perintendent shall cause to be submitted to the finance officer making payment a time and attendance report covering the services rendered during that period.

(15) Leave. Insert the following clause, omitting subparagraph (b) if the clause entitled "Compensation and Billing" (see paragraph (a)(14) of this section) is used in the contract

LEAVE (JULY 1971)

(a) Annual leave. The contractor shall be granted leave with pay on all legal holidays and regular school vacation periods.

(b) Leave without pay. The contractor I shall be in a leave without pay status between the period for which services are not required and the expiration date of this contract. Such nonpay period is creditable for Civil Service retirement purposes to the extent provided in paragraph S3-4a, FPM Supplement 831-1.

(c) Sick leave. The contractor shall be granted sick leave with pay not to exceed

days per school year. If required by the principal, the contractor shall furnish a doctor's certificate when sick for three or more consecutive school days. Unused sick leave shall not be used as a basis for claiming additional compensation. Sick leave accural is at the rate of days per school

year. The contractor shall be permitted to take sick leave with pay not to exceed the number of days to be accrued in this contract. The contractor may not accumulate more than days sick leave.

RATE OF PAY (JULY 1971)

The rate of pay as shown herein has been certified by the (insert name of installation and title of the appropriate dependents' school official) as fair and equitable and in general accord with the pay schedules for similar positions in selected comparable public school systems in surrounding localities. However, the right is reserved by the (insert title of appropriate dependents' school official and name of installation) to amend the rate of pay, either by increases or decreases, to include retroactive adjustments if pay schedules in selected comparable public school systems are changed, or if verification or certification requirements cause rate of pay changes, or if existing pay schedules for Department of the Army civilian employees performing similar duties on the same installation are changed.

(17) Applicable funds. Insert the following clause

APPLICABLE FUNDS (JULY 1971)

Army funds to cover the services contemplated by this contract are made available on a quarterly reimbursable basis by the U.S. Department of Health, Education, and Welfare. The contract shall not be binding upon either party during any period for which adequate funds are not made available. It shall be the responsibility of the (insert name of installation and title of the appropriate Federal official) to determine in each instance that funds are available prior to making any call upon the contractor for performance of any part of the services covered herein.

(18) Retirement. Insert the following clause

RETIREMENT (JULY 1971)

This contract is subject to the provisions of retirement as set forth in the appropriate Civil Service regulations. Deductions for the contractor's contribution shall be made by the finance and accounting officer from payments due the contractor. Deductions for the Government's contribution shall be made from funds set aside for that purpose. (19) Group life insurance. Insert the following clause

GROUP LIFE INSURANCE (JULY 1971) The effective date of coverage shall be the first day of employment. The provisions of CPR 870-1 and Chapter 13, AR 37-105, shall apply to deductions and agency contributions.

(20) Health benefits. Insert the following clause

HEALTH BENEFITS (JULY 1971)

The effective date of coverage shall be the first day of the first pay period after the registration form is received by the employing office which follows a period in which the employee was in a pay status.

(21) Compliance with public school laws. Insert the following clause

COMPLIANCE WITH PUBLIC SCHOOL LAWS
(JULY 1971)

In the performance of his services the contractor agrees that the grade level of instructions, the subjects to be taught, the number of teaching periods per day, and the number of teaching days per week and per month shall be in accordance with the Public School Laws of the State of (insert

name of State in which the military installation is located).

(22) Proper conduct. Insert the following clause

PROPER CONDUCT (JULY 1971)

The Government shall require the contractor to abide by the rules and regulations of the post dependents school board. The Government, when so recommended by the duly appointed school board for just cause, shall terminate this contract for failure of the contractor to comply with said rules and regulations, failure to meet physical qualification standards, or for reasons of inefficiency, or repeated misconduct on the part of the contractor, by giving 15 days notice in writing; except in the case of failure to meet physical qualification standards, this contract may be terminated upon notification. Prior to termination for failure to comply with the aforementioned rules and regulations, inefficiency, or repeated misconduct, a detailed report concerning the violations shall be furnished the contracting officer with a request that the contract be terminated. The contracting officer shall submit all requests for termination based upon alleged improper performance or conduct by the contractor, through the commanding officer of the installation concerned, prior to notifying the contractor.

(23) Security check. Insert the following clause

SECURITY CHECK (JULY 1971)

The contractor consents to a security check of his person as may be required by the U.S. Government authorities of any other civilian employee within a military reservation, and further agrees to furnish such background information as may be requested, in the manner and form requested, in order to accomplish such security check. (24) Physical examination. Insert the following clause

PHYSICAL EXAMINATION (JULY 1971)

The contractor shall present to the school officer, prior to performance under this contract, a certificate of medical examination obtained within the preceding 30 days. The examination will be made by a duly licensed physician at the contractor's expense or at the (specify name and location of Army hospital or dispensary) at no expense to the contractor. The medical certificate must indicate that the contractor is free from any communicable diseases, has no physical defects which would prevent him from performance of duty under this contract, and does not suffer from any condition that would be detrimental to the health and wel

fare of his associates. Failure to meet the required health standards shall be grounds for termination of this contract under terms of the clause entitled "Proper Conduct."

(25) Teaching certificate. Insert the following clause

TEACHING CERTIFICATE (JULY 1971)

The contractor represents that he holds a valid teaching certificate currently in full force and effect for the State of (insert name of State in which the military installation is located) which was issued by competent authority. (In the case of section 6 Schools in Puerto Rico, the contractor must hold valid certificate from any of the 50 States.) The contractor will exhibit the said teaching certificate to the principal or superintendent of the school upon request. Failure on the part of the contractor to procure and exhibit said teaching certificate shall render this contract invalid.

(26) Option to extend the term of the contract. Insert clause in § 1.1506(d) of this title.

(b) For contracts with employees whose services are required on a 12month basis, include all the clauses prescribed in paragraph (a) of this section except the clause entitled "Leave," for which the following clause shall be substituted

LEAVE (JULY 1971)

The Contractor shall accrue and be granted annual and sick leave in accordance with the Annual and Sick Leave Act of 1951, as amended, 5 U.S.C. 2061, and the applicable civilian personnel regulations.

(c) For contracts with substitute teachers, include all the clauses prescribed in paragraph (a) of this section, except the clauses entitled "Statement of Services," "Contract Period," and "Compensation and Billing," for which the following clauses shall be substituted

(1) STATEMENT OF SERVICES (JULY 1971) The contractor shall teach (elementary) (secondary) school at the (insert name of installation) on regular school days at such hours and on such days as the school principal shall designate during the period of performance on this contract as set forth in the clause entitled "Contract Period." It is understood and agreed that this is a call contract, that the contractor is a substitute teacher to perform services in the absence of a regularly employed teacher, and that

(3) COMPENSATION (JULY 1971)

The Government shall pay the contractor upon satisfactory performance of the services described in the clause entitled "Statement of Services" the sum of $for each day worked. Payment shall be made monthly. Deductions for Federal income tax and social security contributions shall be made from payments. Where withholding of payments for purposes of State income taxes is authorized by 5 United States Code 84b, deductions for State income taxes will also be made. The contractor shall furnish the finance officer making payments on this contract appropriate withholding certificates, e.g. IRS Form W-4.

(1) Reviewing and processing all requests for BSP;

(2) Performing direct procurement of BSP in accordance with procedures established by the Department of Defense; and

(3) Programing and budgeting for procurement of BSP.

(b) Heads of Procuring Activities are responsible for insuring that applicable BSP are included in contracts for new communications equipment and facilities procured from WECO as items to be purchased from the contractor.

§ 594.5704 Procedures.

§ 594.5704-1 Ordering BSP for existing communications equipment and facili

ties.

(a) All orders for BSP shall be submitted by letter request to the Commanding General, U.S. Army Communications-Electronics Engineering Installation Agency [USA CEEIA], Attention: SCCC-LOG-RC, Fort Hua chuca, Ariz. 85613, with information copy to the Commanding General, U.S. Army Strategic Communications Command, Attention: SCC-LOG-S, Fort Huachuca, Ariz. 85613.

(b) Letter requests shall include(1) A listing of the BSP required; (2) Quantities required;

(3) Shipping and mailing address; and

(4) Justification for the need for the BSP and identification of the types of equipment or facilities or other information which support the need.

(c) Individual BSP or complete divisions may be ordered. A division is a broad grouping of individual BSP by types of systems, equipments, or major categories of information. For individual BSP, the complete number shall be listed. When ordering complete divisions, the applicable division number shall be listed followed by the notation "Complete Division."

(d) When processing orders for BSP from the Army, A.T. & T. follows a back order procedure in that if a particular BSP is not available at the time of the order, it will be back ordered for later shipment. Any BSP requested

but not received need not be reordered by the requesting agency.

(e) The requesting agency shall acknowledge to the addressee in paragraph (a) of this section receipt of all BSP ordered.

§ 594.5704-2 Ordering new communications equipment and facilities from WECO.

(a) Applicable BSP shall be individually identified in the equipment procurement contract as items to be purchased from the contractor.

(b) In addition to any other clause pertaining to data prescribed in Subchapter A of this title, the following clause shall be included in all contracts for the purchase of BSP

BELL SYSTEM PRACTICES (BSP) (DEC. 1971) (a) Notwithstanding any other provisions of this contract relating to technical data, the Government's rights with respect to any BSP specified to be delivered under this contract, which BSP bears the following legend, shall be limited to those rights stated in the legend:

"This Bell System Practice is furnished for use only for Department of Defense or Coast Guard purposes in the interest of national defense. It will not be sold or disposed of to other Government agencies or to anyone outside the Government. The contents thereof will not be reproducible in whole or in part except for such purposes and upon such terms and conditions as may be agreed to in writing by the American Telephone and Telegraph Co. Nothing contained herein shall imply or grant a license to the Government under any patent or be construed as affecting the scope of any license or other right otherwise granted to the Government under any patent."

(b) No limitation on rights of use shall be asserted as to any data which the Contractor has previously delivered to the Government without restriction. The limited rights provided for by this clause shall not impair the right of the Government to use similar or identical data not originated by the Bell System.

(c) The BSP called for herein are primarily issued, replaced, or revised, as circumstances warrant, for the use of Bell System personnel. No guarantee can be made that all of such BSP will be available, either as such or as a reissue or replacement, at the time delivery is required hereunder and the Contractor assumes no liability in the event of failure to deliver, except as to an equipment adjustment in price if warranted. The immediately preceding sentence of this clause shall not be applicable to BSP called

§ 595.102-2 Exceptions to mandatory use. When a contracting officer in accordance with § 5.102-2(b)(1) of this title has requested the Commissioner, Federal Supply Service, General Services Administration, to waive the requirement for using a Federal Supply Schedule item and the waiver is not granted, the case shall be referred to the cognizant head of procuring activity for final decision.

§ 595.102-4 Establishment or revision of Federal Supply Schedules mandatory upon the Department of Defense. Requests for the establishment of or a change to a Federal Supply Schedule mandatory upon elements of the Department of Defense shall be forwarded through the cognizant head of procuring activity to the addressee in § 591.150(b)(11) of this chapter and shall contain complete item identification including FSN if available, item use, and full justification for the action recommended. The head of procuring activity shall include its recommendations in the matter.

§§ 595.103-595.105 [Reserved]

§ 595.106 Federal Supply Schedules with multiple source provisions.

(a) The justification memorandum required by § 5.106(a) of this title shall be prepared and signed by the activity initiating the purchase request and shall be reviewed and approved by the chief of the purchasing office before an order is placed.

(b) Procurement of articles of foreign origin from Federal Supply Schedules shall be made only after the determinations required by Part 6 of this title and Part 596 of this chapter have been made or obtained from the appropriate approving authority.

Subpart B-Procurement of Supplies

From General Services Administration Stores Depots and of Services for Repair and Refinishing From General Services Administration Sources

§ 595.201

Procurement from General Services Administration Stores Depots. AR 725-50 authorizes accountable property officers and other individuals identified therein to order supplies from General Services Administration Stores Depots using MILSTRIP procedures (see § 591.453 of this chapter). Subpart F-Procurement of Printing and Related Supplies

§ 595.601 Printing and related supplies. (a) AR 310-1 contains instructions which contracting officers shall follow pertaining to

(1) Public printing and duplicating, including contract field printing;

(2) Preparation of the Annual Contract Printing Report (JCP Form 2), Reports Control Symbol JCP-1003; and

(3) The procurement of envelopes.

(b) AR 341-10 contains procedures for the procurement, control, and use of matter bearing the official indicia "Postage and Fees Paid, Department of the Army."

(c) Blank paper, ink, glues, and other related supplies manufactured or regularly carried in stock by the Government Printing Office (GPO) and which are used within the District of Columbia, shall be purchased from that office. Purchases of these items for field use may be made otherwise if they can be procured cheaper for delivery in the field than from the GPO, taking into consideration the cost of packing and transportation. Paragraph 11, section II, AR 37-27, contains instructions relative to purchases of Government publications from the GPO.
