Mr. Gansser asked and was granted leave of absence from tomorrow's session. Mr. Wood asked and was granted indefinite leave of absence.

Mr. Henry moved that the Senate adjourn.

The motion prevailed, the time being 2:38 o'clock p. m.

Accordingly, and in pursuance of the order previously made, the President declared the Senate adjourned until tomorrow, Thursday, February 8, 1923, at 2:00 o'clock p. m.

Religious exercises were conducted by Rev. J. P. Jockinsen of the Pilgrim Congregational Church of Lansing.

The roll of the Senate was called by the Secretary.

Present: Senators Bahorski, Bohn, Brower, Bernie L. Case, William L. Case, Connelly, Eldred, Gettel, Glaspie, Hayes, Henry, Horton, Hunter, Johnson, Karcher, MacNaughton, Pearson, Penney, Riopelle, Sligh, Smith, Truettner, Wilcox, Young -24; a quorum.

Absent with leave: Wood-6.

Absent without leave:

Senators Condon and Osborn-2.

Mr. MacNaughton moved that the absentees without leave be excused from today's session.

Presentation of Petitions.

Petition No. 82. By Mr. Bohn. Resolution of the Trades and Labor Council opposing the enactment of a capital punishment law in this State.

The petition was referred to the Committee on Judiciary.

Petition No. 83. By Mr. Karcher. Resolution by the Board of Supervisors of Alcona County favoring township officers holding office for two years instead of

one.

The petition was referred to the Committee on Counties and Townships.

Petition No. 84. By Mr. W. L. Case. Petition of R. Cas and many other citizens of Grand Traverse County favoring the passage of the capital punishment bill. The petition was referred to the Committee on Judiciary.

Messages From the House.

A message was received from the House of Representatives transmitting
House bill No. 78 (file No. 12), entitled

A bill to amend section 6 of chapter 83 of the Revised Statutes of 1846, entitled "Of marriage and the solemnization thereof," being section 11367 of the Compiled Laws of 1915.

The message informed the Senate that the House of Representatives had passed the bill.

The bill was read a first and second time by its title and referred to the Committee on Public Health.

Reports of Standing Committees.

Mr. Eldred submitted the following report:

The Committee on State Affairs respectfully reports back to the Senate the following entitled bill with amendments, recommending that the amendments be agreed to and that the bill, as thus amended, do pass:

Senate bill No. 42, entitled

A bill to make appropriations for the Superintendent of the Capitol for the fiscal years ending June 30, 1924, and June 30, 1925, for maintenance, operation and other purposes.

The following are the amendments recommended by the committee:

1. Section 1, strike out line 4 and insert in lieu thereof "one hundred ninetynine thousand four hundred sixty-five dollars."

2. Section 1, strike out line 7 and insert in lieu thereof "one hundred seventynine thousand nine hundred fifty dollars."

3. Section 1, strike out lines 12 to 21, inclusive, and insert in lieu thereof the following:

The amendments recommended by the committee were agreed to and the bill, as thus amended, was referred to the Committee on Finance and Appropriations under the rules.

Introduction of Bills.

Senate bill No. 127, entitled

A bill to amend section 1 of Act No. 266 of the Public Acts of 1895, entitled "An act relative to bonds and other obligations, with surety or sureties, and the acceptance as surety thereon of companies qualified to act as such, and the release of such surety, and the safe depositing of assets for which such surety may be liable, and to the charging by fiduciaries of the expense of procuring sureties, and repealing all laws in conflict therewith," being section 9219 of the Compiled Laws of 1915.

The bill was read a first and second time by its title, ordered printed, and referred to the Committee on Insurance.

Mr. Truettner introduced

Senate bill No. 128, entitled

A bill to amend section 27 of Act No. 205 of the Public Acts of 1887, entitled "An act to revise the laws authorizing the business of banking, and to establish a banking department for the supervision of such business," being section 7996 of the Compiled Laws of 1915, as last amended by Act No. 23 of the Public Acts of 1919.

The bill was read a first and second time by its title, ordered printed, and referred to the Committee on Banks and Corporations.

Mr. William L. Case introduced

Senate bill No. 129, entitled

A bill to define as manslaughter the selling, giving or furnishing of intoxicating liquors where death results from the drinking thereof, and to provide a penalty. The bill was read a first and second time by its title, ordered printed, and referred to the Committee on Prohibition.
