House joint resolution No. 16 (file No. 288), entitled

A joint resolution proposing an amendment to section 2 of article 10 of the Constitution of the State of Michigan, to limit the amount of taxes which may be levied on real and personal property, except in case of emergency.

House bill No. 508 (file No. 296), entitled

House bill No. 465 (file No. 265), entitled

A bill to amend sections 4 and 5 of chapter 6 of Act No. 203 of the Public Acts of 1917, entitled "An act to provide for the holding of elections, to prescribe the manner of conducting and to regulate elections, to prevent fraud and deception in the conducting of elections and to guard against abuses of the elective franchise," approved May 10, 1917.

The Committee of the Whole, through its Chairman, reported back to the Senate, favorably and with amendment, the following entitled bill:

House bill No. 444 (file No. 247), entitled

A bill to amend sections 2, 9, 10, 11, 15 and 35 of Act No. 285 of the Public Acts of 1909, entitled "An act to provide for the creation of a Department of Labor, to prescribe its powers and duties, to regulate the employment of labor, to make an appropriation for the maintenance of such department, and to prescribe penalties for the violation of this act," being sections 5323, 5330, 5331, 5332, 5336 and 5356 of the Compiled Laws of 1915, as last amended by Act No. 341 of the Public Acts of 1919, Act No. 280 of the Public Acts of 1917, Act No. 255 of the Public Acts of 1915 and Act No. 216 of the Public Acts of 1915. The following is the amendment recommended by the Committee of the Whole:

Section 10, line 68, after the word "working," insert "during vacation periods and".

The Senate agreed to the amendment recommended by the Committee of the Whole and the bill as amended was placed on the order of Third Reading of Bills.

The Committee of the Whole, through its Chairman, reported back to the Senate the following entitled bill, recommending that all after the enacting clause be stricken out:

House bill No. 203 (file No. 62), entitled

A bill to regulate the hours of employment of nurses in State hospitals and certain State institutions.

The recommendation of the Committee of the Whole was concurred in and all after the enacting clause was stricken out.

A bill to amend sections 3, 4 and 17 of Act No. 59 of the Public Acts of 1915, entitled, as amended, "An act to provide for the construction, improvement and maintenance of highways; for the levying, spreading and collecting of taxes and of special assessments therefor, to authorize the borrowing of money and the issuance of bonds under certain restrictions, regulations and limitations; to prescribe the powers and duties of certain officers with reference thereto; and to validate certain proceedings heretofore taken," same being sections 4673, 4674 and 4687 of the Compiled Laws of 1915, as amended.

The following is the substitute recommended by the committee:

A bill to amend Section five of Act number 59 of the Public Acts of 1915, entitled, as amended, "An act to provide for the construction, improvement and maintenance of highways; for the levying, spreading and collecting of taxes and of special assessments therefor, to authorize the borrowing of money and the issuance of bonds under certain restrictions, regulations and limitations; to prescribe the powers and duties of certain officers with reference thereto; and to validate

certain proceedings heretofore taken," being Section 4675 of the Compiled Laws of 1915, as amended, and to add a new section thereto to stand as section 82. The People of the State of Michigan enact:

Section 1. Section 5 of Act No. 59 of the Public Acts of 1915, entitled, as amended, "An act to provide for the construction, improvement and maintenance of highways, for the levying, spreading and collecting of taxes and of special assessments therefor, to authorize the borrowing of money and the issuance of bonds under certain restrictions, regulations and limitations; to prescribe the powers and duties of certain officers with reference thereto; and to validate certain proceedings heretofore taken," being section 4675 of the Compiled Laws of 1915, is hereby amended and a new section is hereby added thereto to stand as section 82 to read as follows:

Sec. 5. Improving a highway shall include (widening), grading, drainage, bridging, stoning, macadamizing, paving and making of cement, asphalt, bituminous products, or slag, gravel, or any material suitable for road purposes, or any combination of the same. Where a petition is presented for improving any highway the county road commissioners or the State. Highway Commissioner may adopt such kind of improvement as they shall deem best under the circumstances. (Sec. 82. Whenever the legislature of the State of Michigan directs or authorizes the State Highway Commissioner to lay out or establish a particular highway or to widen an existing highway or to construct an improved road over an existing highway, and in order to carry out such authority or direction it shall be necessary to enter the corporate limits of any city, such Commissioner shall have the power and authority to enter within the corporate limits of any city and carry out such authority or direction, under the provisions of this act, and such Commissioner shall have full power and authority to carry out such authority or directions under the provisions of this act without any petition therefor as fully in all respects as though a petition signed by the requisite number of persons as herein before in this act provided had been duly filed. In such case said Commis sioner shall in his first order, set forth the termini of such improvement.) WILLIAM M. CONNELLY,
