 185), entitled

A bill to regulate the sale of potatoes in the State of Michigan; to fix standard grades for potatoes; to provide for inspection and penalties for violation thereof. The message informed the Senate that the House of Representatives had passed the bill.

The bill was referred to the Secretary for enrollment printing and presentation to the Governor.

A message was received from the House of Representatives, transmitting, together with the Senate amendments thereto,

House bill No. 137 (file No. 49), entitled

A bill to amend section 2 of Act No. 188 of the Public Acts of 1899, entitled "An act to provide for the taxation of inheritances, transfers of property by will, transfer of property by the intestate laws of this State or transfers of property by deed, grant, bargain, sale or gift made in contemplation of the death of the grantor, vendor or donor or intended to take effect in possession or enjoyment at or after such death," being section 14525 of the Compiled Laws of 1915, as last amended by Act No. 257 of the Public Acts of 1923.

The following are the Senate amendments to the bill:

(1) Amend section 2, by striking out lines 13 and 14 and inserting in lieu thereof the following: "of the clear market value of ten thousand dollars shall be exempt from all taxation under this act."

(2) Amend section 2, by striking out lines 15, 16 and 17 and inserting in lieu thereof the following "(b) Where the transfer is to a husband or wife such transfer of property of the clear market value of forty thousand dollars shall be exempt from all taxation under this act."

(3) Amend section 2, by striking out the word "entire" in line 21 and the word "transfer" in line 22, and inserting in lieu thereof the following: "transfer of such property in excess of the exemptions herein provided."

(4) Section 2, after line 33, insert the following proviso:

"Provided, That portion of the property so transferred to each individual of the persons included in the classes specified in paragraph one hereof, which consists of real estate, shall be taxable at three-fourths the rates specified in this act. In determining the tax payable under this act, the property subject to tax shall be deemed to consist of real and personal property in the proportions that the clear market value of the real property so transferred bears to the clear market value of the total property so transferred."

The message informed the Senate that the House of Representatives had nonconcurred in the amendments made to the bill by the Senate.

Mr. Baxter moved that the Senate insist on its said amendments and ask a conference with the House of Representatives on the matters of difference between the two houses as to the bill.

The motion prevailed.
