Question. State when and where you were born.-Answer. I was born

in 1857, March 28, a mile this side of Maddisonburg, in Gregg Township, Centre County, Pennsylvania.

Q. Where did you live one year before the election, November 5, 1878-A. In Benner Township, Centre County, Pennsylvania.

Q. Where did you vote November 5, 1878 ?--A. In Benner Township, Centre County, Pennsylvania.

Q. Did you vote on a tax receipt or on age?—A. It was my first vote on a tax receipt.

Q. State whether or not you had been registered.-A. So far as I know I was.

Q. Had you paid a tax, either State or county?—A. I had paid State and county tax.

Q. Do I understand you to say that you voted on age?—A. I did. Q. For whom did you vote for Congress at the election of November 5, 1878?-A. For A. G. Curtin.

Cross-examined by Col. D. H. HASTINGS:

(Counsel for contestee objects to the whole of the foregoing testimony, because it is not rebuttal in any sense, and, reserving this objection, proceeds to cross-examine.)

Q. To whom did you pay a State or county tax?-A. To Thomas Purdue, collector of State and county taxes.

Q. When did you pay it ?—A. October 3, 1878.

Q. Is there any other person residing in Benner Township named Frank Hazel?-A. I do not know that.

Q. Before you voted did you swear and subscribe to a partly written and partly printed affidavit as to your age, residence, and other qualifications as a voter ?-A. No, sir; I did not.

Q. Did any one else do this for you?-A. No, sir.

FRANK HAZEL.

WILLIAM GROVE, being sworn and examined, deposeth as follows: Question. Where were you born, and when?-Answer. I was born in Gregg Township, Centre County, Pennsylvania, as near as I know, on the 28th day of July, 1840.

Q. Where have you lived all your life?-A. I have lived in Centre County all my life.

Q. Where do you live now, and how long have you lived there?—A. I lived in Benner Township, Centre County; it was ten years, either the 28th or 29th of March of this year.

Q. Did you pay a State or county tax within two years and one month before the last November election, which had been assessed at least two months before that election ?-A. I always paid the tax assessed inside the year in which they were assessed; I paid this tax in January, 1878; the tax was assessed for 1877.

Q. Did you vote for Congress at the election held on the 5th of November last, beld in Benner Township?-A. I voted for Congress at the place where the Benner Township election was held on the 5th of November last.

Q. Who did you vote for for Congress ?-A. For A. G. Curtin.

(Counsel for contestee objects to all the testimony of this witness, for the reason that it is not rebuttal testimony in any sense, and, reserving such objection, proceeds to cross-examine.)

Cross-examined by D. H. HASTINGS:

Q. When did you pay your State or county tax for the year 1878 ?—A. It is not paid as yet; the reason why it is not paid the tax collector met me here (in Bellefonte) on January court week and told me that he would leave the amount at John Hoffer's, and I should pay it there, and, to the best of my knowledge, the amount is not there, and the money is ready for the taxes, and had been reserved for that purpose for near two months.

Q. Was your name on the registry list of Benner Township for the year 1878-A. The inspector told me so.

SAMUEL KERN, being sworn and examined, deposeth as follows: Question. Where and when were you born?-Answer. I was born in Clinton County, Pennsylvania, in the year 1848; if I am not mistaken, in the month of February.

Q. Where have you lived during your life?—A. I was partly raised in Clinton County; then my father moved to Centre.

Q. When did he move to Centre County?-A. I cannot exactly say. I suppose I was somewhere about fifteen years old when he moved to Centre County.

Q. Have you lived in Centre County ever since?-A. I had my home in Centre County ever since, although I had went back to Clinton County to work.

Q. In what township do you live now, and how long have you lived there?-A. I live in Benner Township; I moved in Benner Township

in 1875 and have lived there since.

Q. Did you pay a State or county tax within two years and one month before the last November election, which had been assessed at least two months before the election?-A. Yes, sir.

Q. Did you vote for Congress at the election held on the 5th of Novem-ber last ?-A. Yes, sir.

Q. For whom did you vote for Congress at that election ?—A. For Andrew G. Curtin.

Q. To whom did you pay your State and county tax for the year 1878?-A. I have not paid it.

Q. To whom did you pay your State or county tax for the year 1877 ?— A. They had no tax against me. for that year; I was assessed. The collector told me he had not my name on the duplicate. I paid all the other tax assessed against me that year.

Q. Was your name on the register list for Benner Township for the year 1878-A. It was, so far as I know.
