By Mr. LOGAN: A bill to authorize the judge of the county court of Roanoke county to correct excessive assessments of lands in said county.

By Mr. EVANS: A bill to repeal an act approved February 25, 1890, entitled an act to establish boards of commissioners of excise, and to define their duties and powers.

By Mr. NEWBERNE: A bill to pension Confederate soldiers, sailors and marines of Virginia incapacitated for the performance of manual labor, and the widows of Virginia soldiers, sailors and marines who lost their lives in the intersectional war.

To the Committee for Courts of Justice:

By Mr. LOGAN: A bill to amend and re-enact section 3888, Code of Virginia, 1887, entitled "How attempts to commit offences punished."

By Mr. LOGAN: A bill to amend and re-enact section 1033, Code of Virginia, 1887, entitled "Mayor and council, their powers, duties and jurisdiction, appeals allowed to county court.' To the Committee on Counties, Cities and Towns:

By Mr. LOGAN: A bill to regulate the sale of ardent spirits by druggists in cities, counties and magisterial districts where local option prevails.

The hour of 12:30 o'clock P. M. having arrived, being the time fixed for the meeting of the joint assembly to count the votes for governor and lieutenant-governor

The Senate repaired to the hall of the House of Delegates. The roll of the Senate was called, and the following senators responded to their names:

Messrs. Arthur, Manly H. Barnes, Thomas H. Barnes, Berry, Buchanan, Echols, Fairfax, Flood, Green, Harnsberger, Harrison, Hay, Herbert, Hurt, Jackson, Jennings, Jones, Jordan, LeCato, Little, Lovenstein, Maynard, McIlwaine, Miller, Morris, Mushbach, Parrish, Sands, Southall, St. Clair, Stubbs, Tredway, Walton, Washington, Watts, Wells, Wickham and Williams.

There were thirty-eight senators present.

The roll of the House of Delegates was called, and the following delegates responded to their names:

There were eighty-nine members present.

The SPEAKER announced that he had received from the secretary of the Commonwealth returns of the election for governor and lieutenant-governor.

The SPEAKER then, in the presence of the Senate and House of Delegates, proceeded to open the returns of elections.

The SPEAKER appointed Messrs. McILWAINE of the Senate and DOWNING of the House to receive and count the joint vote.

The SPEAKER appointed Messrs. MILLER of the Senate and HUNTON of the House a committee to add up the vote as embodied in the statement by the clerk of the House.

Subsequently the committee reported that the

Whereas, it appears by the returns from the county of Scott that no votes are reported as being cast for lieutenant-governor in said county; and whereas it appears from the returns from the county of Frederick that the names of certain persons were omitted as being voted for for lieutenant-governor; and it further appearing that the votes of the said counties cannot practically affect the election of Charles T. O'Ferrall as governor and Robert C. Kent as lieutenant-governor; and it further appearing that no one asserts that said votes and omission of names would practically affect said election-be it, therefore,

Resolved, That the joint assembly, in accordance with the requirements of law and of the Constitution, do declare Charles T. O'Ferrall duly elected governor of this Commonwealth for four

years, commencing on the 1st day of January, 1894; and Robert C. Kent duly elected lieutenant-governor of this Commonwealth for four years, commencing on the 1st day of January, 1894; and that the presiding officer of this joint assembly— namely, the Speaker of the House of Delegates-do make such declaration.

Whereupon

The Speaker of the House of Delegates declared Charles T. O'Ferrall duly elected governor of this Commonwealth for four years, commencing on the 1st day of January, 1894.

The Speaker of the House of Delegates declared Robert C. Kent duly elected lieutenant-governor of this Commonwealth for four years, commencing on the 1st day of January, 1894.

On motion of Mr. NICOL, the joint assembly adjourned.
Whereupon the Senate returned to their chamber.

The House having resumed its session, on motion of Mr. NICOL it adjourned until to-morrow at 12 o'clock M.

FRIDAY, DECEMBER 8, 1893.

The Journal was read by the clerk.

A communication from the Senate by their clerk was read, as follows:

In Senate, December 7, 1893.

The Senate has passed Senate bills entitled an act extending the time for the collection of taxes for the year 1893, in Caroline county, No. 1; and an act to authorize the city of Winchester to increase its public debt, No. 19.

In which bills they respectfully request the concurrence of the House of Delegates.

No. 1, Senate bill, was read twice, and, on motion of Mr. CARDWELL, was placed on the calendar.

No. 19, Senate bill, was read twice, and, on motion of Mr. NELSON, was placed on the calendar.

J. HOWE SAYERS, delegate-elect from the county of Tazewell, was sworn in by the clerk.

The clerk of the House of Delegates has made the following appointments:

T. H. Bigger, of Richmond city, assistant clerk.

H. Tate Evans, of Richmond city, enrolling clerk.

By Mr. CRUMP: A bill to amend and re-enact section 3084 of the Code of Virginia, relating to the Supreme Court of Appeals.

By Mr. CRUMP: A bill to amend and re-enact the first subdivison of section 185 of the Code of Virginia, relating to the salaries of judges of the Court of Appeals.

By Mr. CRUMP: A bill to repeal section 2824 of the Code of Virginia, relating to proceedings by a judgment creditor to discover usurious dealings on the part of his debtor.

To the Committee on Finance:

By Mr. DEJARNETTE: A bill for the relief of Henry S. Throckmorton, of Halifax county.

By Mr. HARWOOD: A bill to amend and re-enact section 1842 of the Code of Virginia, in relation to sale by samplers and others of unclaimed tobacco in warehouses of the city of Richmond, and disposition of the proceeds.

The following bills were, on motions severally made by Messrs. DOWNING and THOMAS respectively, placed on the calendar and read a first time:

No. 2, House bill to authorize the supervisors of Warren county to borrow $7,000, to be used in the construction of approaches to the two bridges across the north and south branches of the Shenandoah river, at Riverton, in said county.

No. 3, House bill to legalize the issue of certain bonds of the city of Roanoke.

The morning hour having expired, the House proceeded to the business on the calendar.

No. 1, Senate bill entitled an act extending the time for the collection of taxes for the year 1893 in Caroline county, was read a third time and passed.

Mr. CARDWELL moved to reconsider the vote by which the bill was passed; which motion was rejected.

Ordered, That Mr. SAUNDERS inform the Senate that the House has passed the bill.

No. 19, Senate bill entitled an act to authorize the city of Winchester to increase its public debt, was read a third time and passed.

Mr. NELSON moved to reconsider the vote by which the bill was passed; which motion was rejected.

No. 1, House bill changing the time for commencing the construction of the Washington and Western railroad, was read twice and ordered to be engrossed.

On motion of Mr. ANDERSON, the House adjourned until tomorrow at 12 o'clock M.

SATURDAY, DECEMBER 9, 1893.

On motion of Mr. BYRNE, the reading of the Journal was dispensed with.

The following House bills were, on motions severally made by Messrs. PERKINS, WILKINSON and Urz, placed on the calendar and read a first time:

No. 4, House bill to authorize the board of supervisors of Warwick county to increase the salary of the clerk of the county court of the said county.

No. 5, House bill to distribute the road tax arising from the Citizens' Bank of Carroll among the several magisterial districts of Carroll county.

No. 6, House bill to authorize the board of supervisors of Madison county to effect a loan for county road purposes.

Leave of absence was granted Messrs. MILLER, PRETLOW, PATTESON, MURRELL, RICHARDSON and FAHRNEY two days each.

Mr. EDMONDSON offered a concurrent resolution, as follows: Resolved (the Senate concurring), That the auditor of public accounts be requested to inform the general assembly by report in writing, at the earliest practicable moment, of the status of the several accounts of the treasurers and other officers of the several counties, cities and towns of this State with this Commonwealth.

Which was agreed to.
