A bill to amend the title and sections 2, 4, 5, 18, 20, 21 and 28 of an act, entitled "An act to provide for the incorporation of cities and for changing their boundaries," approved June 2, 1909, being Act No. 279 of the Public Acts of 1909;

Was read a third time, and pending the taking of the vote on the passage thereof, Mr. Murtha moved to amend the bill as follows:

By striking out entire section 25.

The question being on the passage of the bill,
Mr. Mapes moved to amend the bill as follows:

1. By inserting a new section to stand as section 20 and to read as follows:

"Sec. 20. The charter commission shall convene on the second Tuesday after the election at the place designated therefor. The city clerk shall preside at the first meeting; shall administer the oath of office to the members-elect, and shall act as clerk of the commission. It shall be the sole judge of the qualifications, elections and returns of its own members, choose its own officers, except clerk, determine the rules of its proceedings and keep a journal. A roll call of its members on any question shall be entered on the journal at the request of one-fifth of its members or less if it shall so determine. It may fill any vacancy in its membership, and it shall fix the time for the submission of the charter to the electors. No. member shall receive compensation for more than ninety days and only for actual attendance. A majority of all the members shall constitute a quorum, and its sessions shall be public. The commission may submit with the charter, independent sections or propositions and such of them as shall receive the approval of a majority of the electors voting thereon shall become a part of the charter if the charter is adopted by the electors."

2. By adding a new section to the bill to stand as section 37 and to read as follows:

"Sec. 37. All charters heretofore formulated and all proceedings of charter commissions heretofore had under this act are hereby validated and made effectual so far as the same shall conform to and be within the provisions of this act as amended."

The question being on receiving the amendments,

The amendments were received, a majority of the Senators-elect voting therefor.

The amendments were then adopted.

The question being on the passage of the bill,

Mr. Taylor moved to amend the bill as follows:

1. By striking out line 1 of section 1 and inserting in lieu thereof the following:

"Section 1. The title and sections 2, 4, 5, 18, 19, 20, 21, 25 and 28 of an act."

2. By adding to section 1 the words "And a new section is hereby added to stand as section 37."

The question being on receiving the amendments,

The amendments were received, a majority of the Senators-elect voting therefor.

The amendments were then adopted.

The question being on the passage of the bill,

The bill was then passed, a majority of the Senators-elect voting therefor, by yeas and nays, as follows:

Mr. Taylor moved to amend the title so as to read as follows:

A bill to amend the title and sections 2, 4, 5, 18, 19, 20, 21, 25 and 28 of an act, entitled "An act to provide for the incorporation of cities and for changing their boundaries," approved June 2, 1909, being Act No. 279 of the Public Acts of 1909, and to add a new section thereto. The motion prevailed and the title of the bill was so amended. The title of the bill as amended, was then agreed to.

House bill No. 88 (file No. 24), entitled

A bill to fix the salary of the Commissioner of Insurance; to provide for the disposition of all moneys received by said Commissioner in the performance of duties connected with his office, and to repeal all acts or parts of acts contravening the provisions of this act.

Was read a third time and passed, a majority of the Senators-elect voting therefor, by yeas and nays, as follows:

Mr. Moriarty moved that the bill be ordered to take immediate effect. The motion prevailed, two-thirds of the Senators-elect voting therefor.
