SIR: Pursuant to the order of the court I transmit herewith a certified copy of the findings filed by the court in the aforesaid cause, which case was referred to this court by the Committee on War Claims, House of Representatives, under the act of March 3, 1883, known as the "Bowman Act."

The United States.]

This case, being a claim for supplies or stores alleged to have been taken by or furnished to the military forces of the United States for their use during the late war for the suppression of the rebellion, the court, on a preliminary inquiry, finds that Nancy Wright, deceased, the person alleged to have furnished such supplies or stores, or from whom the same are alleged to have been taken, was loyal to the Government of the United States throughout said war.

STATEMENT OF CASE.

The claim in the above-entitled case for supplies or stores alleged to have been taken by or furnished to the military forces of the United States for their use during the late war for the suppression of the rebellion was transmitted to the court by the Committee on War Claims of the House of Representatives on the 23d day of February, 1889.

On a preliminary inquiry the court, on the 20th day of May, 1899, found that the person alleged to have furnished the supplies or stores, or from whom they were

alleged to have been taken, was loyal to the Government of the United States throughout said war.

The case was brought to a hearing on its merits on the 15th day of November, 1909. Moyers & Consaul, esqs., appeared for claimant, and the Attorney-General, by Charles F. Kincheloe, esq., his assistant, and under his direction, appeared for the defense and protection of the interests of the United States.

The claimant in his petition makes the following allegations:

That he is a citizen of the United States, residing in Hardeman County, State of Tennessee; that he is the administrator of the estate of Nancy Wright, deceased, late of said county and State; that during the late civil war United States military forces, under proper authority, took from said decedent quartermaster stores and commissary supplies of the kinds and values below stated, to wit:

That a claim for compensation for said supplies was presented to the QuartermasterGeneral and was rejected by that officer because he was not satisfied that the claim was just.

The court, upon the evidence adduced and after considering the same with the briefs of counsel on each side, make the following

FINDING OF FACT.

During the late civil war the military forces of the United States, by proper authority, for the use of the army, took from claimant's decedent, in Hardeman County, State of Tennessee, property of the kind and character described in the petition, which at the time and place of taking was reasonably worth the sum of two hundred and twenty-five dollars ($225), no part of which appears to have been paid.

SIR: I have the honor to transmit herewith, for the consideration of Congress, copy of a communication from the Acting Secretary of the Navy of the 4th instant, submitting an estimate of appropriation in the sum of $1,500, to pay George H. Baker, for services and expenses incurred in preparing instructions for firing steam boilers in the United States Navy, during 1905, by direction of the Secretary of the Navy, Hon. Paul Morton, and providing 600 copies of the same to the commander in chief of the North Atlantic Fleet.
