ecuted in this Island, or within twelve months if executed elsewhere, and any person being ignorant of such deed shall be induced to purchase or lend money by way of mortgage or charge on the security of such. land, and shall cause his deed of conveyance, mortgage, or security deed, to be proved and recorded in the Colonial Secretary's Office, such conveyance, mortgage or charge, so as aforesaid omitted to be recorded shall be null and void, as against such subsequent purchaser, or mortgagee or person having such charge for valuable consideration, but not otherwise. And the legal estate (if any) in the said land which has been conveyed or mortgaged by any such conveyance or mortgage omitted to be recorded as aforesaidshall, so far as is necessary to give effect to this section but not further or otherwise be and remain vested in such subsequent purchaser or mortgagee for valuable consi deration who shall have duly recorded his conveyance or mortgage as required by this Act. This section shall be retrospective in its operation.

2. (1) In the completion of any contract for selling, mortgaging or charging any land and subject to any stipulation to the contrary in the contract, recitals, statements, and descriptions of facts, matters, and parties contained in deeds, instruments, Acts of the Imperial Parliament or of the Legislature of this Island, or in affidavits, or statutory declarations twenty years old at the date of the contract, shall, unless and except so far as they shall be proved to be inaccurate, be taken to be sufficient evidence of the truth of such facts, matters, and descriptions.

(2) Trustees may sell or buy or mort gage or charge or lend on mortgage or charge without excluding the application of this section.

4. In printing the new edition of the laws in the new edition of the Commissioners are hereby required to the laws. print the principal Act as amended by this Act and to insert the several sections of this Act in such parts thereof as they deem most fitting and to re-number the sections thereof so far as may be necessary and to omit this Act from the new edition of the laws.

BARBADOS.

An Act to amend "The Compulsory Powers (Land) Act, 1891 "

E it enacted by the Governor, Council, and Assembly of this Island, and by the authority of the same as follows;

any

1. In all cases in which the amount of any purchase money or compensation payable under the said Act, in respect of lauds is to be settled and determined by arbitration or the verdict of a jury, the estimate of the value of the preinises shall be based on the fair market value thereof, at the time of the valuation being made of such lands and of the several interests therein, due regard being had to the nature and their condition thereof and all circumstances affecting such value, but in case the arbitra. tor or the jury shall give compensation in respect of the purchase being compulsory, such compensation shall not exceed fifteen per cent on the market value of such lands; provided always that this section shall not apply to any compensation given for any damage or loss sustained by reason of the taking of any such land, or by reason of sev

erance.

2. This Act shall be read as one with "The Compulsory Powers (Land) Act 1891," and in preparing the new edition of the laws the Commissioners shall insert in such place as they deem most fitting in the said Act, sections one and two of this Act omitting. from those sections the words "under the said Act," and shall if and so far as necessary re-number the sections of the said Act and shall omit this Act from such new edition.

BARBADOS.

An Act for further promoting the revision of the statute law.

DE it enacted by the Governor, Council, and Assembly of this island, and by the authority of the same, as follows:1. This Act may be cited as "The Statute Law Revision Act (No. 1) 1893."

2. The Act of the 19th September 1745 entitled, An Act to quiet the inhabitants. "of this island in the peaceable possession of "their estates, and for removing the causes "of expensive and vexatious suits in rela"tion thereto" which was repealed by "The Statute Law Revision Act (No. 1) 1891,” is hereby revived, and for all purposes whatever shall be deemed and held never to have been repealed.

3. The words "the commencement of mends section 6 the Act of this island of" and the words of the Act of 17th "relating to offences against the person", February, 1868. Occurring respectively in section 6 of the Act of 17th February 1868, entitled,

An Act to consolidate and amend the law of this island relating to offences against the person" are hereby repealed.

4. The words "the thirtieth day of June

5 The Act of the 18th December 1874 entitled, "An Act to extend the time fixed for commencing the works of the Barbados Railway" and the Act of the 22nd November 1876, entitled, "An Act to extend the "time limited for commencing and comple"ting the Barbados Railway," and section six of the Act of the 11th April 1878, entitled, "An Act to amend An Act entitled An Act to incorporate the Barbados Railway Company" passed the 25th day of February one thousand eight hundred and seventy three and the Act of the 10th March 1879, entitled, "An Act to extend the time "for completing the Barbados Railway" are hereby repealed.
