There shall be elected in the county of Kings auditor, an auditor, who shall hold office for the term of three election of office- sal ary of. -term of years, commencing on the first day of January next after his election, and receive an annual salary of three thousand dollars, which shall be a county charge. He shall be elected by the electors of said county upon the same ballot as State officers at the general State election. The first election for said auditor shall be at the next general election to be held in said county. In case of a vacancy in said office by the death, resignation or removal from office of said auditor, or by his omission to file the oath of office and bond hereinafter provided, or other cause, an election shall be held to fill the vacancy at the next general election thereafter, and the registrar, clerk and treasurer of said county shall appoint a proper person to perform the duties of said auditor until such general election shall be held and the person elected to fill such vacancy shall have duly qualified. The person so appointed shall be subject to the provisions of this act. The person elected as herein before provided to fill such vacancy shall hold his office three years from the first day of January succeeding his election. § 1, ch. 737, 1871, entitled" An act to provide for the election of an auditor of the county of Kings, and prescribing his powers and duties." The person elected as such auditor shall, before entering upon the duties of his office, take and subscribe removal. the constitutional oath of office, and file the same in the office of the clerk of the county of Kings, and shall give bonds to the board of supervisors of said county, with two or more sureties to be approved by the said board, or by the treasurer of said county, in such amount as they or he may determine, conditioned that such auditor shall faithfully discharge the duties of his office, and shall file such bonds, approved as aforesaid, in the clerk's office of said county. Said auditor shall be subject to removal by the governor as is provided by the laws applicable to the removal of sheriffs, which are hereby extended so as to relate to the office enacted by this act. § 2, ch. 737, 1871. Superintendent of public instruction. § 99. The office of State superintendent of public instruction is continued and the term of said office shall be three years, commencing on the day after an election thereto, and continuing until a successor shall have been duly elected. Such superintendent shall be elected by joint ballot of the senate and assembly on the first Tuesday of April, 1865, and on the first Tuesday of April next after the occurrence of any vacancy in office. § 1, tit. 1, ch. 555, 1864, entitled "An act to revise and consolidate the general acts relating to public instruction.” School commissioner. SEC. 100. The office of SCHOOL COMMISSIONER is continued, and the present incumbents shall continue in office in their respective districts for the residue of the terms for which they were elected or appointed. § 1, tit. 2, ch. 555, 1864. School commissioner district. SEC. 101. The districts, as organized under existing sioner dis- laws, and as recognized in the election of school commissioners at the annual election in eighteen hundred and sixty-three, shall continue to be held and regarded as the school commissioner districts in this State, except as the same shall be altered or modified by the legislature. § 2, tit. 2, ch. 555, 1864. The laws regulating the election of and canvassing the votes for county officers shall apply to such elections. And it shall further be the duty of the county clerks, and they are hereby required as soon as they shall have official notice of the election or appointment of a school commissioner for any district in their county, to forward to the superintendent of public instruction, a duplicate certificate of such election or appointment attested by their signature and the seal of the county. § 3, tit. 2, ch. 554, 1864, as amended by § 1, ch. 406, 1867.
