JOURNAL OF THE SENATE

NUMBER TEN.

Senate Chamber, Lansing, Tuesday, January 23, 1923. 4:00 o'clock p. m.

The Senate met pursuant to adjournment and was called to order by the President.

Religious exercises were conducted by Rev. D. T. Grey of the Olivet Baptist Church of Lansing.

The roll of the Senate was called by the Secretary.

Present: Senators Atwood, Bahorski, Bohn, Brower, Bernie L. Case, Condon, Connelly, Gansser, Gettel, Glaspie, Henry, Hunter, Leland, MacNaughton, Riopelle, Ross, Sligh, Smith, Truettner, Whiteley, Wilcox, Wood, Young-23; a quorum.

Absent with leave: Senators Osborn, Pearson and Penney-3.

Absent without leave:

Johnson and Karcher-6.

Senators William L. Case, Eldred, Hayes, Horton,

Mr. MacNaughton moved that the absentees without leave be excused from today's session.

The motion prevailed.

Bills Printed and Filed.

The Secretary announced the printing of the following entitled bills and that the said printed bills were placed on file in the Document Room of the Senate January 20, 1923:

Senate Bill No. 30 (file No. 17),

To provide a poll tax on male inhabitants of State, etc.

Senate Bill No. 31 (file No. 18),

To amend section 9, Act No. 392, L. A. of 1891-increasing salary of jurors of circuit court commissioners' court of Wayne County.

The Secretary also announced the printing of the following entitled bills and that the said printed bills were placed on file in the Document Room of the Senate January 23, 1923:

Senate Bill No. 33 (file No. 19),

To amend section 4, Act No. 205, P. A. of 1887-giving all banks trust powers, etc.

Senate Bill No. 34 (file No. 20),

To amend section 9, chap. 18, Act No. 314, P. A. of 1915-relative to affidavit of merits.

Senate Bill No. 41 (file No. 21),

To make appropriations for the Legislature.

Senate Bill No. 52 (file No. 22),

To amend sections 1 and 2, Act No. 188, P. A. of 1899-relative to inheritance taxes, etc.

Introduction of Bills.

Mr. Bahorski introduced

Senate bill No. 56, entitled

A bill for the suppression of gaming.

The bill was read a first and second time by its title, ordered printed and referred to the Committee on Judiciary.

Mr. Bahorski also introduced

Senate bill No. 57, entitled

A bill to fix and regulate the salaries of circuit court commissioners, and to provide for the appointment, fix and regulate the number and the salaries of the clerks and deputy clerks and other employees in the office of the circuit court commissioners in the several counties of the State, and to repeal all acts or parts of acts, whether general, local or special, contravening the provisions of this act.

The bill was read a first and second time by its title, ordered printed and referred to the Committee on Judiciary.

Mr. Condon introduced

Senate bill No. 58, entitled

A bill to amend section 14 of Chapter 67 of the Revised Statutes of 1846, "Of title to real property by descent," being section 11808 of the Compiled Laws of 1915, as added by Act No. 81 of the Public Acts of 1891.

The bill was read a first and second time by its title, ordered printed and referred to the Committee on Judiciary.

Mr. Condon also introduced

Senate bill No. 59, entitled

A bill to amend section 1 of Act No. 348 of the Public Acts of 1917, entitled "An act to bar debts and obligations against deceased persons and the estates of deceased persons, in certain cases, and to repeal Act No. 256 of the Public Acts of 1915, the same being compilers' section 14620 of the Compiled Laws of 1915, and all acts or parts of acts inconsistent with the provisions of this act," approved May 10, 1917.

The bill was read a first and second time by its title, ordered printed and referred to the Committee on Judiciary.

Mr. Condon also introduced

Senate bill No. 60, entitled

A bill to amend the title and section 8 of Act No. 368 of the Public Acts of 1919, entitled "An act to provide for the licensing of operators of motor vehicles, and the suspension and revocation of such licenses in certain cases," approved May 13, 1919.

The bill was read a first and second time by its title, ordered printed and referred to the Committee on Highways.

Mr. Bernie L. Case introduced

Senate bill No. 61, entitled

A bill to amend section 1 of Act No. 269 of the Public Acts of 1919, entitled "An act to permit the taking of suckers and redsides by seines, drag net or spear in the waters of the Chippewa and Pine rivers and their tributaries in Isabella and Midland counties, during the months of March and April in each year," approved May 12, 1919.

The bill was read a first and second time by its title, ordered printed and referred to the Committee on Conservation.

Mr. Young introduced

Senate bill No. 62, entitled

A bill to provide for the sufficiency of train crews on freight and passenger trains and yard crews within the State of Michigan and to fix a penalty for the violation thereof, making it the duty of the Michigan Public Utilities Commission to enforce the provisions of this act.

The bill was read a first and second time by its title, ordered printed and referred to the Committee on Railroads.

Motions and Resolutions.

Mr. Henry offered the following:

Senate resolution No. 21.

Resolved, That the President of the Senate be and is hereby authorized to appoint as employes of the Senate, the following persons:

Clerks: Rose Boyd (in place of Elizabeth Shaw who declines the position) and Pearl Gilmore.

The resolution was adopted.

The President thereupon announced the appointment of the above named persons to the positions named.

Assignment of Committee Clerks.

Mr. Henry submitted the following report:

The Select Committee appointed to group the Senate Committees and assign rooms and clerks thereto, respectfully recommends the following assignment of clerks:

The report was accepted and adopted.

Mr. Brower offered the following resolution:
Senate resolution No. 22.

Resolved, That the President of the Senate be and is hereby authorized to issue vouchers in favor of the members of the Committees on State Institutions and the Committee on Conservation upon proper certification approved by the Chairman of the respective committees of the expense incurred by such members in making their visits to the said institutions.

The resolution was adopted.

Mr. Brower offered the following resolution:
Senate resolution No. 23.

Resolved. That the Finance and Appropriations Committee be authorized to investigate any or all of the State Institutions for the purpose of determining their respective requirements, and that the expense incurred be paid upon proper certification.

The resolution was adopted.

General Orders.

Mr. Henry moved that the Senate resolve itself into Committee of the Whole for consideration of the general orders.

The motion prevailed and the President designated Mr. Henry as chairman. Accordingly the Senate resolved itself into Committee of the Whole, with Mr. Henry in the chair.

After some time spent therein the committee rose; and, the President having resumed the chair, the committee, through its chairman, reported back to the Senate, favorably and without amendment, the following entitled bill:

Senate bill No. 12 (file No. 11), entitled:

A bill to amend section 1 of Act No. 213 of the Public Acts of 1915, entitled "An act to provide for a presiding circuit judge and for the manner of his selection, to prescribe his powers and duties and to defray the expenses incident thereto," being section 14546 of the Compiled Laws of 1915.

The bill was placed on the order of Third Reading of Bills.

Mr. Smith moved that the Senate adjourn.

The motion prevailed. the time being 4:16 o'clock p. m.

Accordingly, the President declared the Senate adjourned until tomorrow, Wednesday, January 24, at 2:00 o'clock p. m.

The Senate met pursuant to adjournment and was called to order by the President.

The roll of the Senate was called by the Secretary.

Present: Senators Atwood, Bahorski, Bohn, Brower, Bernie L. Case, Condon, Connelly, Eldred, Gansser, Gettel, Glaspie, Hayes, Henry, Horton, Hunter, Karcher, Leland, MacNaughton, Osborn, Riopelle, Ross, Sligh, Smith, Truettner, Whiteley, Wilcox, Wood, Young-28; a quorum.

Absent with leave: Senators Pearson and Penney-2.

Absent without leave: Senators William L. Case and Johnson-2.

On motion of Mr. Leland, indefinite leave of absence was granted to Senator William L. Case.

Mr. Osborn moved that Mr. Johnson be excused from today's session.
The motion prevailed.

Presentation of Petitions.

Petition No. 35. By Mr. Smith. Petition of H. A. Lamb and 34 others, citizens of St. Clair County, asking for a special tax on gasoline for the purpose of maintenance of highways.

The petition was referred to the Committee on Highways.

Great Lakes Tidewater Commission.

The following communication from the Governor was received and read:

To the Honorable, The President of the Senate:

January 18, 1923.

Sir: As required by Act No. 138 of the Public Acts of 1921, I beg to submit herewith a report of the Great Lakes Tidewater Commission.

ALEX. J. GROESBECK, Governor.

The report accompanying the Governor's communication was referred to the Committee on Conservation.

Mr. Osborn moved that 500 copies of the report be printed in pamphlet form for the use of the Senate.
