Notwithstanding any other provisions of law, the comptroller shall encumber only that portion of rehabilitation and architectural design costs for leased sites that the office of mental retardation and developmental disabilities can reasonably expect to expend prior to

September fifteenth, nineteen hundred eighty-six. The office of mental retardation and developmental disabilities is authorized to assign responsibility for lease payments, through a revocable permit, assignment or sublease, to nonstate agencies operating programs on leased sites.

Notwithstanding

any other provisions of law, the comptroller shall make payments for contracts proposed and approved by the commissioners of education and the office of mental retardation and developmental disabilities, and approved by the director of the budget, for day program services for clients who reside in state operated facilities for the developmentally disabled and attend privately operated day programs and for habilitative services and expenses heretofore and hereafter provided by local school districts to clients of community based intermediate care facilities for the developmentally disabled. Notwithstanding any other provisions of law, no amount shall be paid from this appropriation for leasing costs to any day treatment facility without prior determination by certified audit that the rate of reimbursement paid to a facility from any other source is insufficient to meet the costs of all responsible expenses including lease payments.

The commissioner shall reallocate, to the maximum extent practicable, such funding for non-residential outpatient services as is contained in the following amounts in order to serve developmentally disabled individuals living at home and with their caretaker families. As part of such reallocation the commissioner shall:

(a)

Transmit on a quarterly basis reports to the director of the budget, the chairman of the assembly ways and means committee and the chairman of the senate finance committee indicating the number of FTEs serving clients living at home and with their caretaker families and a delineation of the cost centers from which such FTES were reallocated.

(b) Indicate in reports transmitted pursuant to paragraph (a) of this section to what extent such reallocation has been accomplished through the provision of case management services, respite services, recreation services, clinical and transportation services.

(c) Formulate uniform eligiblity standards in order to target the delivery of non-residential outpatient services to clients most in need and to promote the equitable delivery of services to clients living in State and voluntarily operated ICF/MRS and community residences and to clients living at home and with their caretaker families. Such standards may be developed on an interim basis for demonstration purposes and shall be submitted

to the director of the budget, the chairman of the as-
sembly ways and means committee and the chairman of the
senate finance committee no later than August first,
nineteen hundred eighty-five.

(d) Assure the effective coordination of respite services
and the development of a directory of respite
respite services
in every county and in New York City.
(e) Continue to consult parents and other such groups as
required by chapter fifty of the laws of nineteen hun-
dred eighty-four in order to aid in the implementation
of this section. Such groups shall also include the com-
mission on quality of care for the mentally disabled.
(f) Utilize such funding as is specifically provided
herein in order to demonstrate the effectiveness of
utilizing crisis intervention teams as a partial alter-
native to the case manager system of service delivery.
The Commissioner shall prepare a summary of the impact of
actions taken pursuant to the specific provisions of
this section with respect to the enhancement of family
support services. Such summary shall be transmitted to
the Governor and the legislature no later than February
first, nineteen hundred eighty-six.

For services and expenses of the community services pro-
gram in accordance with the following schedule:
