MESSAGES FROM THE HOUSE.

The following message from the House was received and read:

To the President of the Senate:

HOUSE OF REPRESENTATIVES,
Lansing, May 21, 1901.

Sir-I am instructed by the House to retransmit the following bill: House bill No. 1255, entitled

A bill to amend the charter of the City of Grand Rapids;

For which the Senate adopted a substitute having the same title. And now to inform the Senate that the House has amended said substitute so as to read as follows:

Section 1. That section 5 of title 2 of the charter of the City of Grand Rapids be amended to read as follows:

Sec. 5. At said first annual election, and annually thereafter, there shall be elected in each ward one constable who shall hold his office for the term of one year and until his successor is elected and qualified. At the first annual election after the passage of this Act, and every two years thereafter, there shall be elected by the electors of the whole city, one mayor, one city attorney, one clerk of the superior court, and one clerk of the police court, each of whom shall hold his office for the term of two years and until his successor is elected and qualified.

At the second annual election after the passage of this Act, and every two years thereafter, there shall be elected by the electors of the whole city, one treasurer, one clerk, one comptroller, one marshal and

one clerk of the justice courts, each of whom shall hold his office for the term of two years and until his successor is elected and qualified: Provided, That no person shall be elected or appointed to any office created by this Act, who shall hereafter be a defaulter to said city, or to the State of Michigan, or to any county, city or village therein, or who shall use public funds under his control contrary to law; and any person shall be considered a defaulter who shall refuse or neglect, for sixty days after demand made, to account for and pay over to the officer, board or body authorized to receive the same, any public money which had come into his possession.

Sec. 2. That section 7 of title 2 of the charter of the City of Grand Rapids be amended to read as follows:

Sec. 7. The aldermen elect of the common council, on the first Monday in May after the passage of this Act, or within a reasonable time thereafter, and on the first Monday in May of every succeeding year, or within a reasonable time thereafter, shall elect three highway commissioners, whose terms of office shall be one year and until their successors are elected and qualified, and whose duties and salaries shall be prescribed by the common council;

In the adoption of which substitute as thus amended the House has. concurred, by a majority vote of all the members elect, and by a vote of two-thirds of all the members elect has ordered the same to take immediate effect, and in which the concurrence of the Senate is respectfully asked.
