4:00 o'clock p. m.

The Senate met pursuant to adjournment and was called to order by the President.

Religious exercises were conducted by Rev. Thomas Brownlow of the Michigan Avenue Methodist Church of Lansing.

The roll of the Senate was called by the Secretary.

Present: Senators Bahorski, Bohn, Brower, Bernie L. Case, William L. Case, Condon, Connelly, Eldred, Gansser, Gettel, Glaspie, Henry, Horton, Hunter, Karcher, Leland, MacNaughton, Osborn, Pearson, Riopelle, Ross, Sligh, Smith, Whiteley, Wilcox, Wood, Young-27; a quorum.

Absent with leave: Senators Penney and Truettner-2.

Absent without leave: Senators Atwood, Hayes and Johnson-3.

Mr. Henry moved that the absentees without leave be excused from today's ses

sion.

The motion prevailed.

On motion of Mr. Connelly, Senator Penney was excused from tomorrow's session.

On motion of Mr. Smith, Senator Truettner was excused from tomorrow's session.

Presentation of Petitions.

Petition No. 40. By Mr. William L. Case. Petition of the Board of Supervisors of Benzie County, Michigan, protesting the diverting of the Primary School Fund. The petition was referred to the Committee on Education.

The Secretary announced that the following named bills had been printed and placed upon the files of the Senators, January 25:

To suppress gaming.

To fix and regulate the salaries of circuit court commissioners, etc.

To amend section 14 of chapter 67 of the Revised Statutes of 1846, "Of title to real property by descent," estates of adopted persons.

Senate bill No. 59 (file No. 26)—

To amend section 1 of Act No. 348, P. A. of 1917-debts and obligations against estates of deceased persons.

Senate bill No. 60 (file No. 27)-

To amend the title and section 8 of Act No. 368, P. A. of 1919-relative to im pounding of motor vehicles in case of violation of motor vehicle laws.

Senate bill No. 61 (file No. 28)

To amend section 1 of Act No. 269, P. A. of 1919-regarding fishing in Chippewa and Pine rivers, Isabella and Midland counties.

Senate bill No. 62 (file No. 29)

"Full crews" on passenger and freight trains.

The Secretary also announced that the following named bills had been printed and placed upon the files of the Senators, January 27:

Senate bill No. 63 (file No. 30)—

To amend section 62 of chapter 18, Act No. 314 of the P. A. of 1915, the Judica ture Act-appeals to Supreme Court when motion for new trial is granted or denied.

Senate bill No. 64 (file No. 31)

To amend section 11 of Act No. 326, P. A. of 1913-leasing of certain lands on St. Clair Flats, Harsens Island, etc.

Senate bill No. 65 (file No. 32)

To control possession of, etc., and to provide penalties for the unlawful use of firearms.

Senate bill No. 66 (file No. 33)-

Imposing a State tax on gasoline and on all other liquids containing any deriv ative of petroleum or natural gas.

Senate bill No. 68 (file No. 34)

To amend the Judicature Act of 1915, so as to divide the State into ten judicia! circuits.

The Secretary also announced that the following named bills had been printed and placed upon the files of the Senators, January 29:

Senate bill No. 69 (file No. 35)—

To amend sections 1, 2, 3, 4, 7, 8, 9, 10, 11, 12 and 13 of chapter 4 of paragraph i of Act No. 256 of the P. A. of 1917-the general insurance law-relative to rating bureaus.

Senate bill No. 70 (file No. 36)—

To amend sections 6, 7 and 10 of chapter 15 of the Revised Statutes of 1846 -relative to the removal of county officers by the Governor.

Senate bill No. 72 (file No. 37)

To promote safety of railroad employees and traveling public by requiring rail road engines equipped with fire box doors.

The Secretary also announced that the following named bills had been printed and placed upon the files of the Senators, January 29:

To promote safety of general public by requiring railroad locomotives equipped with bell ringers.

Senate bill No. 7 (file No. 39)

To repeal act No. 287 of P. A. of 1921--providing for the collection of agricul tural statistics by township and city assessing officers.

The Secretary also announced that the following named bill had been printed and placed upon the files of the Senators, January 16:

House bill No. 13 (file No. 1)

To amend section 1 of Act No. 246 of P. A. of 1907-making it a misdemeanor to throw any stone, brick or other missile at any passenger train, sleeping car, passenger coach, express car, mail car, baggage car, or any street or trolley car

To amend sections 5, 12 and 13 of Act No. 117 of 1921--to provide for the protection of game and birds.

To amend sections 2 and 4 of Act 93 of 1921-to provide for the licensing of persons to take deer.

House bill No. 9 (file No. 4)

To amend section 9 of chapter 1, of part 3 of Act 84 of 1921-to provide for the organization, regulation and classification of domestic corporation.

The Secretary also announced that the following named bills had been printed and placed upon the files of the Senators, January 26:

House bill No. 12 (file No. 5)

To repeal Act No. 70 of the P. A. of 1911-regulating taxation of steam watercraft of registered tonnage within the State of Michigan.

House bill No. 20 (file No. 6)--

Providing for annual specific tax upon the class of credits founded upon and evidenced by mortgages and liens upon real property.

The Secretary also announced that the following named bills had been printed and placed upon the files of the Senators, January 27:

House bill No. 40 (file No. 7)—

Providing for annual specific tax upon foreign securities.

House bill No. 51 (file No. 8)

To amend section 8 of Act No. 206 of P. A. of 1893-general tax law-personal property.

House bill No. 68 (file No. 9)

Providing for annual specific tax upon bonds, notes, or other evidences of debt, hereafter issued by the State of Michigan or by any county, city, village, township, school district, or road district.

House bill No. 71 (file No. 10)

To repeal Act No. 91 of P. A. of 1911-mortgage tax law.

House bill No. 85 (file No. 11)

Imposing a State tax on gasoline and on all other liquids containing any derivative of petroleum or natural gas.

Messages From the House.

A message was received from the House of Representatives transmitting
House bill No. 13 (file No. 1), entitled

A bill to amend the title and section 1 of Act No. 246 of the Public Acts of 1907, entitled "An act making it a misdemeanor to throw any stone, brick or other missile at any passenger train, sleeping car, passenger coach, express car, mail car. baggage car, or any street or trolley car, and providing a penalty therefor," being section 8448, Compiled Laws 1915.

The message informed the Senate that the House of Representatives had passed the bill.

The bill was read a first and second time by its title and referred to the Committee on Judiciary.

Introduction of Bills.

Mr. Wood introduced

Senate joint resolution No. 2, entitled

A joint resolution proposing an amendment to Article XVI of the Constitution, by adding a new section thereto to stand as section 12 of said article, providing for a death penalty in certain cases.

The joint resolution was read a first and second time by its title, ordered printed, and referred to the Committee on Judiciary.

Mr. Wood also introduced

Senate bill No. 74, entitled

A bill to provide certain requirements in written instruments conveying or mortgaging real estate or any interest therein, and to provide for the recording thereof and fees therefor in certain cases.

The bill was read a first and second time by its title, ordered printed, and referred to the Committee on Judiciary.

Mr. Bahorski introduced

Senate bill No. 75, entitled

A bill to authorize and empower counties within the State of Michigan by and through their administrative boards or bodies to take and appropriate private property for public use, to establish a procedure and method for determining the necessity for such taking, and to provide for the payment of a just compensation therefor.

The bill was read a first and second time by its title, ordered printed, and referred to the Committee on Counties and Townships.

Mr. Riopelle introduced

Senate bill No. 76, entitled

A bill to authorize the incorporation of credit unions, to prescribe their powers and purposes, and for the supervision of corporations formed hereunder.

The bill was read a first and second time by its title, ordered printed, and referred to the Committee on Banks and Corporations.

Mr. Bohn introduced

Senate bill No. 77, entitled

A bill authorizing the Auditor General to cancel the taxes of the years 1885 and 1886 on all descriptions of land on which the taxes remain unpaid.

The bill was read a first and second time by its title, ordered printed, and referred to the Committee on Taxation.

Mr. Bohn also introduced

Senate bill No. 78, entitled

A bill to amend section 9 of Act No. 302 of the Public Acts of 1915, entitled, as amended, “An act to provide for the registration, identification and regulation of motor vehicles and trailers attached thereto operated upon the public highways of this State, and of the operators of such vehicles, and to provide for levying specific taxes upon such vehicles so operated, and to provide for the disposition of such funds and to exempt from all other taxation such motor vehicles so specifically taxed, registered, identified, and regulated, and to repeal all other acts or parts of acts inconsistent herewith or contrary hereto," being section 4805 of the Compiled Laws of 1915, as amended by Act No. 383 of the Public Acts of 1919. The bill was read a first and second time by its title, ordered printed, and referred to the Committee on Highways.

Mr. MacNaughton introduced

Senate bill No. 79, entitled

A bill to amend section 1 of Act No. 22 of the Public Acts of the extra session of 1919, entitled "An act to provide for the appointment of county agents of the State Board of Corrections and Charities; to prescribe the powers, duties and compensation thereof; and to provide for the repeal of all acts and parts of acts inconsistent with the provisions hereof," as amended by Act No. 25 of the Public Ac's of the first extra session of 1921.

The bill was read a first and second time by its title, ordered printed, and referred to the Committee on State Affairs.

Mr. Condon introduced

Serate bill No. 80, entitled

A bill to prevent and punish the desecration, mutilation or improper use of the flag of the United States of America, and of this State, and of any flag, standard, color, ensign or shield authorized by law, and to repeal Act No. 98 of the Public Acts of 1901. entitled "An act to prevent and punish the desecration of the flag of the United States," being sections 15566, 15567, 15568, and 15569 of the Compiled Laws of 1915.
