Subject: Extortionate rate on coal to Williamstown from Jellico district.

An investigation of this complaint disclosed the fact that a rate of $2.00 per ton was being charged for the transportation of coal from and to the points indicated. A reduction of 30 cents per ton was made and a new tariff issued.

Subject: Extortionate switching charges.

It developed from an investigation of this complaint that the defendant company was charging its patrons $5.00 per car for switching. This was reduced to $2.00 per car, and the excess for past services to complainant was refunded.

Subject: Taxation.

As a result of an investigation of this complaint, this company's taxes were increased.

Subject: Petition for new depot.

It appearing to the Commission that the depot at this place had been destroyed by fire, the defendant company was requested and did erect a new depot which is deemed sufficient for the accommodation of the traveling and shipping public at that point.

Subject: Petition for depot and agency at Silerville, Ky. After investigation of this complaint, it was recommended that a depot be built and an agency established at this point, which was promptly done.

HARGIS BROS., JACKSON, KY.,

L. & A. RAILROAD COMPANY.

Subject: Extortionate rate on coal.

This complaint was investigated and it was found that defendant company charged $40.00 per car for the transportation of coal to Jackson, which was in the opinion of the Commission extortionate, and a reduction to $20.00 per car was made, and the excess refunded to complainant, and, on their motion, this complaint was dismissed settled.

ILLINOIS CENTRAL RAILWAY COMPANY.

Subject: Failure to grant free transportation with live stock.

It developed, upon an investigation of this complaint, that defendant company's contract with complainant for this particular shipment entitled him to free transportation with his stock, and defendant was requested to refund the amount of this transportation, which it has agreed to do.

Subject: Extortionate coal rates.

Notice has been given that a meeting of the Commission will be held at Mt. Sterling, Ky., for the purpose of hearing and determining this complaint on the 3d day of January, 1905.

Subject: Petition for additions to depot.

This complaint has not yet been investigated nor acted upon and is therefore continued.

Subject: Failure to build switch.

This complaint was partly investigated and defendant company agreed to build the switch complained of.

CHESAPEAKE & NASHVILLE RAILWAY COMPANY.

Subject: Damage to merchandise in transit.

Complainant was advised that his remedy was by suit, the Commission not having power in the premises.

Illinois Central Railroad Company on petition to abandon stations at Meadowlawn and River Side, Ky.

An investigation of this petition showed that a large cement plant is under construction within a short distance north of River Side, about three-quarters of a mile from River Side depot, and that this place is fast building up and bids fair to be one of the most important stations upon this company's line. The Commission refused to consent to the abandonment of the station and depot at Meadowlawn, but consented that the River Side depot may be removed and a new depot erected at a designated point near the Horner Cement Mills, about three-quarters of a mile north of its present location.

A number of complaints were referred by the Commission to Commissioner McD. Ferguson, which are in process of adjustment by him through correspondence with the various railroad companies. The office and dwelling of Commissioner Ferguson, having recently been burned, together with all the correspondence and complaints referred to, the records will have to be supplied.

THE L. & N. AND GLASGOW RAILROAD COMPANY.

Subject: Extortionate freight rates.

At a meeting of the Railroad Commission, held in the city of Louisville, Ky., on the 6th, 7th, 9th and 10th days of June, 1904; present, C. C. McChord, Chairman; McD. Ferguson, Commissioner First District, and A. T. Siler, Commissioner Third District.

The chairman announced that the meeting had been called for the purpose of rendering a decision in the matter of complaint of S. T. Young and Others vs. The Glasgow Railroad Company and Louisville & Nashville Railroad Company and, after full consideration of the testimony offered, it was de termined by the Commission that a reduction of 10 per cent. on the rates specified in the classes and commodities, hereinafter enumerated, be made, and that in computing the fractions in calculating said 10 per cent. reduction, if the frac tion is under five, it is not to be counted, but where it is five and over, that the same should be counted as a whole number. The following shows the former rate and the rate as reduced on classes and commodities to and from Glasgow and Louisville, Ky., over the lines of the Louisville & Nashville and Glasgow Railroad Companies, and it is now ordered by this Commission that said railroad companies charge no more for the transportation of such commodities as are now assigned to the several classes that are herein enumerated, than that designated as the new rate, that is to say, 10 per cent. less than the former rate, calculated on the basis hereinbefore stated, viz.:

It is further ordered that the chairman notify each of said railroad companies, and the meeting adjourned subject to the call of the chairman.

Illinois Central Railroad Company on application to change location of depot at Horse Branch.

At a meeting of the Railroad Commission, held at its office in Frankfort, Ky., Sept. 9, 1904, present, A. T. Siler, McD. Ferguson and C. C. McChord, Commissioners. The application of the Illinois Central Railroad Company for a change of its depot at Horse Branch, Ky., from its present site and to locate same and erect a new depot at a point shown upon the blue print filed with said application, was received and ordered filed, and the Commission, having investigated said application and being now advised, consents that said change may be made, as shown in said application and blue print. It is ordered that a copy of this order be mailed to the proper official of the Illinois Central Railroad Company. The question of approving the depot is reserved for further action, the plans to be hereafter submitted.
