NUMBER SIXTY-FIVE.

Senate Chamber,

Lansing, Wednesday, April 18, 1923. 1:15 o'clock p. m.

The Senate met pursuant to adjournment and was called to order by the President.

The roll of the Senate was called by the Secretary.

Present: Senators Atwood, Bahorski, Bohn, Brower, Bernie L. Case, William L. Case, Condon, Connelly, Eldred, Gansser, Glaspie, Hayes, Henry, Horton, Hunter, Karcher, Leland, MacNaughton, Osborn, Pearson, Penney, Ross, Sligh, Smith, Truettner, Whiteley, Wilcox, Wood, Young- 29; a quorum.

Absent with leave: Senators Johnson and Riopelle-2.

Absent without leave: Senator Gettel-1.

Mr. Henry moved that Senator Gettel be excused from today's session.
The motion prevailed.

Presentation of Petitions.

Petition No. 555. By Mr. Eldred. One hundred fifty telegrams from citizens of Michigan favoring the reinstatement of the Homeopathic Department in the Michigan University.

The petition was referred to the Committee on State Affairs.

Petition No. 556. By Mr. William L. Case. Seventeen telegrams from citizens of Michigan favoring the reinstatement of the Homeopathic Department in the Michigan University.

The petition was referred to the Committee on State Affairs.

Petition No. 557. By Mr. William L. Case. Six telegrams from citizens of Michigan opposing the Chiropractors' Bill.

The petition was referred to the Committee on Public Health.

Announcement by Secretary of Printing and Filing of Bills.

The Secretary announced that the following named bills had been printed and placed upon the files of the Senators April 18:

To make additional appropriations for various State institutions and departments.

House bill No. 368 (file No. 269)—

To provide for the construction of a stadium at the Michigan Agricultural College.

To make appropriations for the Department of Public Safety.

To make appropriations for the Michigan State Prison.

House bill No. 265 (file No. 272) —

To amend section 2, Act No. 70, P. A. of 1911-to increase tax paid by steamboat owners.

House bill No. 401 (file No. 273)

To amend section 7, Act No. 279, P. A. of 1909-an act to provide for the incorporation of cities.

House bill No. 421 (file No. 274)

To regulate the operation and use of vehicles on public highways.

House bill No. 480 (file No. 275)—

To amend section 8, chapter 9, Act No. 283, P. A. of 1909-logging railroads. House bill No. 255 (file No. 276)

To amend section 14, chap. 2, Act No. 164, P. A. of 1881-to provide that annual meetings of school districts may be held on the second Monday of June.

House bill No. 499 (file No. 277)-

To amend section 9, Act No. 211, P. A. of 1921-to provide for continuance of vocational rehabilitation.

House bill No. 504 (file No. 278)—

To amend sec. 1, chap. 10, Act No. 164, P. A. of 1881-to provide that a school officer may be elected on plurality vote.

House bill No. 509 (file No. 279)

To amend the title and sections 1 and 2, Act No. 209, P. A. of 1921-to require the teaching of civil government in all schools of the State.

House bill No. 414 (file No. 280) —

To amend section 12, Act No. 183, P. A. of 1897-to provide that boards of supervisors may vote additional compensation to circuit court stenographers.

House bill No. 423 (file No. 281)

To amend section 4, chap. 5, Act No. 126, P. A. of 1917-an act to provide for the registration of electors.

House bill No. 324 (file No. 282)

To provide for the labeling of woolen yarns, cloth, etc.

House bill No. 392 (file No. 283)-

To limit the amount of taxes that may be levied upon real and personal property. House bill No. 420 (file No. 284)

To amend section 18, and to add nine new sections to Act No. 181, P. A. of 1919use of hog cholera serum, etc.

House bill No. 410 (file No. 285)—

To prohibit the wearing of masks except on certain occasions.

Acts Enrolled and Presented to Governor.

The Secretary announced the enrollment printing and presentation to the Governor on April 17, for his approval, of the following named acts:

Senate enrolled Act No. 33 (being Senate bill No. 44, file No. 111)—

An act to make appropriations for the State Board of Accountancy for the fiscal years ending June 30, 1924, and June 30, 1925, for maintenance, operation and other purposes.

Senate enrolled Act No. 34 (being Senate bill No. 48, file No. 146)—

An act to make appropriations for the Michigan Historical Commission for the fiscal years ending June 30, 1924, and June 30, 1925, for maintenance, operation and other purposes.

Senate enrolled Act No. 35 (being Senate bill No. 49, file No. 129)

An act to make appropriations for the Commissioner of Pardons and Paroles for the fiscal years ending June 30, 1924, and June 30, 1925, for maintenance, operation and other purposes.

Senate enrolled Act No. 36 (being Senate bill No. 140, file No. 106)

An act to supplement existing laws relating to the establishment and maintenance of municipal courts of record and to provide a system or method for the selection of juries for the trial of causes therein.

Messages From the House.

A message was received from the House of Representatives transmitting
House bill No. 365 (file No. 221), entitled

"A bill to amend the title of act number six of the Public Acts of the extra session of nineteen hundred seven, entitled "An act to define and to regulate the treatment and control of dependent, neglected and delinquent children, to pre

scribe the jurisdiction of the probate court and the powers, duties and compensation of the probate judge and the probate register with regard thereto; to provide for the appointment of county agents, register of the juvenile division and probation officers, and to prescribe their powers, duties and compensation, and to provide for the granting of re-hearings and modifications of orders, sentences and decrees of said court," as last amended by act number three hundred eight of the Public Acts of nineteen hundred fifteen, and to add a new section thereto, to stand as section 7-a."

The message informed the Senate that the House of Representatives has passed the bill.

The bill was read a first and second time by its title and referred to the Committee on Judiciary.

A message was received from the House of Representatives transmitting
House bill No. 491 (file No. 230), entitled

A bill to amend section 12 of Act No. 91 of the Public Acts of 1905, entitled "An act to prevent the importation from other states and the spread within this State of dangerous insects and dangerously contagious diseases affecting trees, shrubs, vines, plants and fruits," as amended by Act No. 187 of the Public Acts of 1917. The message informed the Senate that the House of Representatives has passed the bill.

The bill was read a first and second time by its title and referred to the Committee on Agriculture.

A message was received from the House of Representatives transmitting
House bill No. 12 (file No. 5), entitled

A bill to repeal Act No. 70, of the Public Acts of 1911, entitled "An act regulating the taxation of steam vessels, steam boats and other steam water craft of registered tonnage within the State of Michigan," approved April 13, 1911.

The message informed the Senate that the House of Representatives has passed the bill.

The bill was read a first and second time by its title and referred to the Committee on Taxation.

A message was received from the House of Representatives transmitting the following resolution:

House concurrent resolution No. 29.

A concurrent resolution providing for a joint committee to investigate the conduct of the State Highway Department under the laws of this State.

Whereas, the State Highway Commissioner has signified his desire for a thorough investigation of his department, therefore, be it

Resolved by the House of Representatives (the Senate concurring) that a joint Committee, consisting of two senators, to be named by the President of the Senate, and three representatives to be named by the Speaker of the House, be appointed to investigate said department to the end that full, complete and accurate information in respect to the conduct of such department be obtained and laid before this Legislature; and

Resolved further, that such Committee be given full power to investigate the books and records of such department and to examine, with or without oath, any officers or employes of such department in respect to such department; and

Resolved further, that such Committee may incur such expenses as may be necessary to obtain such information, including such travel and incidentals, connected therewith as such Committee may deem necessary to carry on such investigation; and

Resolved further, that said joint committee report its findings and recommenda tions to this Legislature at the earliest possible time.

The message informed the Senate that the concurrent resolution has been adopted by the House of Representatives.

Pending the order that, under rule 59, the concurrent resolution lie over one day, Mr. Connelly moved that rule 59 be suspended.

The motion prevailed.

The concurrent resolution was then considered and adopted.

A message was received from the House of Representatives re-returning in accordance with the request of the Senate therefor

House bill No. 174 (file No. 36), entitled

A bill to provide for the suspension of a teacher's certificate for violation of contract.
