PROCEEDINGS OF THE SENATE IN EXECUTIVE SESSION.

Lansing, Wednesday, Jan. 11, 1911.

2:20 o'clock p. m.

The Sergeant-at-Arms announced that the Senate Chamber had been prepared for the Executive Session.

Mr. White moved to discharge the Committee on Executive Business from the further consideration of the appointments transmitted to the Senate by Governor Warner, except as to the appointment of a member of the Detroit Board of Health, and as to that appointment that the committee be discharged from the further consideration of the name of Dr. J. B. Kennedy.

Mr. Cartier moved as an amendment that the Committee on Executive Business be discharged from the further consideration of all the nominations sent to the Senate by both Governor Warner and Governor Osborn, and referred to the Committee on Executive Business.

Which amendment was agreed to by Mr. White.

The question being on the motion made by Mr. White as amended by Mr. Cartier,

Mr. Cartier moved that the Senate take a recess for fifteen minutes, the time being 3:35 o'clock p. m.

The motion prevailed.

AFTER RECESS.

3:50 o'clock p. m.

A quorum of the Senate was present.

The Committee on Executive Business, by its Chairman, Mr. Fowle, reported

That said committee had had under consideration the motion made by Mr. White as amended by Mr. Cartier and requested that the committee be allowed further time to submit a report to the Senate, the committee having agreed that it would prepare, and submit to the Senate tomorrow, a report embodying all the nominations referred to the committee in accordance with the motion made by Mr. White, with or without recommendation.

Whereupon Mr. White withdrew his motion.

Mr. Mapes moved that when the executive session close today it be with the understanding that the Senate take up the report of the Committee on Executive Business in executive session tomorrow at 2:30 o'clock p. m.

The motion prevailed.

Mr. Mapes moved that the executive session close.

The motion prevailed, the time being 4 o'clock p. m.

By agreement reached in executive session yesterday the Senate took up the order of

REPORTS OF STANDING COMMITTEES.

The Committee on Executive Business to which was referred the following appointments to office by Ex-Governor Warner and nominations to office by Governor Osborn:

J. B. Kennedy, M. D., of Detroit, Wayne county, as a member of the Detroit Board of Health for the term ending February 28, 1914;

James Scully, of Ionia, Ionia county, appointed September 1, 1909, as member of the Michigan Railroad Commission, for the term ending January 15, 1911;

Frederick Klump, of Cass City, Tuscola county, appointed July 15, 1909, member of the State Court of Mediation and Arbitration, for the term of three years from and after May 26, 1909;

William D. Calverly, of Houghton, Houghton county, appointed September 1, 1909, as member of the Board of Control of the Michigan College of Mines, to fill vacancy caused by the resignation of Walter Fitch, for the term ending June 9, 1913;

Elizabeth G. Flaws, of Grand Rapids, Kent county, appointed September 8, 1909, as a member of the Board of Registration and Examination of Nurses for a term of three years from and after July 31, 1909;

Dr. Arthur W. Scidmore, of Three Rivers, St. Joseph county, appointed September 8, 1909, as a member of the Board of Registration and Examination of Nurses, for the term of six years from and after August 1, 1909;

Elizabeth Tacey, of Detroit, Wayne county, appointed September 8, 1909, as a member of the Board of Registration and Examination of Nurses, for a term of six years, from and after July 31, 1909;

Walter Beckwith, of Detroit, Wayne county, appointed September 30, 1909, as a member of the Board of Examiners of Horse-shoers, for a term of five years, from and after August 4, 1909;

Will E. Collins of Owosso, Shiawassee county, appointed January 17, 1910, as a member of the Board of Pharmacy, for the term of five years, from and after January 1, 1910;

Dr. Carrie C. Classen, of South Haven, Van Buren county, appointed

March 9, 1910, as a member of the Board of Osteopathic Registration and Examination, for a term of five years, from and after April 30, 1910;

Dr. Wilbert B. Hinsdale, of Ann Arbor, Washtenaw county, appointed June 29, 1910, as a member of the Board of Trustees of the State Sanatorium for the Care and Treatment of Persons having Tuberculosis, for the term of six years, from and after September 1, 1909 ;

Louis H. Weil, of Port Huron, St. Clair county, appointed June 29, 1910, as a member of the Mackinac Island State Park Commission, to fill vacancy caused by the death of John R. Bailey, for the term ending June 21, 1913;

Dr. Bret Nottingham, of Lansing, Ingham county, appointed September 28, 1910, as a member of the Board of Registration in Medicine, to fill vacancy caused by the resignation of Dr. Joseph H. Ball, for the term ending September 30, 1911;

Jennie Leece, of Traverse City, Grand Traverse county,, appointed November 4, 1910, as a member of the Board of Registration and Examination of Nurses, to fill vacancy caused by the ineligibility of Alfreda Maud Galbraith, for the term ending July 31, 1912;

J. A. Heath, of Richmond, Macomb county, appointed November 12, 1910, as a member of the Board of Trustees of the State Sanatorium for the Care and Treatment of Persons having Tuberculosis, for the term of six years, from and after September 1, 1909;

Marion O. Rowland, of Paw Paw, Van Buren county, appointed November 15, 1910, as Commissioner of Insurance, to fill vacancy caused by the resignation of James V. Barry, for the term ending June 30, 1911; Edward A. Phillips, of Fenton, Genesee county, appointed November 30, 1910, as a member of the Board of Control of the Michigan Reformatory, to fill vacancy caused by the resignation of Leonard Freeman, for the term ending February 15, 1915;

John S. Haggarty, of Detroit, Wayne county, appointed December 20, 1910, as a member of the Board of Control of the Michigan State Prison, to fill vacancy caused by the death of T. J. Navin, for the term ending February 15, 1915;

William F. Gallagher, of Owosso, Shiawassee county, appointed December 20, 1910, as a member of the Board of Trustees of the Industrial School for boys, to fill vacancy caused by the resignation of W. A. Rosenkrans, for the term ending December 31, 1912;

Elliott F. Grabill, of Greenville, Montcalm county, appointed August -11, 1909, as a member of the Board of Managers of the Michigan Soldiers' Home, to fill vacancy caused by the resignation of Townsend A. Ely, for the term ending February 28, 1913;

William H. Johnston, of Ishpeming, Marquette county, as a member of the Board of Control of the State House of Correction and Branch of State Prison in the Upper Peninsula to fill the vacancy caused by the resignation of Otto C. Davidson, of Iron Mountain, whose term expires February 14, 1911;

James Bice, of Marquette, Marquette county, as a member of the Michigan Railroad Commission for the term ending January 15, 1913; Perry F. Powers, of Cadillac, Wexford county, as Commissioner of Labor for the term ending July 1, 1911;

Leartus M. Connor, M. D., of Detroit, Wayne county, as a member of the State Board of Health for the term ending January 31, 1915. J. B. Kennedy, M. D., of Detroit, Wayne county, as a member of the Detroit Board of Health for the term ending February 28, 1914; Dr. George F. Burke, of Detroit, Wayne county, as a member of the Board of Dental Examiners for the term ending December 31, 1914; Dr. C. W. Hitchcock, of Detroit, Wayne county, as member of the Board of Trustees of the Eastern Michigan Asylum for the term ending February, 1912;

O. L. Millard, of Hersey, Osceola county, as a member of the Board f Control Home for Feeble-Minded and Epileptic, at Lapeer, for term ending January 31, 1915;

Dr. J. B. Griswold, of Grand Rapids, Kent county, as a member of the Board of Trustees of the Michigan Soldiers' Home for the term ending February 28, 1915;

John S. Weidman, of Mt. Pleasant, Isabella county, appointed September 8, 1909, as a member of the Board of Control of the Home for the Feeble-Minded and Epileptic, to fill vacancy caused by the death of Charles T. Wilbur, M. D., for the term ending January 31, 1915;

Edwin L. Keyser, of Pontiac, Oakland county, appointed September 30, 1909, as a member of the Board of Trustees of the Eastern Michigan Asylum, to fill vacancy caused by the death of Edward M. Murphy, for the term ending the second Monday in February, 1911;

Henry N. Loud, of Au Sable, Iosco county, appointed February 24, 1910, as a member of the Board of Library Commissioners, for a term of four years, from and after June 8, 1909;

Arthur H. Vandenberg, of Grand Rapids, Kent county, as a member of the State Board of Library Commissioners for the term ending June 8, 1913;

Respectfully report that the committee has had the same under con

sideration and recommend that the Senate advise and consent to the said nominations to office.

Mr. Fowle moved that the nominations to office recommended in the report of the committee down to and including the name of William H. Johnston be voted on collectively and that the remaining nominations to office recommended by said committee, be voted on separately.

Mr. Collins demanded a division of the question and requested that the name of E. T. Boden, of Bay City, Bay county, as a member of the State Board of Pharmacy for the term ending December 31, 1915, be excepted from the motion made by Mr. Fowle.

Mr. White demanded a division of the question and requested that the names of John S. Weidman, of Mt. Pleasant, Edwin L. Keyser, of Pontiac, Henry N. Loud, of Au Sable, and Arthur H. Vandenberg, of Grand Rapids, be excepted from the motion made by Mr. Fowle.

Mr. Mapes moved as a substitute for the motion made by Mr. Fowle, that the Senate proceed to a vote on all the nominations recommended by the Committee on Executive Business except the names of Boden, Weidman, Keyser, Loud and Vandenberg.

The substitute was adopted.

The motion as substituted then prevailed.

The Senate then advised and consented to the nominations recommended in the report of the Committee on Executive Business except the names of Boden, Weidman, Keyser, Loud and Vandenberg, a majority of the Senators present voting therefor, by yeas and nays, as follows:

Dickinson, of Pontiac, Oakland county, appointed September 1, 1909, as a member of the Michigan Railroad Commission, for the term ending January 15, 1913;

E. A. Honey, of Kalamazoo, Kalamazoo county, appointed December 23, 1909, as a member of the Dental Board for a term of five years from and after January 1, 1910;

Edwin O. Shaw, of Newaygo, Newaygo county, appointed February 24, 1910, as a member of the Board of Trustees of the Michigan Soldiers' Home, to fill vacancy caused by the death of Edward P. Allen, for the term ending February 28, 1915;
