In the Year of our Lord One Thousand Eight Hundred and Thirty-Three.

AN ACT

In amendment of an Act making further Provision for the redemption of Mortgages, passed February 18, A. D. 1822.

SEC. 1. BE it enacted by the Senate and House 2 of Representatives in General Court assembled, and 3 by the authority of the same, That the proviso in 4 the first section of said act, in the following words, 5 viz:-" Provided the mortgagee, or those claiming 6 under him, shall on request have refused or neglected 7 truly to state his or their account of the sum due on 8 said mortgage, before the commencement of such 9 suit," be and the same is hereby repealed.

1 SEC. 2. Be it further enacted, That unless it shall 2 appear to the Court, that the mortgagee or other de3 fendant, in any of the cases in said act mentioned,

4 has refused or unreasonably neglected to render a 5 just and true account, when there to requested, of the money due on the mortgage, and of the rents and 7 profits of the mortgaged premises, and of the money 8 expended in the repairs or improvements thereof, if 9 any, or that he has otherwise, by his default prevent10 ed the plaintiff or complainant from performing the 11 condition of the mortgage before the commencement 12 of the suit, the plaintiff shall pay to the defendant 13 his costs.

To Prevent the Destruction of Beach Grass, in the Towns of Provincetown and Truro.

1 SEC. 1. BE it enacted by the Senate and House of 2 Representatives in General Court assembled, and by 3 the authority of the same, That from and after the 4 passing of this Act, no neat cattle, horses or sheep 5 shall be permitted to go at large in the town of Pro6 vincetown, nor on that tract of land situate in the 7 town of Truro, between the line which divides the 8 towns of Provincetown and Truro, and a line drawn 9 parallel with the aforesaid line from the foot of East10 ern Harbor Meadow in Truro, to the northern side 11 of Cape Cod, in Barnstable County. And if any per12 son shall voluntarily suffer any of the creatures afore13 said to go at large over the aforementioned lands, 14 whether the same be Province lands or private pro15 perty, he shall forfeit and pay to the use of the person
