NUMBER SEVENTY-FOUR.

Senate Chamber,

Lansing, Monday, April 30, 1923. 4:00 o'clock p. m.

The Senate met pursuant to adjournment and was called to order by the President.

Religious exercises were conducted by Father John A. Gabriels of the Church of the Resurrection of Lansing.

The roll of the Senate was called by the Secretary.

Present:

Senators Atwood, Bohn, Brower, Bernie L. Case, William L. Case, Condon, Connelly, Eldred, Gansser, Glaspie, Hayes, Henry, Horton, Hunter, Leland, MacNaughton, Osborn, Pearson, Penney, Riopelle, Sligh, Smith, Truettner, Whiteley, Wilcox, Wood, Young-27; a quorum.

Absent with leave: Senator Johnson-1.

Absent without leave: Senators Bahorski, Gettel, Karcher and Ross-4.

Mr. MacNaughton moved that the absentees without leave be excused from today's session.

The motion prevailed.

Act Enrolled and Presented to Governor.

The Secretary announced the enrollment printing and presentation to the Governor on April 28, 1923, for his approval, of the following named act: Senate enrolled Act No. 54 (being Senate bill No. 42, file No. 217)—

An act to make appropriations for the Superintendent of the Capitol for the fiscal years ending June 30, 1924, and June 30, 1925, for maintenance, operation and other purposes.

Messages From the House.

A message was received from the House of Representatives re-transmitting, in accordance with the request of the Senate,

House bill No. 494 (file No. 243), entitled

A bill to amend section 19 of chapter 4 of Act No. 283 of the Public Acts of the State of Michigan for the year 1909, entitled "An act to revise, consolidate and add to the laws relating to the establishment, opening, improvement, maintenance and use of the public highways and private roads, the condemnation of property and gravel therefor; the building, repairing and preservation of bridges; setting and protecting shade trees, drainage, cutting weeds and brush within this State, and providing for the election and defining the powers, duties and compensation of State, county, township and district highway officials," being compiler's section 4365 of the Compiled Laws of the State of Michigan for the year 1915, as amended.

Mr. Connelly moved to amend the title of the bill so as to read as follows:

A bill to amend the title and section 19 of chapter 4 of Act No. 283 of the Public

Acts of the State of Michigan for the year 1909, entitled "An act to revise, consolidate and add to the laws relating to the establishment, opening, improvement, maintenance and use of the public highways and private roads, the condemnation of property and gravel therefor; the building, repairing and preservation of bridges; setting and protecting shade trees, drainage, cutting weeds and brush within this State, and providing for the election and defining the powers, duties and compensation of State, county, township and district highway officials," being compiler's section 4365 of the Compiled Laws of the State of Michigan for the year 1915, as amended.

The motion prevailed.

The Senate agreed to the title of the bill as thus amended.

A message was received from the House of Representatives returning
Senate bill No. 106 (file No. 70), entitled

A bill to amend chapter 37 of the Revised Statutes of 1846, entitled "Of the Support of Poor Persons by Their Relatives," the same being sections 5191 to 5205, inclusive, of the Compiled Laws of 1915, by adding thereto six new sections to stand as sections 16, 17, 18, 19, 20, and 21.

The message informed the Senate that the House of Representatives has passed the bill.

The bill was referred to the Secretary for enrollment printing and presentation to the Governor.

A message was received from the House of Representatives returning
Senate bill No. 157 (file No. 121), entitled

A bill to amend section 1 of Act No. 146 of the Public Acts of 1917, entitled "An act to authorize and empower boards of education in certain school districts of this State to provide for the establishment and offering of advanced courses of study to high school graduates, and to provide for the regulation thereof," approved April 25, 1917.

The message informed the Senate that the House has amended the bill as follows:

1. Amend by inserting in line 11, section 1, after the word "thereof," the following: "In any school district of more than two hundred fifty thousand people, according to the last official census of the United States Government, the board of education is authorized and empowered to provide for the establishing and offering in such school district of advanced courses for such high school graduates, which may embrace four years of collegiate work. Such courses collectively shall be known by such name as the board of education may designate." The board of education shall provide suitable instructors for any advanced courses that it is herein authorized to establish and shall adopt regulations with reference to the admission and conduct of pupils taking such courses, and the issuance of diplomas and degrees upon the completion thereof."

The message further informed the Senate that as thus amended the House has passed the bill and has ordered that the bill be known as the "Smith-Burns Bill." The question being on concurring in the amendment made to the bill by the House,

The roll was called and the Senators voted as follows:

So, a majority of all the Senators-elect voting therefor,.

The amendment was concurred in.

The Senate concurred in the order of the House that the bill be known as the "Smith-Burns Bill."

The bill was referred to the Secretary for enrollment printing and presentation to the Governor.

A message was received from the House of Representatives returning
Senate bill No. 47 (file No. 251), entitled

A bill to make appropriations for the Michigan State Sanatorium for the fiscal years ending June 30, 1924, and June 30, 1925, for maintenance, operation and other purposes.

The message informed the Senate that the House has amended the bill as follows:

1. Amend by striking out of line 3, section 1, the words "seventy-eight thousand five hundred thirty," and inserting in lieu thereof the words "seventy-one thousand three hundred eighty."

2. Amend by striking out of line 5, section 1, the words "seventy-two thousand nine," and inserting in lieu thereof the words "sixty-six thousand five."

3. Amend by striking out of line 11, section 1, the figures "3,750.00" and "3,750.00," and inserting in lieu thereof the figures "3,500.00" and "3,500.00." 4. Amend by striking out of line 12, section 1, the figures "67,250.00" and "67,250.00," and inserting in lieu thereof the figures "62,100.00" and "62,100.00." 5. Amend by striking out of line 13, section 1, the figures "71,000.00" and "71,000.00," and inserting in lieu thereof the figures "65,600.00" and "65,600.00." 6. Amend by striking out of line 20, section 1, the figures "167,305.00" and "166,805.00," and inserting in lieu thereof the figures "161,905.00" and "161,405.00." 7. Amend by striking out of line 22, section 1, the figures "11,225.00" and "6,175.00," and inserting in lieu thereof the figures "9,475.00" and "5,175.00"

8. Amend by striking out of line 23, section 1, the figures "178,530.00" and "172,980.00," and inserting in lieu thereof the figures "171,380.00" and "166,580.00." The message further informed the Senate that as thus amended the House has passed the bill and ordered that it take immediate effect.

Senate bill No. 23 (file No. 216), entitled

A bill to make appropriations for Newberry State Hospital for the fiscal years ending June 30, 1924, and June 30, 1925, for maintenance, operation and other purposes.

The message informed the Senate that the House has amended the bill as follows:

1. Amend by striking out of section 1, line 3, the words "three hundred ninetytwo thousand nine hundred sixty-seven," and inserting in lieu thereof the words "three hundred sixty-five thousand three hundred ninety-three."

2. Amend by striking out of section 1, all of lines 24, 25, 26, 27, 28, 29 and 30. 3. Amend by striking out of section 1, line 31, the amount "$392,967.00," and inserting in lieu thereof the amount "$365,393.00."

The message further informed the Senate that as thus amended the House has passed the bill and ordered that if take immediate effect.

The question being on concurring in the amendments made to the bill by the House,

A bill to make appropriations for the State Administrative Board for the fiscal years ending June 30, 1924 and June 30, 1925, for maintenance, operation and other purposes.

The message informed the Senate that the House has amended the bill as follows:

1. Amend by striking out of section 1, line 3, the words "two hundred fortyseven thousand two hundred," and inserting in lieu thereof the words "two hundred twenty-seven thousand seven hundred."

2. Amend by striking out of section 1, lines 4 and 5, the words "two hundred thirty-four thousand two hundred," and inserting in lieu thereof the words "two hundred twenty-six thousand two hundred."

3. Amend by striking out of section 1, line 14, the amount "174,600.00" and inserting in lieu thereof the amount "164,600.00."

4. Amend by striking out of section 1, line 15, the amount "$188,100.00," and inserting in lieu thereof the amount "$178,100.00."

5. Amend by striking out of section 1, line 16, the amounts "31,000.0031,000.00," and inserting in lieu thereof the amounts "25,000.00-25,000.00."

6. Amend by striking out of section 1, line 18, the amounts "7,100.00-7,100.00," and inserting in lieu thereof the amounts "6,600.00-6,600.00."

7. Amend by striking out of section 1, line 19, the amounts “6,000.00—3,000,00," and inserting in lieu thereof the amounts "3,000.00-1,500.00"

Amend by striking out of section 1, line 20, the amounts "$247,200.00— $234,200.00," and inserting in lieu thereof the amounts "$227,700.00-$226,200.00." 9. Amend by striking out of section 2, lines 2 and 3, the words "and the disbursing officer of the State Administrative Board shall render his accounts therefor."

The message further informed the Senate that as thus amended the House has passed the bill and ordered that it take immediate effect.
