CHAPTER 204.

APPROPRIATION-SCHOOL FOR DEAF.

AN ACT making an appropriation for immediate sleeping quarters and maintenance and support of the Deaf School of Sulphur Oklahoma and declaring an emergency.

Be It Enacted By The People Of The State Of Oklahoma. Appropriation.

Section 1. There is hereby appropriated out of any money in the State Treasury not otherwise appropriated, the sum of four thousand five hundred sixty-nme dollars and seventeen cents ($4,569.17), or so much thereof as may be necessary, said amount being itemized as follows:

For the purpose of equipping immediate sleeping quarters...$3,000.00
For maintenance and support..

Emergency.

-$1,569.00

Section 2. For the preservation of the public peace, health and safety, an emergency is hereby declared to exist by reason whereof it is necessary that this act take effect and be in force from and after its passage and approval.

CHAPTER 205.

BENEFICIARY SOCIETIES AND ASSOCIATIONS.

AN ACT amending section 3486 of Revised Laws of Oklahoma of 1910, relative to fraternal beneficiary associations and declaring an emergency.

Be It Enacted By The People Of The State Of Oklahoma.

Regulations and Description.

Section 1. That Section 3486 of Revised Laws of Oklahoma of 1910 is hereby amended to read as follows:

"Section 3486. A fraternal beneficiary association is a corporation, society or voluntary association formed or organized and carried on for the benefit of its members and their beneficiaries and not for profit. Each association shall have a lodge system, with ritualistic form of work and representative form of government, and shall make provision for the payment of benefits in case of death and may make provision for the payments of benefits in case of sickness temporary or permanent physical disability, either as a result ofdisease, accident or old age, provided, the period of life at which the payment of physical disability benefits on account ofold age commenced, shall not be under seventy (70) years, all subject to compliance of its members with its constitution and by-laws. Any such association may also make provision for the payment of benefits in case of death, sickness and physical disability or either of minor children, of such of its members, or such other minor children, who desire to avail themselves of such benefits, and may also make provision for the payment of educational and industrial benefits or aids for minor children of such of its members or such other minor children who desire to avail themselves of such benefits, all subject to the regulations, rules, terms and conditions prescribed by the constitution and by-laws of the association. The funds from which the expenses, benefits, aids and other charges of such association shall be defrayed shall be derived from assessments and dues collected from its members. Benefits in case of death of members shall be paid to the families,

heirs, blood relatives, affianced husband or wife or to the person dependent upon the member or be used for the payment of the last sickness and funeral expenses of the members all in accordance with the constitution and by-laws of the association. All other benefits, aids and reliefs shall be paid as authorized or directed by the constitution and by-laws of the association. Any such association may create, maintain disburse and apply reserve or emergency funds in accordance with its constitution and by laws. The term "Fraternal beneficiary association" wherever used in any law of this state shall be construed to mean an association such as is defined by this section. Such association shall be governed by this article (article III of chapter 38 Revised Laws of Oklahoma of 1910) and shall be exempt from the provisions of the Insurance laws of this state except as provided in this article and no law shall apply to them unless they be expressly designated therein."

Emergency.

Section 2. That an emergency is hereby declared to exist by reason whereof it is necessary for the immediate preservation of the public peace, health and safety that this act take effect from and after its passage and approval.

CHAPTER 206.

ASSIGNMENT-BOND.

AN ACT to amend section 227 of chapter 4, Revised Laws of Oklahoma, 1910, and declaring an emergency.

Be It Enacted By The People Of The State Of Oklahoma.

Assignees Bond.

Section 1. That section 227 of chapter 4 of the Revised Laws of Oklahoma, 1910, be and the same is hereby amended to read as follows:

"Within thirty days after the date of an assignment for the benefit of creditors the assignee must enter into a bond to the State, with sufficient sureties, the amount of said bond to be named and approved by the Judge of the district court of the county in which the original inventory is filed, and conditioned for the faithful discharge of the trust, and due accounting for all moneys received by the assignee, which bond must be filed in the same office with the original inventory."

Emergency.

Section 2. For the preservation of the public peace, health and safety, an emergency is hereby declared to exist, by reason whereof this act take effect and be in force from and after its passage and approval.

CHAPTER 207.

APPROPRIATION-DEFICIENCIES.

AN ACT making an appropriation to pay the claim of Shrader and Sanders, contractors, for amounts due for building Haskell District Agricultural School, at Broken Arrow, Oklahoma, and to pay rents for quarters occupied by State officers and departments, and declaring an emergency.

Be It Enacted By The People Of The State Of Oklahoma.

Appropriation-Haskell School.

Section 1. The following sums of money are hereby appropriated out of any money in the State Treasury, not otherwise appropriated, thirteen hundred and eighty dollars ($1.380.00) or so much thereof as may be necessary to pay the claim of Shrader and Sanders, contractors, for building the Haskell District Agricultural School at Broken Arrow, Oklahoma.

For material and labor performed by Shrader and Sanders 1380.00.

Payments.

Section 2. The amount herein appropriated shall be approved by the head of the department and institution, the president of the Board of Agriculture and the Governor of the State of Oklahoma, before being audited by the State Auditor. For the payment of this claim the State Auditor is hereby authorized to draw his warrant upon the State Treasurer in favor of the parties named in this act for the amount set opposite their names upon sworn vouchers therefor; provided, that the amount herein appropriated shall be in full payment of said claim or claims owing by the state to persons in whose favor said appropriation is made, their heirs, and assigns and the said auditor shall not deliver any warrants until an affidavit and a receipt in full is filed in his office by the beneficiary. Provided, that said affidavit shall state that the services were rendered and materials furnished the state in the amount of said claim, and that no part of said amount thus due has been received by the affiant, his agent or representative and that
