JOURNAL OF THE SENATE NUMBER NINE. Senate Chamber, Lansing, Thursday, January 18, 1923. 2:00 o'clock p. m. The Senate met pursuant to adjournment and was called to order by the President. Religious exercises were conducted by Rev. L. B. Bissell, pastor of the Mt. Hope Avenue Presbyterian Church of Lansing. The roll of the Senate was called by the Secretary. Present: Senators Bahorski, Brower, Bernie L. Case, William L. Case, Condon, Connelly, Eldred, Gansser, Henry, Horton, Hunter, Johnson, Leland, MacNaughton, Riopelle, Ross, Sligh, Whiteley, Wood-19; a quorum. Absent with leave: Senators Bohn, Gettel, Glaspie, Osborn, Pearson, Penney, Smith, Truettner, Wilcox and Young-10. Absent without leave: Senators Atwood, Hayes and Karcher-3. Mr. Henry moved that the absentees without leave be excused from today's session. The motion prevailed. Presentation of Petitions. Petition No. 20. By Mr. Leland. Petition of the Board of Supervisors of Van Buren County opposing repeal of the Primary School Fund Law. The petition was referred to the Committee on Education. Petition No. 21. By Mr. Leland. Petition of the Board of Supervisors of Van Buren County that the present specific tax on mortgages of one-half of one per per cent for the life of said mortgage be repealed or amended so as to require the payment of one-half of one per cent annual tax thereon, and that said amended law include and cover all other securities that are now non-taxable. The petition was referred to the Committee on Taxation. Petition No. 22. By Mr. Leland. Petition of the Board of Supervisors of Van Buren County that the Legislature pass a law providing for the collection at the source of a tax of one cent a gallon on all gasoline sold in the State, the proceeds of said tax to be put into a sinking fund for the purpose of retiring the highway bonds of the State. The petition was referred to the Committee on Highways. Petition No. 23. By Mr. Leland. Petition of the Board of Supervisors of Van Buren County that the Legislature place a fair tax on commercial trucks and busses, the proceeds of said tax to be placed to the credit of the highway maintenance fund. The petition was referred to the Committee on Highways. Petition No. 24. By Mr. Leland. Petition of the Board of Supervisors of Van Buren County that a law be passed taxing insurance companies on the same basis as other businesses. The petition was referred to the Committee on Insurance. Petition No. 25. By Mr. Leland. Petition of the Board of Supervisors of Van Buren County that interurban railroads be assessed as are other railroads. The petition was referred to the Committee on Railroads. Petition No. 26. By Mr Leland. Petition of the Board of Supervisors of Van Buren County that the stock of trust companies and building and loan companies be taxed on the same basis as bank stock. The petition was referred to the Committee on Banks and Corporations. Petition No. 27. By Mr. Leland. Petition of the Board of Supervisors of Van Buren County favoring an amendment to repeal Section 14, Article XI of the Constitution in regard to fines collected for violation of penal laws. The petition was referred to the Committee on Judiciary. Petition No. 28. By Mr. Leland. Petition of the Board of Supervisors of Van Buren County favoring automobile and other vehicle lighting law. The petition was referred to the Committee on Highways. Petition No. 29. By Mr. Leland. Petition of the Board of Supervisors of Van Buren County favoring amending the Corporation Tax Act, and taxing stock of foreign corporations. The petition was referred to the Committee on Taxation. Petition No. 30. By Mr. Karcher. Resolution of the Board of Supervisors of Osceola County to amend Mother's Pension Law. The petition was referred to the Committee on State Affairs. Petition No. 31. By Mr. Karcher. Resolution of the Tawas City Board of Trade protesting against the use of Primary School money for any other purposes. The petition was referred to the Committee on Education. Petition No. 32. By Mr. Karcher. Resolution of the Board of Supervisors of Tawas City protesting the use of Primary School money for other state purposes. The petition was referred to the Committee on Education. Petition No. 33. By Mr. Horton. Resolution of the Board of County Road Commissioners relative to the change in the Covert Act. The petition was referred to the Committee on Highways. Petition No. 34. By Mr. Johnson. Resolution of the Board of Supervisors favor ing appropriation for State Reward Roads. The petition was referred to the Committee on Highways. Reports of Standing Committees. Mr. Condon submitted the following report: The Committee on Judiciary respectfully reports back to the Senate the following entitled bill with amendment, recommending that the amendment be agreed to and that the bill, as thus amended, do pass: Senate bill No. 26 (file No. 15), entitled: A bill to amend section 1 of Act No. 271 of the Public Acts of 1919, entitled "An act to punish the giving of checks, drafts or orders on any bank or other depository, wherein the person so giving such check or draft, shall not have sufficient funds or credit for the payment of the same," approved May 13, 1919. The following is the amendment recommended by the committee: Section 1, lines 2 and 3, strike out the words "or merchandise." The report was accepted. GEO. M. CONDON, Chairman. The amendment recommended by the committee was agreed to and the bill, as thus amended, was referred to the Committee of the Whole. Mr. Condon submitted the following report: The Committee on Judiciary respectfully reports back to the Senate the following entitled bill, without amendment, and with the recommendation that the bill do pass: Senate bill No. 12 (file No. 11), entitled: A bill to amend section 1 of Act No. 213 of the Public Acts of 1915, entitled "An act to provide for a presiding circuit judge and for the manner of his selection, to prescribe his powers and duties and to defray the expenses incident thereto," being section 14546 of the Compiled Laws of 1915. The report was accepted. The bill was referred to the Committee of the Whole. GEO. M. CONDON, Chairman. Introduction of Bills. Mr. Johnson introduced Senate bill No. 54, entitled A bill to designate the holidays to be observed in the acceptance and payment of bills of exchange and promissory notes, in the holding of courts and relative to the continuance of suits, and to repeal Act No. 124 of the Public Acts of 1865 and Act No. 185 of the Public Acts of 1893. The bill was read a first and second time by its title, and referred to the Committee on Banks and Corporations. Mr. Johnson also introduced Senate bill No. 55, entitled A bill to amend section 1 of Act No. 11 of the Public Acts of 1911, entitled "An act designating the days to be observed as holidays in the public schools of this State," being section 5823 of the Compiled Laws of 1915, as amended by Act No. 72 of the Public Acts of 1919. The bill was read a first and second time by its title, and referred to the Committee on Education. On motion of Mr. Condon, Five hundred additional copies of Senate bill No. 11 (file No. 9) were ordered printed in pamphlet form. Appointment by the Secretary. The Secretary of the Senate, pursuant to the provisions of Senate rule No. 10, announced the appointment of Marie Daly, as stenographer to the Secretary. Messages From the House. A message was received from the House of Representatives transmitting A resolution providing for adjournment for more than three days. Resolved by the House of Representatives (the Senate concurring), That when the Legislature adjourns today it stand adjourned until Tuesday, January 23, at 4:00 o'clock p. m. The message informed the Senate that the House of Representatives had adopted the concurrent resolution; in which action the concurrence of the Senate was requested. Pending the order that, under rule 59, the concurrent resolution lie over one day, Mr. Henry moved that rule 59 be suspended. The motion prevailed. The concurrent resolution was then considered and adopted. Mr. Bahorski moved that the Senate adjourn. The motion prevailed, the time being 2:24 o'clock p. m. Accordingly, and pursuant to the provisions of House concurrent resolution No. 10, the President declared the Senate adjourned until Tuesday, January 23, at 4:00 o'clock p. m. DENNIS E.
