ARTICLE VII.

CONCERNING NUISANCES.

SEC. 1. No person shall, in this city, deposit Sewers not to be or throw into any sewer, sewer-inlet, or privy vault which has a sewer connection, any animal or vegetable substance, or any straw, hay, ashes or soot, or any article whatever that may cause the sewer to choke up, or otherwise to create a nuisance.

SEC. 2. Any person convicted before the Police Court for violating any of the above provisions, shall be deemed guilty of a misdemeanor, and fined not less than five nor more than fifty dollars.

SECTION 1. Whoever shall, in this city, False falsely represent himself to be an officer of this cer. city; or shall, without being duly authorized by the city, exercise, or attempt to exercise, any of the duties, functions or powers of a city officer; or member of the Metropolitan Police force; or shall hinder, obstruct, resist, or otherwise interfere with any city officer in the discharge of his official duties; or attempt to prevent any such officer from arresting any person; or attempt to rescue from such officer any person in his custody, shall be deemed guilty of a misdemeanor.

ARTICLE IX.

PENALTIES.

SECTION 1. Whoever shall be convicted of any misdemeanor under any provision of this Ordinance in a case where no special penalty is prescribed, shall forfeit and pay to the city a sum not less than one nor more than one hrnPenalty for sec dred dollars for the first offense; for the second offense of a like nature, he shall forfeit and pay not less than double the minimum penalty aforesaid; for the third offense of a like nature, not less than treble said minimum; and so on, increasing the minimun three dollars upon each additional conviction.

SEC. 2. The word "misdemeanor," whenever it occurs in any Ordinance, shall be construed to mean and to stand in lieu of a "violation of ordinance."

AN ORDINANCE

IN RELATION TO

FINES, FORFEITURES AND PENALTIES.

Be it ordained by the City Council of the City of St. Louis:

the City of St. Louis, or either of them, the fixed by Ordidoing of any act or the omission to do any act or duty, is declared to be a breach of any or either of said ordinances, and there shall be no fine or penalty declared for any such breach, any person or persons convicted of any such breach shall be adjudged to pay a fine of not less than one dollar, and not exceeding three hundred dollars.

SEC. 3. Whenever, in any ordinance of the City, heretofore or hereafter passed, a fine, forfeiture, or penalty is or may be prescribed, and not less than a given sum, but the maximum of such fine, forfeiture or penalty, is not likewise fixed, such maximum shall be as follows, to-wit: If the minimum of such fine, forfeiture, or penalty, shall be less than one hundred dollars, the maximum shall be three hundred dollars; if the minimum be one hundred dollars or above that sum, the maximum shall be five hundred dollars; and it shall be lawful, in any such case, to recover the maximum aforesaid in like manner as if the same were specifically set forth in any such ordinance.
