The provisions of section 111, title 18, United 4 States Code, shall apply to officers, agents, and employees 5 of the Commission in the performance of their official duties. 7 SEC. 15. If any provision of this Act or the application 8 of such provision to any person or circumstance shall be 9 held invalid, the remainder of this Act or the application of 10 such provision to persons or circumstances other than those to which it is held invalid shall not be affected thereby. 11 14 15 EFFECTIVE DATE SEC. 16. There is hereby established a Commission to 5 be known as the Commission on Equal Employment Oppor6 tunity (hereafter in this Act referred to as the "Commis7 sion"). MEMBERSHIP SEC. 102. The Commission shall be composed of— (1) the Vice President of the United States, who shall serve as Chairman; (2) the Secretary of Labor, who shall serve as Vice Chairman; and (3) not to exceed nine additional members who shall be appointed by, and serve at the pleasure of, the President. 17 Not less than one-half of the members appointed under para 18 graph (3) shall be appointed from private life. 19 20 222 ORGANIZATION SEC. 103. (a) The Chairman shall preside at meetings 21 of the Commission. The Vice Chairman shall have general 22 supervision and direction of the work of the Commission and 23 of the execution and implementation of the policies adopted 3 1 by the Commission and of its orders and recommendations. 2 made pursuant thereto. 3 (b) A quorum of the Commission shall consist of a 4 majority of the members serving at any time. 5 (c) The Commission shall meet upon the call of the 6 Chairman and at such other times as may be provided by 7 its rules and regulations. 10 8 (d) The Commission shall adopt such rules and regula9 tions as it determines necessary to govern its proceedings. (e) Each member of the Commission who is an officer or employee of the Government in addition to serving as a 12 member of the Commission shall serve without additional 13 11 compensation. Each member of the Commission appointed 14 from private life shall receive $75 a day when engaged in 15 the performance of his duties as a member of the Commis16 sion. Each member of the Commission shall be reimbursed 17 for travel, subsistence, and other necessary expenses incurred 18 by him in the performance of his duties as a member of the 20 Commission. (f) Service of an individual as a member of the Com 21 mission shall not be considered as service bringing such indi22 vidual within the provisions of sections 281, 283, 284, 434, 1 4 or 1914 of title 18 of the United States Code, or section 2 190 of the Revised Statutes (5 U.S.C. 99). GENERAL DUTIES SEC. 104. It shall be the duty of the Commission (1) to encourage and enforce a policy of equal opportunity for employment in the civilian service of the Government and of equal opportunity for service in the Armed Forces of the United States, including all re serve components thereof; of equal opportunity for employment under Government contracts; and of equal opportunity for employment in programs supported or in facilities constructed, in whole or in part, by grants in-aid made by the Government; (2) to encourage and enforce a policy of equal opportunity in the availability of, and the administration of, all training programs and recruitment and placement services provided by the Government or provided with funds or services furnished, in whole or in part, by the Government; (3) to encourage and enforce a policy of equal opportunity for membership in, and participation in the activities of, labor organizations, insofar as such member ship or participation affects equal opportunity for employment, and terms and conditions of employment with |
