2 lency the Governor be, and he hereby is, authoriz3 ed, to direct the necessary arrangements to be made 4 within the State House as aforesaid, for printing and 5 preparing the Bills aforesaid, and for the proper ac6 commodation of the Commissioner in the discharge 7 of his duties, and he is hereby authorized to draw his 8 warrant on the Treasury for any sum not exceeding 9 Ten thousand dollars, which may be required to 10 carry the provisions of this act into effect.

SEC. 6. Be it further enacted, That from and 2 after the

no Bank incorporated,.

3 4 or which hereafter may be incorporated by authority 5 of this Commonwealth, shall issue any bills as cur6 rency, except they be printed and prepared in man7 ner aforesaid, under the direction of said Commis8 sioner, and any Bank within this Commonwealth 9 which shall thereafter issue any other bill or note, 10 shall forfeit and pay to the Commonwealth double 11 the amount of such bill or note so issued.

SEC. 7. Be it further enacted, That said Com2 missioner, when he shall be prepared to furnish bills, 3 according to the provisions of this act, shall give 4 notice thereof in writing to the Cashiers of the sev5 eral Banks, and shall furnish them with impressions 6 from the materials, from which said Bills are to be 7 printed; and after the notice aforesaid, no Bank 8 shall procure to be printed, any Bill for circulation, 9 by any other person than said Commissioner, under 10 a penalty of one hundred dollars for each offence.

SEC. 7. Be it further enacted, That said Com2 missioner shall enter into bonds to the Common3 wealth, with proper sureties to the satisfaction of

4 His Excellency the Governor, in the penal sum of

dollars,

6 for the faithful performance of his duties, under this 7 act, and he shall be entitled to receive

8

dollars per annum,

9 in full compensation for his services; and shall hold 10 his office during the pleasure of the Governor and 11 Council.

1 SEC. 8. Be it further enacted, That upon appli2 cation of the President and Directors of any Bank 3 within this Commonwealth, for a designating orna4 ment or vignette, to be put upon their bills exclu5 sively, it shall be the duty of said Commissioner to 6 cause a die or plate to be prepared at the expense 7 of said Bank, to be used in the printing of their 8 bills, provided the same can be done consistently 9 with the general arrangement of the plates.

SEC. 9. Be it further enacted, That all acts and 2 parts of acts, inconsistent with the provisions of this 3 act be, and the same are, hereby repealed.

The Committee of both Houses on Railways and Canals, to whom was referred the petition of Job Chase, Jr., and others, inhabitants of Harwich and Dennis, for liberty to make improvements in Herring River, have considered the subject, and ask leave to report a Bill.

AN ACT

To Incorporate the Herring River Company, in the Town of Harwich.

SEC. 1. BE it enacted by the Senate and House 2 of Representatives in General Court assembled, and 3 by the authority of the same, That Job Chase, Jr., 4 Elijah Chase, Anthony Kelley, Joseph Kelley, Joshua 5 Wixon, Jr., and Richard Baker, their associates, suc6 cessors and assigns, be, and they hereby are made a 7 body politic and corporate, by the name of the Her8 ring River Company, for the purpose of deepening 9 the channel and improving the navigation and the 10 Alewife fishery of said River; and by their corporate 11 name may sue and be sued, plead and be impleaded, 12 may have a common seal, and the same may alter at

13 pleasure; and shall have power to appoint all such 14 officers and make such by-laws and regulations as 15 shall be necessary for the management of their con-" 16 cerns, and for carrying into effect the purposes of this 17 Act: Provided, the same be not inconsistent with 18 the laws of this Commonwealth.

SEC. 2. Be it further enacted, That the property 2 of said company shall be divided into one hundred 3 shares, and all assessments made by said company 4 for expenses, or for the erection or construction of 5 works in conformity with the provisions of this Act, 6 or for the payment of damages recovered of this com7 pany, shall be equally apportioned upon all the shares 8 of said company, and the private property of each 9 member of said company shall be holden for the pay10 ment of all such assessments; and such assessments 11 shall never exceed the sum of twenty dollars upon 12 each share, except for the payment of damages which 13 may have been recovered of said company: and the 14 private property of each member of said company 15 shall be holden for the payment of any debt or dam16 age for which said company shall be liable.

Be it further enacted, That the said company shall have power to construct and erect dams, 3 locks, and other works across and upon said river at 4 suitable places, and also to erect piers, wharves, and 5 dykes at the mouth and upon the banks of said river, 6 for the purpose of deepening and preserving the chan7 nel, and facilitating the navigation and benefiting the 8 Alewife fishery on said river: Provided, the said 9 company shall not appropriate to its use any individu10 al property, or infringe or trespass upon any private 11 or corporate rights or privileges, or do any act to the
