the Government, with employers under Government contracts or under grants-in-aid made by the Government;

(4) to encourage and promote educational programs by employer, labor, civic, educational, religious, and other nongovernmental groups in order to eliminate or reduce the basic causes of discrimination in employment because of race, color, religion, or national origin; (5) to perform the duties and functions imposed on

it by the provisions of this Act;

(6) to submit, not later than February 1 of each year, a report to the President and the Congress setting forth its activities during the preceding calendar year and its recommendations, if any, for executive or legislative action, and to submit such special reports as the President or Congress may request or the Commission deems necessary; and

(7) to perform such other duties and functions as may be prescribed, or delegated to it, by the President.

STAFF

SEC. 105. (a) There shall be an Executive Vice Chair

man of the Commission who shall be appointed by the Presi22 dent and who shall be ex officio a member of the Commission. 23 The Executive Vice Chairman shall assist the Chairman, the 24 Vice Chairman, and the members of the Commission and

1 shall be responsible for carrying out the orders and recom2 mendations of the Commission and for performing such other 3 functions as the Commission may direct. The Executive 4 Vice Chairman shall receive compensation at a rate pre5 scribed by the President, but not in excess of the scheduled 6 rate of basic compensation provided for grade GS-18 in the 7 Classification Act of 1949.

(b) The Commission is authorized to appoint, subject

to the civil service laws and regulations, such other personnel

as is necessary to enable it to carry out its functions and 11 duties, and to fix their compensation in accordance with the

12 Classification Act of 1949, and is authorized to procure serv

ices as authorized by section 15 of the Act of August 2, 1946

(60 Stat. 810; 5 U.S.C. 55a), but at rates for individuals 15 not in excess of $50 a day.

16 (c) The Commission may procure, by contract or other

wise, the services of public and private organizations and institutions.

SEC. 106. (a) The Commission or, on the authoriza

tion of the Commission, any subcommittee thereof, may,

for the purpose of carrying out its functions and duties,

hold such hearings and sit and act at such times and places, administer such oaths, and require, by subpena or

otherwise, the attendance and testimony of such witnesses,

1 and the production of such books, records, correspondence, 2 memorandums, papers, and documents as the Commission or 3 such subcommittee may deem advisable, and impose sanc4 tions and penalties as set forth below. Subpenas may 5 be issued under the signature of the Chairman or Vice 6 Chairman of the Commission, or any duly designated mem7 ber, and may be served by any person designated by the 8 Chairman, the Vice Chairman, or such member.

9 (b) In case of contumacy or refusal to obey a subpena 10 issued under subsection (a), any district court of the United 11 States or the United States court of any possession, or 12 the District Court of the United States for the District of 13 Columbia, within the jurisdiction of which the inquiry is being 14 carried on or within the jurisdiction of which the person 15 guilty of contumacy or refusal to obey is found or resides 16 or transacts business, upon application by the Attorney 17 General of the United States shall have jurisdiction to 18 issue to such person an order requiring such person to 19 appear before the Commission or a subcommittee thereof, 20 there to produce evidence if so ordered, or there to give 21 testimony touching the matter under inquiry; and any 22 failure to obey such order of the court may be punished 23 by the court as a contempt thereof.

(c) The Commission is authorized to secure from

25 any department, agency, or independent instrumentality

1 of the executive branch of the Government any informa2 tion it deems necessary to carry out its functions and duties. 3 Each such department, agency, and instrumentality is author4 ized and directed to furnish such information to the Commis5 sion, upon request made by the Chairman or the Vice 6 Chairman, and to cooperate with the Commission and to 7 furnish it such assistance as it may require in carrying out its 8 functions and duties.

9 (d) The Commission is authorized to delegate to any 10 officer, agency, or employee in the executive branch of the 11 Government any function of the Commission under this 12 Act, except the authority to promulgate rules and regulations 13 of a general nature.

(e) The Commission shall adopt such rules and regula15 tions and issue such orders as it deems necessary and appro

16 priate to achieve the purposes of this Act.

TITLE II-FEDERAL EMPLOYMENT

GENERAL

SEC. 201. It shall be unlawful for any department or 20 agency of the Federal Government to discriminate against 21 any Federal employee or applicant for Federal employment, 22 in the terms, conditions, or privileges of employment, because 23 of race, color, religion, or national origin. Any such person 24 who is aggrieved as a result of discrimination in violation of

1 this section may file a complaint with such department or

agency, or with the Commission.

ENFORCEMENT AND SANCTIONS

4 SEC. 202. (a) Each department and agency shall be 5 primarily responsible for complying with the rules, regula6 tions, and orders of the Commission with respect to non7 discrimination in employment. Each department and agency shall cooperate with the Commission, and furnish the 9 Commission such information and assistance as it may require 10 in the performance of its functions under this title. Each de

partment and agency shall appoint or designate, from among 12 its personnel, an officer or officers to be responsible for

13

assuring equal employment opportunities.

14 (b) The Commission may receive and cause to be in15 vestigated complaints by employees or prospective em16 ployees of a Government department or agency, which 17 allege discrimination contrary to the provisions of this title 18 or the rules and regulations issued hereunder. The appro19 priate department or agency shall report to the Commission 20 what action has been taken or is recommended with regard

(c) If the Commission so directs, the Department or
