Q. Have you yourself paid a State or county tax to Thomas Perdue, collector of State and county taxes, for the year 1878-A. Not myself; John Reiser paid the tax for me.

Q. When did John Reiser pay your taxes for you?-A. I can't tell. Q. Have you settled with John Reiser for any taxes that he paid Thomas Perdue for you?-A. I have not settled with him, but he paid my tax to Thomas Perdue.

Q. Did you see him pay your taxes to Thomas Perdue?-A. No; I did not.

Q. Did you get a receipt from Thomas Perdue for the payment of your taxes; and, if so, what is the date of it ?-A. I did; it is dated January 25, 1879.

Q. When did Reiser pay your taxes to Stover ?-A. I can't tell. He always pays them when he pays his own. I told him to do so.

Q. Have you settled with Reiser for any taxes that he paid to Uriah Stover for you?-A. I settle with him every year.

Q. What was the amount of the taxes Reiser paid to Stover?—A. I can't tell that.

Q. When did you and Reiser have your last settlement?—A. About a year ago.

Q. Did Reiser have you charged with any taxes that he paid to Stover for you?-A. He had the taxes charged, of course.

Q. What was the amount of taxes Reiser had you charged that he paid Stover -A. I can't tell.

Q. Did you see in his account any item charged against you for taxes that he had paid Uriah Stover?-A. I did not pay particular attention to it; it was taken out of my wages.

DANIEL KLINE, being sworn and examined, deposeth as follows: (Counsel for contestee requests counsel for contestant to state what he proposes to prove by the witness, and the purpose for which he is called.

Counsel for contestant replies that he proposes to prove his qualifications as a voter in Beuner Township.

Counsel for contestee objects to the taking of the testimony of witness, because he is not called in rebuttal.)

Question. State your age and residence.-Answer. I was born in 1851; am 28 years old; I reside in Benner Township.

Q. How long have you lived in Benner Township?-A. About fourteen years.

Q. Where were you born?-A. In Potter Township, Centre County. Q. Have you always lived in Centre County, Pennsylvania ?-A. Yes, sir.

Q. Have you paid a State and county tax within two years previous • to the election on November 5, 1878 ?—A. Yes, sir.

Q. State to whom you paid it.-A. In 1876 I paid it to Amos Garbrick, and in 1877 to Uriah Stover.

Q. Was Stover collector of State and county taxes in your township for the year 1877?—A. Yes, sir.

Q. State whether or not you voted at the election held November 5, 1878.-A. I did.

Q. State for whom you voted for Congress ?-A. For Andrew G. Curtin.

Cross-examined:

Q. What time did you vote on the election last fall?-A. Between two and three o'clock in the afternoon.

Q. From whom did you get the ticket that you voted ?-A. From James Sweitzer.

Q. Did you read the ticket?-A. Yes, sir.

Q. Who received your ticket at the window that day ?--A. William Searson.

Q. Did he number your ballot ?--A. That is more than I can tell.

Q. What time in 1876 did you pay your tax to Amos Garbrick ?--A. I can't tell; I took no receipt.

Q. How long is it since you paid your tax to Uriah Stover ?--A. I can't tell.

Q. Did you pay him last fall?--A. Yes; it was in the summer.

Q. With whom were you working at the time you paid him?—A. For myself.

WILLIAM GROVE, Jr., being sworn and examined, deposeth as follows: (Counsel for contestee requests counsel for contestant to state what he proposes to prove by this witness and the purpose for which he is called.

Question. Where do you reside?--Answer.. In Benner Township, Centre County, Pennsylvania.

Q. How long have you resided in Benner Township ?—A. Some few days over ten years.

Q. Are you acquainted with Lazarus Nearhood?-A. I am.

Q. Where does he reside ?--A. He resided last year in Benner Township.

Q. Did he vote at the November election of 1878 ?-A. Yes, sir.

Q. Who gave him his ticket?—A. I did; I gave him a ticket, but I cant say whether he voted that ticket or not; Mr. Spangler also gave him a ticket about the same time.

Q. Did you go along with Nearhood to the window when he voted ?-A. Yes, sir; I saw him put in his ticket.

Q. State if Nearhood voted either the ticket you gave him or the ticket Mr. Spangler gave him.-A. He voted one of the two tickets. Q. What name for Congress was on the ticket you gave him ?--A. A. G. Curtin's name.

Q. Do you know what name for Congress was on the ticket which Mr. Spangler gave him?--A. I am almost positive that the tickets were alike.

Q. State the politics of J. L. Spangler?-A. He is a Democrat; I take him for one.

Q. Are you acquainted with J. B. Witmer?--A. I am.

Q. Did he vote at the election of November 5th, 1878 ?—A. Can't tell that.

Q. Did you give him a ticket at that election?-A. I gave him a ticket at his house on the day of the election, at his house.

Q. What ticket did you give him?-A. Í gave him a straight-out Democratic ticket with Andrew G. Curtin's name on it.

Cross-examined by Mr. LOVE:

Q. Where does Lazarus Nearhood live?-A. I don't know where he is

now.

Q. When did he leave Benner Township?-A. I cannot tell you the day or month.

Q. How long ago is it since he left Benner Township?-A. I cannot tell.

Q. Was he living in Benner Township on the 5th of November last ?A. I cannot say whether he was living in Benner Township on the 5th of November last, but he was in the township on that day. He was at my place on the night of the 4th.

Q. You have just stated that he was at your place on the night of the 4th of November last; when did he come to your place at that time?A. It was on Sunday, which would be the 3rd of November.

Q. Where did he come from to your place?-A. I do not know.

Q. How long before that time had he been at your place?—A. I can't tell you that.

Q. Was he in your employ last year?-A. No, sir.

Q. Who did he work for in Benner Township last summer?—A. For William H. Krape.

Q. When did he quit work for William H. Krape last fall?-A. I cannot tell you that.

Q. Had he quit work for William H. Krape before he came to your place on Sunday, the 3rd of November?-A. Yes, sir.

Q. Do you remember how long before that he had quit work for Mr. Krape?—A. I can't tell, but it must have some time before that.

Q. Was he working for anybody in Beuner Township on the 5th of November last?-A. He was not; he was tending the election the whole day.

Q. When he came to your place on Sunday, November 3d, did he say anything to you about where he had been?-A. Yes, sir; I would not say positive, but I think he told me he had been to Union County, Snyder County, and Mifflin County.

Q. What did he say he had been doing in those counties?-A. He said he was hunting work, but did not find any. He also said he saw his father and brothers and sisters.

Q. In what county does his father live?-A. His father lives in Mifflin County; also one of his brothers.

Q. Did he come from Mifflin County direct to your place on the 3rd of November last ?—A. I don't know where he came from last.

Q. Was your place the first he came to in Benner Township after his trip through the counties you have mentioned? -A. That is hard to tell. Q. Had you seen anything of him in Benner Township from the time be quit work for W. H. Krape until he came to your place on Sunday, November 3 ?—A. He came from Krape's to my place.

Q. How long had he been at Wm. H. Krape's immediately before he came to your place on Sunday, the 3d of November?-A. If you have referred to the time that he went to Krape's and the time that he worked there then I think it was near about December, 1877.

Q. What time did Lazarus Nearhood quit work for W. H. Krape last fall?-A. I don't know that.

Q. Did he quit working for him before he started to Union, Snyder, and Mifflin counties in hunt of work?-A. Yes, sir.

Q. When he came back from those counties to Benner Township he came to your place on Sunday, the 3rd of November last, did he not ?A. He came to my place on the 3rd of November, but where he came from I do not know.

Q. Then if you don't know where he came from to your place on Sunday, the 3d of November last, do you swear that he came from W. H. Krape's to your place at that time?-A. No, sir.

Q. How long did Lazarus Nearhood stay at your place after the 5th of November last ?—A. I don't know precisely; may have been a day or two, maybe not so long.

Q. Where did he go when he left your place ?-A. I do not know. Q. Did he say anything to you about where he was going to ?-A. Not that I remember, not at that time.

Q. When did he say anything to you about where he was going ?—A. Some time after the 5th of November, after he was gone, I received a letter from him.

Q. Where was he at the time you received a letter from him?—A. In Logansville, Clinton County.

Q. What time in the day did Lazarus Nearhood vote at the election last fall, November 5, 1878 ?-A. He voted in the morning.

Q. If the ticket that you gave him was the same as Mr. Spangler gave him, what was the object in Mr. Spangler giving him a ticket?-A. He wanted to get some advice from Mr. Spangler, and that is the reason he asked Mr. Spangler for a ticket.

Q. What kind of advice did he want to get from Mr. Spangler ?-A. I don't know.

Q. Was it legal advice or advice as to the election?-A. I don't know. Q. Did he want any advice from Mr. Spangler as to the election ?A. Not that I know of.

Q. Who received your ticket at the polls?—A. I think it was William Searson.

Q. Did you examine your ticket carefully just before voting?—A. I think I did.

EPHRAIM GLENN.

Testimony of Henry Beck.

HENRY BECK, being sworn and examined, deposeth as follows: Question. What is your age, residence, and business?-Answer. My age is thirty-nine; residence, Spring Township; my business, clerk to the commissioners of Centre County.

Q. Are the original registry lists kept on file in the commissioners' office?-A. They are, except when they are out of the office.

Q. State whether or not there is on file in the commissioners' office the registry list for the western precinct of Ferguson Township for the year 1878-A. There is not.

Q. State whether or not you have made search for such list in the commissioners' office?

(Counsel for contestee objects to the question because it is irrelevant and not rebuttal.)

A. I have.

Q. Have you been able to find such list in your office?—A. I have not, and when I found it was missing I wrote to the assessor to know whether he had it in possession, and, if so, to return it to the commis sioners' office. I received no reply, and afterwards wrote again, and still received no reply.
