BARBADOS.

An Act to authorize The Barbados Railway Company, Limited, to construct and maintain a tramway from the City of Bridgetown to Colleton plantation in the parish of Saint Peter.

HEREAS The Barbados Railway Company, Limited, (hereinafter referred to as "the company") have petitioned the legislature of this island to grant them powers to construct and maintain a tramway from the city of Bridgetown to Colleton plantation in the parish of Saint Peter; And Whereas it is deemed expedient to grant the said company the powers they ask for; Be it therefore enacted by the Governor, Council, and Assembly of this island, and by the authority of the same, as follows:

Preliminary.

1. This Act may be cited for all purposes as "The Barbados Railway Company, Limited, (Tramways) Act, 1893."

2. For the purposes of this Act the terms hereinafter mentioned shall have the meanings hereinafter assigned to them; that is to say,

the term "road" shall mean any way being a public highway and the carriage way of any bridge forming part of or leading to the same;

the term "commissioners shall mean

the word "district" in relation to com-

diction of such commissioners;
the term "police magistrates"

mean any police magistrate acting in the police court for the district; the term "company" shall mean "The Barbados Railway Company, Limited." Part I.

Construction of tramway.

3. The company shall have authority to construct and maintain subject to the provisions of this Act a tramway from the city of Bridgetown to Colleton plantation in the parish of Saint Peter, with all proper rails, plates, offices, weighbridges, turn tables, carriage and engine houses, warehouses, works and conveniences connected therewith, or for the purposes thereof and may work and use the same.

Before commencing to construct the tramway authorized by this Act;

(1) The company shall furnish the Governor-in-Executive Committee with plans and sections of such tramway in triplicate showing the exact course which every such tramway will take, and the land and roads over which it will pass, which plans and sections are to be dealt with as follows,

(2) The Governor-in-Executive Committee shall as soon as possible cause one copy of the said plan and section to be laid before the Legislative Council,

Provided always that such tramway shall not be proceeded with unless and until the plan and section laid before the Legislative Council and the House of Assembly shall have received the sanction of both houses. And such plans and sections shall not be varied or altered unless amended plans shewing such variations and alterations shall be dealt with and approved of in the same manner as the original plans.

4. The tramway authorised by this Act to be laid shall be constructed of a gauge not exceeding three feet six inches, and shall be laid on one side of the road only, namely, the lower or seaward side and so that the rail nearer the centre of the road shall be at least eighteen feet (inclusive of the trench) from the opposite side of the road, (except at "Prospect" "Derricks" and "Holetown" bridges which may remain at their present widths, but a notice bell shall be kept ringing for a distance of two hundred yards when the car is approaching either of the aforesaid bridges) and shall not be open for public traffic until the same has been inspected and certified to be fit for such traffic and a certificate that the provisions

of this section have been complied with, given by some person to be appointed by the Governor-such inspection to be at the cost of the company; provided always that if the carriages or motors used on the tramway shall extend beyond the outer edge of the wheels thereof less than eighteen inches on each side, the width of the gauge of such tramway may be increased, provided the width of the gauge and the distances over which such carriages or motors so extend shall not when taken together in any case exceed six feet 6 inches.

5. The rails of the tramway shall be of the flanged type and the tramway shall be maintained in such manner that the uppermost surface of the rail shall be on a level with the surface of the road except on curves of less than fifty feet mean radius where the outer rail may be laid at the proper elevation.

6. The company shall at their own expense at all times maintain and keep in good condition and repair with such materials and in such manner as the commissioners shall direct and to their satisfaction, so much of any road whereon the tramway belonging to them is laid as shall lie between the rails of the tramway and so much of the road as extends cigliteen inches beyond the rails of and on each side of the tramway.
