SIR: I have the honor to transmit herewith, for the consideration of Congress, copy of a communication from the Acting Secretary of Commerce and Labor, of the 21st instant, submitting a request for an appropriation of $20,650 for the restoration of the grounds and property at the general light-house depot at Tompkinsville, N. Y., as an addition to the amount heretofore appropriated for repairs of lighthouses, 1910, by act approved March 4, 1909.

SIR: By an act of Congress approved March 1, 1905 (U. S. Stat. L., vol. 33, chap. 1294, p. 820), the Secretary of Commerce and Labor was authorized to sell and convey to the city of New York, for purposes described in said act, about an acre of the property of the United

States known as the "United States light-house property," in the Borough of Richmond, city of New York, and State of New York, upon such terms and conditions as he shall deem best.

The above-mentioned act provided that the proceeds from said sale should be appropriated as an additional sum to the amount to be appropriated for repairing, protecting, and improving lighthouses and buildings and other described purposes incident thereto, for the fiscal year ending June 30. (Act approved March 3, 1905.)

I have the honor to state that, owing to the delay in the consummation of the above-mentioned sale and conveyance of the land to the city of New York, payment there for in the amount of $46,514.55 was not made until April 17, 1909, prior to which date the availability of the appropriation for light-house purposes for the fiscal year 1906, to which these proceeds were to be added, expired, and therefore, on June 26, 1909, the funds received, less the sum of $619.85, expended for incidental expenses of the sale, or the amount of $45,894.70, was deposited to the credit of the Treasurer of the United States to be carried to the surplus fund.

It would appear that the Congress by its action in appropriating the amount received from the sale and conveyance of the land in question as an addition to the appropriation for the maintenance of the LightHouse Establishment deemed it proper that such funds should be applied to the purpose of restoring the remaining grounds, buildings, boundary walls, etc., to a proper condition, but that, for the reason hereinabove stated, said funds did not become available during the life of the appropriation to which they were to be added.

I therefore request that you will cause to be presented to the present Congress for its earliest practicable action a bill for the appropriation of $20,650, the amount estimated as necessary for the payment for the restoration of the grounds and property at the general lighthouse depot at Tompkinsville, N. Y., as an addition to the amount heretofore appropriated for repairs of light-houses, 1910, by act approved March 4, 1909.

I beg to invite your attention to the importance of an early action by the Congress upon this matter by reason of the short period remaining in the fiscal year 1910 for which the appropriation is requested. Respectfully,
