AN ACT to amend section one of chapter four of act number two hundred eighty-three of the Public Acts of nineteen hundred nine, as amended, entitled "An act to revise, consolidate and add to the law, relating to the establishment, opening, improvement, maintenance and use of the public highways and private roads, the condemnation of property and gravel therefor; the building, repairing and preservation of bridges; setting and protecting shade trees, drainage, cutting weeds and brush within this state, and providing for the election and defining the powers, duties and compensation of state, county, township and district highway officials," the same being section four thousand three hundred forty-seven of the Compiled Laws of nineteen hundred fifteen.

The People of the State of Michigan enact:

SECTION 1. Section one of chapter four of act number two hundred eighty-three of the Public Acts of nineteen hundred nine, as amended, entitled "An act to revise, consolidate and add to the laws relating to the establishment, opening, improvement, maintenance and use of the public highways and private roads, the condemnation of property and gravel therefor; the building, repairing and preservation of bridges; setting and protecting shade trees, drainage, cutting weeds and brush within this state, and providing for the election and defining the powers, duties and compensation of state, county, township and district highway officials," the same being section four thousand three hundred forty-seven of the Compiled Laws of nineteen hundred fifteen, is hereby amended to read. as follows:

CHAPTER IV.

SECTION 1. On petition of not less than ten per centum of the resident freeholders residing in each of the several organized townships, incorporated villages and cities, of any county, as shown by the tax roll of the preceding year, or upon a majority vote of the members of the board of supervisors, the board of supervisors of such county may submit the question of adopting the county road system to a vote of the electors of such county. The said board of supervisors may submit the question at a general or special election called for that purpose. The following form of resolution shall be sufficient for submitting the question, viz.: Resolved, That the question of adopting the county road system be submitted to a vote of the electors of the county of at (the general or special election) to be held on the day of ... nineteen hundred

AN ACT to provide for the public safety; to establish the State Department of Public Safety, and the manner of or ganizing the same; to transfer thereto the offices, duties and powers of the State Fire Marshal, the State Oil Inspector, the Department of the Michigan State Police, and certain powers and duties of the Commissioner of the Food and Drug Department; to create the office of Commissioner and Deputy Commissioner of the Department of Public Safety, to prescribe their powers, duties and compensation; and making an appropriation for certain purposes of this

act.

SECTION 1. There is hereby created a department of the Department state government which shall be known and designated in safety. law as the Department of Public Safety which shall consist of a Commissioner as its executive head and of such officers and employees as may be appointed or employed in such department. The Commissioner shall be appointed by the Governor Commisby and with the advice and consent of the senate and shall hold office from the date of such appointment until the appointment and qualification of a successor. Such department office. shall have its offices at the seat of government, with such accommodations therefor as shall be provided by the Board of State Auditors. The Deputy Commissioner shall perform such duties as may be assigned to him by the Commissioner, and in the absence or disability of the Commissioner may perform any of the duties imposed by law upon the Commissioner. The compensation of such deputy shall be three thousand five hundred dollars per annum. The Commissioner and Deputy Commissioner of said department shall each devote his entire time to the duties of his office.

SEC. 2. The following existing departments and offices are hereby transferred to and placed under the jurisdiction of the Department of Public Safety, namely: The State Fire Marshal's Department, the State Oil Inspector's Department, and the Department of the Michigan State Police; and the Commissioner of the Department of Public Safety ex-officio shall hereafter be the State Fire Marshal, and the State Oil Inspector. The offices of Deputy State Oil Inspector and of Deputy State Fire Marshal are hereby abolished. The duties of the Assistant State Fire Marshal shall hereafter be performed by the Deputy Commissioner of the Department of Public Safety. The powers and duties pertaining to the office of Deputy State Oil Inspector prior to the passage of this act may be exercised and performed by any employe of the Department of Public Safety deputized or appointed by the Commissioner to exercise and perform such duties.

SEC. 3. The Commissioner of the Department of Public Safety shall be responsible for the enforcement of the provisions of act number three hundred thirty-eight of the Public Acts of nineteen hundred seventeen, known as the prohibition act, and all acts supplemental thereto, to the same extent as and in succession to the Commissioner of the Food and Drug Department, and all of the duties, powers and responsibilities imposed by said act or acts upon the Commissioner of the Food and Drug Department shall hereafter de volve upon and be exercised by the Commissioner of the Department of Public Safety. So much of house enrolled act number eleven, Public Acts of nineteen hundred twenty-one, as makes the Department of Agriculture successor to the Commissioner of the Food and Drug Department in the enforcement of said prohibition act, is hereby repealed.

SEC. 4. All existing commissions and enlistments in the Michigan State Police shall be terminated on the first day of June of the year nineteen hundred twenty-one, and all of the property and equipment pertaining thereto shall be transferred to the Department of Public Safety as of said date. Upon the disbandment of the existing organization of the Michigan State Police, there shall be organized within the Department of Public Safety a uniformed corps of special men for the purpose of assisting the Commissioner in the performance of the duties of his department. The State Administrative Board shall prescribe the form of the organization, the location of the units, the uniforms and equipment, the character of the special training and discipline, and the general

policy with respect to the use and employment of such corps.

SEC. 5. The Commissioner shall appoint and employ such Assistants, assistants and employes as may be necessary to carry out the duties of his department, the grading and individual pay of whom shall be subject to the approval of the State Administrative Board. The total number of persons appointed and employed therein, including the uniformed corps, shall be fixed by the State Administrative Board. SEC. 6. The Commissioner of the Department of Public Conservators Safety, his deputy, and each member of the Department of Public Safety, are hereby individually vested with the powers of a conservator of the peace, and for the purpose of the service of process and of making arrests, with the powers of a deputy sheriff. Each such person shall furnish a bond to the Bond. state in the same amount, subject to the same conditions and with the same character of sureties, as is required by law of deputy sheriffs; and which bonds shall be approved by the State Administrative Board: Provided, That surety company Proviso. bonds may be accepted by the said board in all such cases. Any such member of the said department may serve and execute all criminal and civil process, when directed to do so by the Governor or the Attorney General, in actions and matters in which the state is a party. The Commissioner and said department shall be under the immediate control and direction of the Governor, and any member thereof may be employed by the Attorney General in any investigation or matter under the jurisdiction of his department.
