Ths following is the substitute:

A bill concerning State inspection of the appliances, methods and work employed in sugar beet testing laboratories in Michigan.

The People of the State of Michigan enact:

Section 1. The Dairy and Food Commissioner of the State of Mich igan shall select and appoint one or more inspectors of sugar beet test ing, who shall be competent sugar chemists and sugar beet testers of practical experience.

Sec. 2. The inspectors at all times shall have access to such labora tories as are maintained by sugar manufacturers in Michigan, and shall devote their entire time to the inspection of the beet sugar factories of the State visiting each factory as many times as possible during the active working season.

Sec. 3. Whenever a petition requesting the inspection of the work at any sugar beet testing laboratory is signed by six or more sugar beet growers who are contractors with the factory they desire inspected and said petition is forwarded to the Dairy and Food Commissioner of the State of Michigan, it shall be the duty of an inspector to make the inspection requested as soon as the circumstances will permit.

Sec. 4. The inspector shall make and check as many tests as possible on the samples of beets and shall make such suggestions to those in charge as he deems advisable in order to promote the accuracy of tests and consequent justice to both buyer and seller of beets. He shall report to the Dairy and Food Commissioner of the State of Michigan

each day's proceedings. These proceedings of the inspectors and such other matters as the Dairy and Food Commissioner of the State of Michigan deems of interest to beet growers and factory owners shall be gathered in the form of a bulletin to be issued annually and sent out to each beet grower and factory owner who applies.

Sec. 5. The sugar companies shall keep a daily record in a suitable book which shall contain the sugar per cent and the name of the seller of beets, or some designating number in place of the name of the seller. The records must be kept complete to date and accessible to the inspectors all times.

Sec. 6. The manager or other officers of factories manufacturing beet sugar shall render to the State Treasurer on or before thirty days after the close of the campaign each year, a sworn statement of the number of tons of sugar beets manufactured together with an inspection tax of one-quarter cent per ton on all beets manufactured into sugar. Said fund to be maintained by the State Treasurer as an inspection fund for beet sugar factories. The salary and actual and necessary expenses and equipment of the inspectors appointed under the provision of this act shall be paid out of the fund hereby created.

Sec. 7. Any manager or factory official who shall refuse to admit to any beet sugar factory in operation in this State any inspector who produces authority signed by the Dairy and Food Commissioner of the State of Michigan, or who shall interfere with or obstruct any person so provided with such written authority in the exercise of any privilege, or in the discharge of any duty provided by this act, or who shall violate any of the provisions of this act, shall be guilty of a misdemeanor and shall be punished by a fine of not less than three hundred dollars nor more than five thousand dollars or by imprisonment in the county jail for not less than thirty days nor more than one year, or by both such fine and imprisonment in the discretion of the court.
