The motion made by Mr. Goodell then did not prevail, a majority of all the Senators present not voting therefor, by yeas and nays, as follows:

The question being on the motion made by Mr. Kelly, that the vote by which the Senate refused to pass the bill be reconsidered.

Mr. Goodell moved as a substitute for the motion that the further consideration of the bill be indefinitely postponed.

Mr. Atwood arose to a point of order and stated that the bill having failed to pass the Senate, no motion was in order but for the reconsideration thereof.

The President declared the point of order well taken.

The question then being on the motion made by Mr. Kelly, that the vote by which the Senate refused to pass the bill be reconsidered, Mr. Kelly demanded the yeas and nays.

The motion made by Mr. Kelly then prevailed, a majority of all the Senators present voting therefor, by yeas and nays, as follows:

Pending the announcement of the vote upon the motion made by Mr. Kelly, the vote of Senator Humphrey was demanded by Senator Kelly, whereupon Senator Humphrey voted "nay" and was so recorded.

Mr. Goodell moved as a substitute for the motion, that the further consideration of the bill be indefinitely postponed.
