A bill to repeal Act No. 164 of the Public Acts of 1893, entitled "An act to prohibit catching or taking fish in Maple River and tributary streams in any other manner than with hook and line," approved May 31st, 1893.

The question being on agreeing to the title of the bill,

Mr. Hulse moved to amend the title so as to read as follows:

A bill to authorize township boards of townships and legislative bodies

of cities to fill vacancies in the office of justice of the peace.

The motion prevailed.

The House agreed to the title of the bill as amended.

Mr. Hulse moved that the bill be ordered to take immediate effect. The motion prevailed, two-thirds of all the members-elect voting therefor.

House bill No. 67 (file No. 9), entitled

A bill to amend section 14 of chapter III of Act 314 of the Public Acts of 1915, entitled "An act to revise and consolidate the statutes relating to the organization and jurisdiction of the courts of this State; the powers and duties of such courts, and of the judges and other officers thereof; the forms of civil actions; the time within which civil actions and proceedings may be brought in said courts; pleading, evidence, practice and procedure in civil actions and proceedings in said courts; to provide remedies and penalties for the violation of certain provisions of this act; and to repeal all acts and parts of acts inconsistent with or contravening any of the provisions of this act."

Was read a third time and passed, a majority of all the members-elect voting therefor, by yeas and nays, as follows:

The House agreed to the title of the bill.

Mr. Flowers moved that the bill be ordered to take immediate effect. The motion prevailed, two-thirds of all the members-elect voting therefor.

House bill No. 59 (file 12), entitled

A bill to amend section 41 of chapter II of Act No. 314 of the Public Acts of 1915, entitled "An act to revise and consolidate the statutes relating to the organization and jurisdiction of the courts of this State; the powers and duties of such courts, and of the judges and other officers thereof; the forms of civil actions; the time within which said civil actions and proceedings may be brought in said courts; pleading, evidence, practice and procedure in civil actions, and proceedings in said courts; to provide remedies and penalties for the violation of certain provisions of this act; and to repeal all acts and parts of acts inconsistent with, or contravening any of the provisions of this act," and to add thereto a new section to be known as section 58, chapter II of said act.

Was read a third time.

The question being on its passage,

Mr. Jerome moved to amend the bill

By striking out of lines 11 and 12 of section 1 the words "and a new section is added to stand as section 58 of chapter II, said amended and said added section."

The motion prevailed and the amendment was adopted, a majority of all of the members-elect voting therefor.

Mr. Martz moved to amend the bill

By adding at the end of line 5, after the word "seventeen," the words: "Provided however, That each of said judges shall hold court from 9:30 a. m. until 12 noon, and from 1:30 p. m. until 4:30 p. m. each day, Sundays and holidays excepted, and no judge shall absent himself from

said court for vacational purposes for a greater time than fifteen days in any one calendar year."

The motion did not prevail and the amendment was not adopted, a majority of all the members-elect not voting therefor.

The bill was then passed, a majority of all the members-elect voting therefor, by yeas and nays, as follows:

MOTIONS AND RESOLUTIONS.

Mr. Daigneau offered the following resolution:

House resolution No. 24.

Whereas, The State of Michigan expends large amounts of money for

the publication of the Michigan Manual and various other books and pamphlets, and

Whereas, It is the belief of many of our citizens that much of this work could be done to advantage in some of our State penal and industrial institutions; therefore be it

Resolved, That a committee of three members be appointed to investi gate the feasibility of having a portion at least of the printing and binding for our State done by our State institutions as aforesaid and to report their findings to the House at an early date, together with such recommendations as they may deem advisable.

The resolution was adopted.

Mr. Ormsbee offered the following resolution:
House resolution No. 25.

Whereas, Death has invaded the family circle of one of our members, Representative Barney Diehl, of Macomb county, taking from him his beloved mother; therefore be it

Resolved, That the House extends its heartfelt condolences to Representative Diehl in his bereavement.

Resolved, That a copy of this resolution be spread upon the Journal of the House of Representatives.

The resolution, by a rising vote, was unanimously adopted.

Mr. Newkirk moved that the Committee of the Whole be discharged from further consideration of

House bill No. 11 (file No. 2), entitled

A bill to amend section 65 of Act No. 118 of the Public Acts of 1893. entitled "An act to revise and consolidate the laws relative to the State Prison, to the State House of Correction, and branch of the State Prison in the Upper Peninsula, and to the House of Correction and Reformatory at Ionia, and the government and discipline thereof, and to repeal all acts inconsistent therewith," being section 2144 of the Compiled Laws of 1897. And that the bill be referred to the Committee on Ways and Means. The motion prevailed.

Mr. Robinson moved to reconsider the vote by which
House bill No. 40 (file No. 3), failed to pass.

The motion prevailed.

The question being on the passage of the bill,

Mr. Wood made written request for the printing of
House bill No. 28, entitled

A bill to prohibit the unauthorized taking or using of automobiles or other motor vehicles by drivers or caretakers thereof, or by any other person or persons, whether with or without the intent to steal the same, and to provide a penalty therefor, and to repeal Act 33 of the Public Acts of 1909, entitled "An act to prohibit the unauthorized taking or using of automobiles or other motor vehicles by drivers or caretakers thereof, or by any other person or persons, without intent to steal the same, and to provide a penalty therefor."

The request was referred to the Committee on Printing.
