judgment of the court to which such appeal is taken is against the appellant, judgment shall, at the same time it is entered against the appellant, be entered against the sureties on his said undertaking to stay execution, and execution shall issue thereon against said sureties the same as against their principal, the appellant, and no stay of such execution shall be permitted."

Emergency.

Section 2. It being immediately necessary for the preservation of the public peace, health and safety, an emergency is hereby declared to exist, by reason whereof this act shall take effect and be in full force from and after its passage and approval.

CHAPTER 250.

SCHOOLS AND SCHOOL DISTRICTS-STATE FUNDS APPORMENT TO COUNTIES AND DISTRICTS.

AN ACT to amend section 5, article 2, chapter 219, of the Session Laws of 1913, relating to apportionment of school funds.

Be It Enacted By the People of the State of Oklahoma:

How Apportioned.

Section 1. An act to amend section 5, article 2, chapter 219, of the Session Laws of 1913, so as to hereafter read as follows:

"Section 5.

Within five days after receiving the certificate of the State Superintendent of Public Instruction

informing him of the amount of state school fund which has been apportioned to his county, such county superintendent shall apportion the same, together with the unapportioned county school fund in the county treasury, among the school districts and parts of districts in such county in the ratio of the number of persons of school age who are entitled to receive the same, residing in each district, or part of district, as shown by the last annual report of the several clerks of such district and parts of districts; provided, that no district in which a common school has not been taught for at least three months within the last two preceding school years, shall be entitled to receive any portion of said funds, and he shall draw his order on the county treasurer in favor of each of the several school districts for the amount apportioned to such district."

CHAPTER 251.

APPROPRIATION-WALL ABOUT GRANITE REFORMATORY.

AN ACT making an appropriation for the purpose of purchasing materials for the construction and erection of a wall around and enclosing the building of the Oklahoma State Reformatory, located at Granite, Oklahoma, out of any moneys not otherwise appropriated.

Be It Enacted By the People of the State of Oklahoma:

Appropriation for Materials.

Section 1. There is hereby appropriated out of the general revenue fund of the State of Oklahoma, not otherwise appropriated, for the purpose of purchasing materials for the construction and erection of a wall around and

enclosing the buildings of the Oklahoma State Reformatory, located at Granite, Oklahoma, the sum of $15,000.00. Approved March 30, 1915.

CHAPTER 252.

STATE INSTITUTION-TRAINING SCHOOL FOR NEGROES-AP

PROPRIATION.

AN ACT creating a state training school for delinquent negro boys, locating same and providing for its management and control, and making an appropriation therefor.

Be It Enacted By the People of the State of Oklahoma:

Negro Training School Location.

Section.1. There is hereby established a State Training School for delinquent negro boys, to be located on the lands belonging to the state in Pittsburg county, near McAlester, on which the State Penitentiary is located.

Board of Affairs to Control.

Section 2. Said training school shall be under the supervision and control of the State Board of Public Affairs, and said Board may employ all the instructors, teachers, guards, or employees that may be required for said institution.

Government.

Section 3. Said training school shall be governed in all respects by the provisions of article 7, chapter 68, Revised Laws of Oklahoma, 1910, so far as applicable and not repugnant hereto.

Inmates Separate from Convicts.

Section 4. The inmates of such training school shall not be confined in the penitentiary or required to work or

associate with the convicts confined in the State Penitentiary, but shall be kept and maintained separate from such convicts.

When Operative.

Section 5. As soon as the said Board has made suitable provisions for the custody of the boys eligible for admission thereto, such. Board shall arrange for the transportation, receiving and support of such boys, and give notice to the public thereof.

Appropriation.

Section 6. There is hereby appropriated out of the general revenue funds of this state, not otherwise appropriated, the sum of ten thousand ($10,000.00) dollars for the purpose of erecting and furnishing buildings, for said training school and equipping said institution that the said school may properly and efficiently perform its functions. Approved March 30, 1915.

CHAPTER 253.

COMMISSIONERS OF LAND OFFICE OFFICES AND SALARIES.

AN ACT amending sections 7226, 7237, 7238 and 7239, of the Revised Laws of Oklahoma, 1910, relating to employees of the Commissioners of the Land Office, fixing their compensation and providing for the payment thereof.

Be It Enacted By The People Of The State Of Oklahoma :

Offices and Salaries in State Land Department.

Section 1. That section 7236, be and the same is hereby amended to read as follows:

"Section 7236. The Commissioners of the land office of the State of Oklahoma are hereby authorized and em

powered, for the purpose of providing the necessary help and assistance in managing, loaning, investing, re-investing and depositing the permanent common school fund as by the Constitution and laws of this state directed, and in the managing, leasing and selling of the state and school lands belonging to this state as by law provided, to hire and employ the following executive, clerical and stenographic assistance, and the salary and compensation of such offices, to be paid to such executive, clerical and stenographic assistance as may be employed as herein provided, shall be the amount following the name of each office herein created and provided for.

One Secretary to the Commissioners of the Land Office of the State of Oklahoma, who shall be paid for his services in the loaning, investing, re-investing and depositing of the permanent common school fund and the selling and leasing of the state and school lands, a salary of two thousand five hundred dollars per annum, and no more. The said secretary shall, before entering upon the performance of his duties, make and deliver to the Commissioners of the Land Office a good and sufficient surety company bond, payable to the State of Oklahoma, to be approved by said Commissioners, in the sum of two hundred thousand dollars conditioned upon the faithful performance of his duties, and that he will account and pay over to the proper authorities all moneys of every kind coming into his hands or into his charge as such; provided that all other employees, clerks and assistants who are employed by the Commissioners of the Land Office, shall be required to make and execute to the State of Oklahoma, to be approved by the said Commissioners, a surety company bond in such amounts as the Commissioners may determine, conditioned that they will faithfully perform the duties of their trust, and render true and correct account for all moneys which may come into their hands; provided further, that the premium on all of said bonds shall be paid for by the State out of its general funds.
