Mr. Foster moved that the Senate resolve itself into the Committee of the Whole on the

GENERAL ORDERS OF THE DAY.

The motion prevailed.

The President called Mr. Murtha to the chair.

After some time spent therein, the committee rose, and the President pro tempore having taken the chair, the Committee of the Whole, through its chairman made the following report:

I.

The Committee has had under consideration the following:
Senate bill No. 289 (file No. 252), entitled

A bill to amend chapter 54 of Act No. 314 of the Public Acts of 1915, entitled "An act to revise and consolidate the statutes relating to the organization and jurisdiction of the courts of this State; the powers and duties of such courts, and of the judges and other officers thereof; the forms of civil actions; the time within which civil actions and proceedings may be brought in said courts; pleading, evidence, practice and procedure in civil actions and proceedings in said courts; to provide remedies and penalties for the violation of certain provisions of this act; and to repeal all acts and parts of acts inconsistent with, or contravening any of the provisions of this act," being sections 13845 to 13863 inclusive, of the Compiled Laws of 1915, by adding a new section thereto to stand as section 20.

Senate bill No. 231 (file No. 195), entitled

A bill to amend section 42 of chapter XII, section 49 of chapter XIII, section 63 of chapter XVIII, section 61 of chapter XIX and section 15 of chapter LXV of Act No. 314 of the Public Acts of 1915, entitled "An act to revise and consolidate the statutes relating to the organization and jurisdiction of the courts of this State; the powers and duties of such courts, and of the judges and other officers thereof; the forms of civil actions; the time within which civil actions and proceedings may be brought in said courts; pleading, evidence, practice and procedure in civil actions and proceedings in said courts; to provide remedies and penalties for the violation of certain provisions of this act; and to repeal all acts and parts of acts inconsistent with, or contravening any of the provisions of this act."

Senate bill No. 157 (file No. 113), entitled

A bill to amend section 1 of chapter 50 of Act No. 314 of the Public Acts of 1915, entitled "An act to revise and consolidate the statutes relating to the organization and jurisdiction of the courts of this State; the powers and duties of such courts, and of the judges and other officers thereof; the forms of civil actions; the time within which civil actions and proceedings may be brought in said courts; pleading, evidence, practice and procedure in civil actions and proceedings in said courts'; to pro vide remedies and penalties for the violation of certain provisions of this act; and to repeal all acts and parts of acts inconsistent with, or contravening any of the provisions of this act."

Senate bill No. 150 (file No. 108), entitled

A bill to authorize the appointment of a deputy clerk for the circuit court in any circuit which is composed of one county only, and in which there is but one circuit judge, and to fix the salary of said clerk.

Senate bill No. 325 (file No. 300), entitled

A bill making an appropriation for the Traverse City State Hospital for the fiscal year ending June 30, 1918, for the erection and equipment of a general hospital for the treatment of patients seeking surgical or medical aid therein and to provide a tax to meet the same and to repeal Act No. 33 of the Public Acts of 1915.

House bill No. 85 (file No. 233), entitled

A bill to provide for a deficiency appropriation for the State Tuberculosis Sanatorium and to provide a tax to meet the same.

House bill No. 108 (file No. 243), entitled

A bill making an appropriation for the erection, construction, furnishing and equipping of new hospital buildings for the University of Michigan at Ann Arbor, and to provide a tax to meet the same.

Senate bill No. 312( file No. 287), entitled

A bill to amend section 1 of Act No. 205 of the Public Acts of 1887, entitled “An act to revise the laws authorizing the business of banking and to establish a banking department for the supervision of such business," as amended, the same being section 7967 of the Compiled Laws of 1915.

House bill No. 386 (file No. 210), entitled

A bill to amend section 14 of Act No. 398 of the Public Acts of 1913, entitled “An act to provide for the organization, regulation and conduct of co-operative companies and associations," approved May 14, 1913, being compilers' section 9963 of the Compiled Laws of 1915.

House bill No. 459 (file No. 217), entitled

A bill to amend sections 1, 2, 3 and 4 of chapter 11 of Act No. 3 of the Public Acts of 1895, entitled "An act to provide for the incorporation of villages within the State of Michigan, and defining their powers and duties," the same being sections 2764, 2765, 2766 and 2767 of the Compiled Laws of 1915.

Senate bill No. 303 (file No. 279), entitled

A bill to amend section 82 of chapter 23 of Act No. 314 of the Public Acts of 1915, entitled "An act to revise and consolidate the statutes relating to the organization and jurisdiction of the courts of this State; the powers and duties of such courts, and of the judges and other officers thereof; the forms of civil actions; the time within which civil actions and proceedings may be brought in said courts; pleading, evidence, practice and procedure in civil actions and proceedings in said courts; to provide remedies and penalties for the violation of certain provisions of this act; and to repeal all acts and parts of acts inconsistent with or contravening any of the provisions of this act," approved May 18, 1915. House bill No. 333 (file No. 127), entitled

A bill to authorize the city of Cheboygan, in the county of Cheboygan, to borrow money, and issue its bonds therefor, for the purpose of paying the floating indebtedness of said city and for general public purposes.

Has made no amendments thereto, and has directed its chairman to report the same back to the Senate and recommend their passage.

II.

The Committee has also had under consideration the following:

Senate bill No. 15 (file No. 16), entitled

A bill to amend amended sections 2 and 4 of Act No. 142 of the Public Acts of 1913, entitled "An act to provide for the assessment and the collection of a specific tax upon secured debts other than debts secured or evidenced by mortgages and liens upon real property, and which mortgages and liens are recorded in Michigan, and to repeal all acts and parts of acts in contravention thereto."

And has amended the same as follows:

Amend by inserting in line 6, section 1, after the word "thereto" the words and figures "being sections 4283 and 4285 of the Compiled Laws of 1915."

Amend by adding to section 4, the following: "War bonds issued by any foreign nation, when diplomatic and friendly relations exist between such country and this nation, shall be exempt from all specific and general taxation in this State for a period of five years from and after July 1, 1917..

House bill No. 116 (file No. 44), entitled

A bill providing that any common carrier by railroad, their officers, agents and employes, employing any special agents or detectives for the purpose of detecting and reporting any misconduct or violation of any order or rule of such common carrier by railroad, shall before disciplining or discharging any employe upon the report of any such detective or special agent give the employe so reported an opportunity to be heard; to be confronted with such special agent or detective reporting him and to have the right and privilege to cross-examine such detective or special agent; to be represented by counsel if he so desires, and providing a penalty for the violation thereof.

And has amended the same as follows:

1. Amend by striking out of lines 4 and 5, section 2, the words "less than fifty dollars nor."

2. Amend by striking out of line 6, section 2, the words "less than thirty days nor."

Senate bill No. 310 (file No. 285), entitled

A bill to prohibit the sale, keeping for sale, loaning, giving away or carrying of certain dangerous weapons; to prevent the carrying of concealed weapons except in certain specified cases when a license is issued therefor; to provide punishment for the violations of the provisions hereof and to repeal all other acts or parts of acts inconsistent with this act. And has amended the same as follows:

1. Amend by inserting in line 15, section 1, after the word "person" the words "provided that a person while hunting may carry a revolver or pistol."

2. Amend by striking out of line S, section 5, the words "one year" and inserting in lieu thereof the words "two years."

3. Amend by adding a new section to be known as section 9 and to

read as follows: "Sec. 9. This act shall not be construed as repealing ordinances of cities having a population of 100,000 or more, regulating the carrying of the weapons mentioned in this act; nor of repealing any local act of the Legislature under which cities of 100,000 population or more are regulating the carrying of the weapons mentioned by this act."

House bill No. 148 (file No. 125), entitled,

A bill to amend chapter 5 of Act No. 283 of the Public Acts of 1909, approved June 2, 1909, as amended, entitled "An act to revise, consolidate and add to the laws relating to the establishment, opening, im provement, maintenance and use of the public highways and private roads, the condemnation of property and gravel therefor; the building, repairing and preservation of bridges; setting and protecting shade trees, drainage, cutting weeds and brush within this State, and providing for the election and defining the powers, duties and compensation of State, county, township and district highway officials," by adding thereto a new section to stand as section 10-a thereof.

And has amended the same as follows:

Amend by striking out of line 1, section 10, the word "ten” and inserting in lieu thereof the word "fifteen."

House bill No. 72 (file No. 19), entitled

A bill to provide for the construction, maintenance and improvement of federal aided roads; to authorize townships, good roads districts and counties to raise money by taxation and by loan for the purpose of contributing thereto; to validate and legalize proceedings heretofore taken to raise money for the purpose contemplated by this act; and to provide an appropriation for paying the State's portion of the expense incurred hereunder.

And has amended the same as follows:

1. Amend by adding to section 1, line 15, after the word "made” the following: "The State highway commissioner is further authorized to enter into all contracts and agreements with the United States government relating to the construction and maintenance of rural post roads under the provisions of the said act of Congress, to submit such scheme or program of construction and maintenance as may be required by the Secretary of Agriculture, and do all other things necessary fully to carry out the co-operation contemplated and provided for by the said act. The State treasurer is hereby authorized to receive any and all moneys due the State of Michigan under the provisions of this act, and shall pay out the same under the orders of the auditor general which shall be issued by said auditor general upon orders of the State highway commissioner."

Amend by striking out of line 7, section 2, the words "and federal government."

3. Amend by striking out of line 4, section 3, the words "the State and federal government paying the remainder."

4. Amend by striking out of lines 7 and 8, section 3, the words "the State and federal government paying the remainder."

5. Amend by striking out of lines 10 and 11, section 3, the words "the State and federal government paying the remainder."

6. Amend by striking out of line 14, section 3, the words "the State and federal government paying the remainder."

7. Amend by striking out of lines 17 and 18, section 3, the words "the State and federal government paying the remainder."

8. Amend by striking out of lines 20 and 21, section 3, the words "the State and federal government paying the remainder" and insert in line 20, after the word "roads" the following: "in each case the State paying the remainder of the cost from the State funds appropriated for this purpose and from such funds as may be allotted to each project by the federal government."

9. Amend by striking out of line 7, section 5, the word "in" where it first appears and inserting in lieu thereof the word "if."

Senate bill No. 160 (file No. 124), entitled

A bill to amend sections 2, 3, 8, 9, 10 and 11 of Act No. 148 of the Session Laws of 1869, entitled "An act to revise and consolidate the several laws relating to the support and maintenance of poor persons," the same being sections 4503, 4504, 4509, 4510, 4511 and 4512 of the Compiled Laws of 1897.

And has amended the same as follows:

Amend the proviso added to section 2 so as to read as follows:

"Provided, further, That nothing herein contained shall be construed to modify or repeal Act No. 253 of the Local Acts of Michigan for the year 1883, Act 326 of the Local Acts of Michigan for the year 1889, and Act 77 of the Public Acts of Michigan for the year 1885, or interfere with the operation of any Local Act now in force and effect in any county, nor municipal ordinance and regulations adopted pursuant to any charter provisions of any municipality in this State."

And has directed its chairman to report the same back to the Senate, recommending that the amendments be concurred in, and that, as amended, the bills pass.

III.

The Committee has also had under consideration the following:
Senate bill No. 298 (file No. 268), entitled

A bill to amend section 4 of Act No. 279 of the Public Acts of 1909, as amended, entitled "An act to provide for the incorporation of cities. and for revising and amending their charters."

Senate bill No. 306 (file No. 275), entitled

A bill to amend section 4 of Act No. 279 of the Public Acts of 1909, as amended, entitled "An act to provide for the incorporation of cities and for revising and amending their charters."

Has directed its chairman to report the same back to the Senate, with the recommendation that the bills be re-referred to the Committee on Cities and Villages.
