terial, supplies, salaries or other purposes whatsoever, shall be paid from said appropriations that shall not have accrued within the respective fiscal years for which said appropriations are made available and the fact that material or supplies are on hand or in use at the beginning of a fiscal year subsequent to their purchase shall not be sufficient authority for the payment thereof out of an appropriation made and available for such subsequent fiscal year, and in the event of the issue by the Auditor of any warrant in violation of the provisions of this section, or in excess of the amounts appropriated and made available in section 1, hereof, the same shall not be a charge against the State but shall be a charge against the auditor and his bondsmen. CHAPTER 101.

APPROPRIATION-NEW COLLEGE LAND FUNDS.

AN ACT making an appropriation from the new college funds for the support and maintenance of certain educational institutions.

Be It Enacted By the People of the State of Oklahoma:

New College Funds-Apportionment.

Section 1. In pursuance of its divisions and distribution of the New College Funds provided for in section 7225, Revised Laws 1910, there is hereby appropriated for the respective institutions, hereinafter named, out of the New College Funds, that is, funds collected from the income, interest, rentals and proceeds of New College Lands, the following amounts for the respective fiscal years named, to-wit:

For the support and maintenance of the University of Oklahoma, Norman,

Auditor to Issue Warrants-Restrictions and Liability.

Section 2. The State Auditor is hereby empowered and authorized to issue his warrant upon the State Treasurer for such portion of the appropriations made in Section 1, hereof, as he may find to be due upon the auditing of the respective claims in favor of the persons to which such claims are allowed; provided, that all claims and accounts against the State shall be itemized and shall show upon their face the fiscal year within which the same shall have accrued and shall be sworn to as being true and

correct and shall bear the approval of the proper authority having control of each of such institutions before being audited. CHAPTER 102.

OFFICERS ATTORNEY GENERAL-ASSISTANTS DUTIES.

AN ACT to amend chapter 232, of the Session Laws of Oklahoma, 1913, entitled, "An act authorizing the Attorney General to employ legal and stenographic assistance in the office of the Attorney General, fixing and providing for the compensation of such assistance; and making an appropriation therefor," and declaring an emergency.

Be It Enacted By the People of the State of Oklahoma: Assistants-Salaries.

Section 1. That section 1 of chapter 232, of the Session Laws of Oklahoma, 1913, be and the same is hereby amended to read as follows:

"Section 1. The positions of Assistant Attorneys General hereinafter named, are hereby created and established, and the salary and compensation of each shall be as herein named, payable monthly.

First Assistant Attorney General, salary per annum.
Second Assistant Attorney General, salary per annum..
Third Assistant Attorney General, salary per annum.
Fourth Assistant Attorney General, salary per annum.
Fifth Assistant Attorney General, salary per annum..
Sixth Assistant Attorney General, salary per annum.

Section 2. The positions of stenographers as hereinafter named are hereby created and established and the salary and remuneration of each shall be as herein, named, payable monthly:

Appointment-Governor's Consent-Attorney to Banking Board.

Section 3. The sixth Assistant Attorney General shall be appointed by the Attorney General with the approval or consent of the Governor, to be expressed by him in writing and filed in the office of the Secretary of State, and shall be assigned by the Attorney General to the Banking Department of the State and be counsel and legal advisor of the Bank Commissioner, Banking Board and said Department under the Attorney General, and it shall be his duty under the directions of the Attorney General to advise and bring all actions in the name of the State or otherwise by the Attorney General in behalf of the Banking Board; and to collect and realize on all assets of banks, in process of liquidation, or assets that have been acquired by said Banking Board in trust for the guaranty fund, and to perform such other duties as may be required by the Attorney General, Governor, or Banking Department.

Disposition of Assets of Liquidating Banks.

Section 4. In collecting said assets, wherever the obligation provides for an attorney's fee, the same shall be collected and not become a part of the trust fund, but be constituted as fees and be collected as such and become a part of the revenue of the State and converted monthly by the Bank Commissioner into the State Treasury as a part of the general revenue fund.

Receivers-Attorney General To Advise-Fees.

Section 5. Wherever State Banks are placed in the hands of a receiver, it shall be the duty of the court making the order appointing a receiver, to also make an order appointing the Attorney General as attorney for said receiver, and to allow a reasonable fee for such services; and such fee shall be paid over to the Bank Commissioner, and by him at the end of the month, converted into the State Treasury as a part of the general revenue fund.

Violation of Banking Laws-Attorney General to Prosecute.

Section 6. It shall be the duty of the Attorney General or any assistant assigned by the Attorney General, to appear in the District Court and assist in the prosecution of all persons charged with the violation of the banking laws of the State, and when directed by the Attorney General or the Governor, he, or the Assistant so directed, may supersede the County Attorney and take active charge of such prosecution either in the District Court or in the examination of such matters before the grand jury. Attorney To School Land Department-Appointment-Duties.

Section 7. The Seventh Assistant Attorney General shall be appointed by the Attorney General, with the consent or approval of the Governor, which shall be expressed in writing and be filed with the Secretary of State; and said assistant Attorney General, or any assistant directed by the Attorney General, shall be assigned by the Attorney General to the School Land Department; and under direction of the Attorney General, be its legal advisor, not only in the
