Annoyance occasioned to the Public or to Individuals, it shall be necessary to adduce Evidence to the Satisfaction of the Magistrate other than that of the Police or Constable by whom any Person shall be apprehended of such Annoyance having been occasioned.

3. Whenever any Person charged with any Offence not amounting 5 to Felony, or to an aggravated or indecent Assault, and for which such Person is liable to be summarily convicted as herein-before mentioned, shall be in the Custody of any Police Constable in posit as Se- charge of any Station House, without the Warrant of any Justice curity for a or Magistrate, it shall be lawful for such Constable at any 10 Person's Appearance Time when such Person so charged cannot immediately be taken before a Justice or Magistrate, in addition to such Person's own Recognizance, and with or without any Bail, to take a Deposit of such Sum of Money as he shall deem reasonable as Security for such Person's Appearance to answer such Charge, and such Deposit shall 15 be returned to such Person on his or her so appearing; but in case such Person shall not so appear, the Money deposited shall be forfeited, and be applied in the same Manner as any Penalty recovered from any Person summarily convicted, and the Constable shall enter in some Book to be kept for that Purpose at every such Station House 20 the Amount of any Sum tendered as a Deposit, and whether the same has been accepted or refused.

4. Whenever any Bail shall be offered to such Constable for the Appearance of any Person to answer any Charge for any Offence punishable as herein-before mentioned, and not amounting to Felony, 25 or an aggravated or indecent Assault, and such Constable shall offered, with refuse to accept such Bail, such Constable shall enter in a Book, to his Reasons be kept for that Purpose at each such Station House, the Name, Residence, and Occupation of the Person or Persons so offered, and the Reasons for which such Constable refuses to accept such Bail; 30 and the Officer on Duty at every Station House when Persons shall be brought under any Charge shall be required to afford all reasonable Facilities to the Person so charged for Communication with his Friends with a view to obtaining Bail, and a Tariff of Charges for Messages for such or other like Purposes shall be exhibited in some conspicuous 35 Place in every Station House.
