CHAPTER 1.

SENATE BILL NO. 1.

Mileage and Per Diem.

AN ACT making appropriation to pay the mileage and per diem of members of the Senate and House of Representatives of the Extraordinary Session of the Ninth Legislature, salaries of officers and employees and contingent expenses.

BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA :

Appropriation.

Section 1. There is hereby appropriated, out of any money in the State Treasury, not otherwise appropriated, the sum of One Hundred Fifty Thousand ($150,000.00) Dollars, or so much thereof as may be necessary, to pay the mileage and per diem of the members of the Senate and House of Representatives of the extraordinary Session of the Ninth Legislature, and salaries of the officers and employees of the Senate and House of Representatives, and such contingent expenses as either the Senate or the House of Representatives may order paid therefrom.

Same-Purpose of.

Section 2. Said One Hundred Fifty Thousand ($150,000.00) Dollars is to pay all expenses properly certified by the said House of Representatives and Senate and Committees appointed thereby and the Senate sitting as a court of impeachment.

Emergency.

Section 3. It being immediately necessary for the preservation of the public peace, health and safety, an emergency is hereby declared to exist, by reason whereof this Act shall be in full force and effect from and after its passage and approval.

CHAPTER 2.

SENATE BILL NO. 5.

Wearing Masks or Hoods-Intimidation-Organizations and Oaths. AN ACT providing for the prohibiting of the wearing of any mask or hood, except as set forth therein, and defining penalty for violation thereof; prohibiting trespass upon the premises of another while hooded or in disguise, and providing a penalty therefor; making assault upon the person of another a felony, and describing the punishment therefor; making the sending of certain letters, documents or other printed matter a crime, and providing the punishment thereof; making it the duty of the County Attorney and Sheriff and of the peace officers to enforce the law and providing for removal of such officers for neglect of duty, and disqualifying them from holding any office of trust or profit within the State after conviction; providing that no society, association or corporation shall be permitted to exist within the State of Oklahoma which requires its members to take an oath or obligation in conflict with the constitution of this State or the United States, or who by oath or otherwise owes allegiance to any king, power or potentate in any foreign country, and providing a penalty therefor.

BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA :

Masks and Hoods-Unlawful to Wear-Exceptions.

Section 1. It shall be unlawful for any person in this State to wear a mask, hood or covering, which conceals the identity of the wearer; provided, this Act shall not apply to the pranks of children on Hallowe'en, to those going to, or from, or participating in masquerade parties, to those participating in any public parade or exhibition of an educational, religious or historical character, to those participating in any meeting of any organization within any building or enclosure wholly within and under the control of said organization, and to those participating in the parades or exhibitions of minstrel troupes, circuses or other amusements or dramatic shows. Any person, or persons, violating the provisions of this Section of this Act, shall be deemed guilty of a misdemeanor, and upon conviction thereof, shall be punished by a fine of not less than Fifty ($50.00) Dollars nor more than Five Hundred ($500.00) Dollars, or by imprisonment in the county jail for a period of not exceeding (1) year, or by both such fine and imprisonment.

Trespass-Demanding Admission to Premises-Unlawful.

Section 2. Any person, masked or in disguise, who shall enter upon the premises of another or demand admission into the house or enclosure of another (with intent to inflict bodily injury, or injury to property) shall be deemed guilty of assault with intent to commit a felony and such entrance or demand for admission shall be prima facie evidence of such intent, and upon conviction thereof, such person shall be punished by a fine of not less than Fifty ($50.00) Dollars nor more than Five Hundred ($500.00) Dollars, and by imprisonment in the penitentiary for a term of not less than (1) year nor more than five (5) years.

Assaults-While Masked-Felony.

Section 3. Any person, while masked or in disguise, who shall assault another with a dangerous weapon, or other instrument of punishment, shall be deemed guilty of a felony, and upon conviction thereof shall be punished by a fine of not less than One Hundred ($100.00) Dollars nor more than Five Hundred ($500.00) Dollars,
