9 o'clock a. m.

The Senate met pursuant to adjournment and was called to order by the President.

The roll of the Senate was called by the Secretary.

The following Senators were present:

Messrs. Barnaby, Bradley, Cartier, Conley, Foster, Fowle, James, Kingman, Kline, Lee, Leidlein, Mapes, Miller, Moriarty, Murtha, Putney, F. D. Scott, G. G. Scott, Taylor, Vanderwerp, Vaughan, Walter, Ward, Watkins, Weter, Wiggins-26.

The following Senator was absent with leave: Mr. Rosenkrans—1. The following Senators were absent without leave: Messrs. Collins, Freeman, Newton, Snell and White-5.

Mr. Taylor moved that the absentees without leave be excused from today's session.

The motion prevailed.

Mr. Weter asked and obtained leave of absence for himself from today's session after 10:30 o'clock a. m.

MESSAGES FROM THE GOVERNOR.

The following message from the Governor was received and read:

MOTIONS AND RESOLUTIONS.

Mr. F. D. Scott moved that the Sergeant-at-Arms be instructed to so enforce Senate Rule 50, that visitors shall be excluded from the body and aisles of the Senate chamber, and allowed only the seats along the the walls.

Mr. James moved to so amend the motion of Mr. Scott that Senate Rule 50 be enforced in all parts of the Senate Chamber.

The motion to amend prevailed.

The motion as to the enforcement of Rule 50, as amended, then prevailed.

Mr. Weter moved that the members of the Senate of 1907 who are

to hold a reunion this afternoon, be invited to occupy, for the occasion, their former seats in this Senate Chamber.

The motion prevailed.

Senate bill No. 393 (file No. 367), entitled

A bill to create a game and fish commission, defining its powers and duties and making an appropriation therefor;

With the following amendment thereto :

By inserting in line 5 of section 7 after the word "Commission" the words "The Board of Fish and Game Commissioners shall also appoint such county Game Wardens or protectors for the same term, and with the same powers and authority, as under and by the provisions of existing Local Acts, and to be appointed by the State Game and Fish Warden."

Recommend that the amendment be concurred in, and that when so amended the bill pass.

Senate bill No. 402 (file No. 377), entitled

A bill to amend sections 1, 2, 3, 4, 5 6. 7, 8, 9 and 10 of Act No. 164 of the Laws of 1869, entitled "An act to define certain offenses affecting railroads and to provide punishment for the same," as amended and enlarged by Act No. 168 of the Laws of 1871, and by Act No. 93 of the Public Acts of 1875, and by Act No. 146 of the Public Acts of 1881, and to add three new sections thereto to stand as sections 11, 12 and 13; With the following amendment thereto :

By inserting in line 5 of section 1 after the figures "1881" the following: "being compiler's sections 11623 to 11633 inclusive, of the Compiled Laws of 1897."

Recommend that the amendment be concurred in, and that when so amended the bill pass.
