Religious exercises were conducted by Father P. J. McSherry of St. Mary's Catholic Church of Lansing. The roll of the Senate was called by the Secretary. Present: Senators Atwood, Bahorski, Bohn, Brower, Bernie L. Case, Condon, Connelly, Eldred, Gansser, Gettel, Glaspie, Hayes, Henry, Horton, Hunter, Johnson, Karcher, Leland, Osborn, Pearson, Penney, Riopelle, Ross, Sligh, Smith, Truettner, Whiteley, Wilcox, Wood, Young-30; a quorum. Absent without leave: Senators William L. Case and MacNaughton-2. Mr. Gansser moved that the absentees without leave be excused from today's session. The motion prevailed. Presentation of Petitions. Petition No. 570. By Mr. Hayes. Resolution adopted by the Accountants' Study Club of A. W. Ehrman & Company, opposing the passage of the Chiropractors' Bill. Petition from Board of Education of Hamtramck, opposing any change in the distribution of the Library and Primary Money. The petition was referred to the Committee on Education. Acts Enrolled and Presented to Governor. The Secretary announced the enrollment printing and presentation to the Governor on April 23rd, for his approval, of the following named acts: Senate enrolled Act No. 41 (being Senate bill No. 235, file No. 201)— An act to amend section 4 of Act No. 106 of the Public Acts of 1909, entitled, as amended, "An act to regulate the transmission of electricity through the public highways, streets and places of this State, where the source of supply and place of use are in the same or different counties; to regulate the charges to be made for electricity so transmitted; to regulate the rules and conditions of service under which said electricity shall be furnished and to confer upon the Michigan Public Utilities Commission certain powers and duties in regard thereto," being section 4845 of the Compiled Laws of 1915, as amended by Act No. 274 of the Public Acts of 1921. Senate enrolled Act No. 42 (being Senate bill No. 224, file No. 184) — An act to amend section 9 of chapter 2 of Act No. 283 of the Public Acts of 1909, entitled "An act to revise, consolidate and add to the laws relating to the establishment, opening, improvement, maintenance and use of the public highways and private roads, the condemnation of property and gravel therefor; the building, repairing and preservation of bridges; setting and protecting shade trees, drainage, cutting weeds and brush within this State, and providing for the election and defining the powers, duties and compensation of State, county, township and district highway officials," being section 4326 of the Compiled Laws of 1915. Senate enrolled Act No. 43 (being Senate bill No. 35, file No. 110)— An act to make appropriations for the Board of Examiners of Barbers for the fiscal years ending June 30, 1924, and June 30, 1925, for maintenance, operation and other purposes. Messages from the House. A message was received from the House of Representatives re-returning A bill to make appropriations for the Michigan State Board of Examiners for Registration of Architects, Engineers and Surveyors for the fiscal years ending June 30, 1924, and June 30, 1925, for maintenance, operation and other purposes, Together with the House amendments to the bill, in the adoption of which amendments the Senate non-concurred. The message informed the Senate that the House of Representatives insists on its amendments and asks for a conference with the Senate on the matters of difference between the two Houses relative to the bill. Mr. Brower moved that the request of the House for a Conference be granted. The motion prevailed. The President appointed as conferees on the part of the Senate at said Conference Senators Atwood, Whiteley and Ross. The message informed the Senate that the House has amended the bill as follows: 1. Amend by inserting in section 1, line 16, after the word "stated," the words "subject to the general supervisory control of the State Administrative Board," 2. Amend by striking out of section 2, lines 2 and 3, the words "and the disbursing officer of the Board of Registration of Nurses and Trained Attendants shall render his accounts therefor." The message further informed the Senate that as thus amended the House has passed the bill and ordered that it take immediate effect. The question being on concurring in the amendments made to the bill by the House, The roll was called and the Senators voted as follows: So, a majority of all the Senators-elect voting therefor, The amendments were concurred in. A message was received from the House of Representatives re-returning A bill to amend sections 9 and 10 of chapter 5 of Act No. 283 of the Public Acts of 1909, as amended, entitled "An act to revise, consolidate and add to the laws relating to the establishment, opening, improvement, maintenance and use of the public highways and private roads, the condemnation of property and gravel therefor; the building, repairing and preservation of bridges; setting and protecting shade trees, drainage, cutting weeds and brush within this State, and providing for the election and defining the powers, duties and compensation of State, county, township and district highway officials," being sections 4386 and 4387 of the Compiled Laws of 1915. The House amended the bill as follows: (1) Amend by inserting in line 36, section 9, after the word "have," the following: "prior to April 1, 1923." (2) Amend by inserting in line 39, section 9, after the word "labor," the following: "or unless said board of county road commissioners have, prior to said date, made and filed their first order of determination and duly advertised and held their hearing of objections to the improvement of a road being built under and in compliance with the provisions of Act No. 59, Public Acts of 1915, as amended." The Senate amended House amendment No. 1 by striking out the word "April" and inserting in lieu thereof the word "June." The message informed the Senate that the House has agreed to the Senate amendment to House amendment No. 1. The bill was referred to the Secretary for enrollment printing and presentation to the Governor. A message was received from the House of Representatives transmitting A bill to amend section 2 of Act 217 of the Public Acts of 1897, entitled "An act to provide for the registration of deaths in Michigan and requiring certificates of death," the same being section 5605 of the Compiled Laws of 1915. The message informed the Senate that the House of Representatives has passed the bill. The bill was read a first and second time by its title and referred to the Committee on State Affairs. A message was received from the House of Representatives transmitting A bill to amend section 18 of Act No. 206 of the Public Acts of 1893, entitled "An act to provide for the assessment of property and the levy of taxes thereon, and for the collection of taxes heretofore and hereafter levied; making such taxes a lien on the lands taxed; establishing and continuing such lien, providing for the sale and conveyance of lands delinquent for taxes, and for the inspection and disposition of lands bid off to the State and not redeemed or purchased, and to repeal Act No. 200 of the Public Acts of 1891, and all other acts and parts of acts in anywise contravening any of the provisions of this act," the said section being Compiler's section 4012 of the Compiled Laws of Michigan of 1915. The message informed the Senate that the House of Representatives has passed the bill. The bill was read a first and second time by its title and referred to the ComImittee on Taxation. A message was received from the House of Representatives transmitting A bill to amend section 23 of Act No. 166 of the Public Acts of 1917, as amended, entitled "An act to classify all school districts, now in existence or hereafter created, which shall have a population of five hundred or more and less than seventy-five thousand as districts of the third or fourth classes; to provide for the government, control and administration of such school districts and the schools therein through boards of education; to provide for the manner of nomination and election of such boards and their powers and duties; and to repeal all general or special laws that conflict with the provisions of this act." The message informed the Senate that the House of Representatives has passed the bill. The bill was read a first and second time by its title and referred to the Committee on Education. A message was received from the House of Representatives transmitting A bill to provide for the licensing, bonding and regulation of private employment agencies, the limiting of the amount of the fee charged by such agencies, the refunding of such fees in certain cases, the imposing of obligations on persons, firms or corporations which have induced workmen to travel in the hope of securing employment, charging the Commission of Department of Labor and Industry with the enforcement of this act and empowering said Commission to make rules and regulations fixing penalties for the violation hereof, and repealing Act 301 of the Public Acts of 1913. The message informed the Senate that the House of Representatives has passed the bill. The bill was read a first and second time by its title, and referred to the Com. mittee on Labor. A message was received from the House of Representatives transmitting A bill to amend sections 2, 9, 10, 11, 15 and 35 of Act No. 285 of the Public Acts of 1909, entitled "An act to provide for the creation of a Department of Labor, to prescribe its powers and duties, to regulate the employment of labor, to make an appropriation for the maintenance of such department, and to prescribe penalties for the violation of this act," being sections 5323, 5330, 5331, 5332, 5336 and 5356 of the Compiled Laws of 1915, as last amended by Act No. 341 of the Public Acts of 1919, Act No. 280 of the Public Acts of 1917, Act No. 255 of the Public Acts of 1915 and Act No. 216 of the Public Acts of 1915. A message was received from the House of Representatives transmitting A bill to permit boards of supervisors in certain counties to create a committee to audit bills and to perform certain other duties, to be known as the finance committee of such boards; to define its powers and duties and to fix the compensation of the members thereof. |
