[No. 163.] AN ACT creating the State Welfare Department, prescribing its form of organization, its powers and duties; providing for the management and control of state hospitals, prisons, and other state institutions of a special nature; to provide for the welfare of persons in the custody or under the tutelage of the state; abolishing certain boards governing institutions embraced within this act, and creating certain commissions in succession thereto; and making an appropriation for certain purposes of this act. The People of the State of Michigan enact: powers and who to SECTION 1. There is hereby created a department of the State welfare state government which shall be known and designated in department, law as the State Welfare Department, with the powers and duties, etc. duties as hereinafter prescribed. Such department shall consist of a director as its executive head, and of the several commissions hereinafter created, and of such officers and assistants as may be appointed or employed in such department. The director and each of the members of the said Director, etc., several commissions shall be appointed by the Governor, by appoint. and with the advice and consent of the senate, and shall each hold the office to which appointed from the date of such appointment until the appointment and qualification of a successor. Such department shall have its executive office at the seat of government with such accommodations therefor as shall be provided by the Board filled. of State Auditors. The members of each of Commission the commissions shall be entitled to their actual and neces- members, per sary expenses, and to compensation at the rate of ten dol- diem. lars per diem for each day employed, in the performance of the duties of their respective offices, but none of the said members shall be reimbursed for any expenses nor paid any such compensation, excepting in pursuance of regulations or orders respecting the same as shall be made by the State Administrative Board in the exercise of its general powers. The office of deputy to such director is hereby created, and Deputy whenever in the judgment of the State Administrative Board, the work of such department requires the assistance of a deputy, then such board shall authorize and make such appointment and such deputy shall perform such duties as may be assigned to him by the director, including any of the duties that the director himself might be required to perform, and including also the duties imposed by law upon the secretary of the State Board of Corrections and Charities as existing director. Compensation. Employes. Report, commissions to make. Where filed. May install Vocational training system. State welfare commission, memberships, etc. Office. prior to the passage of this act. The compensation of such deputy shall be fixed by the State Administrative Board. The director, and deputy director when appointed, shall each devote his entire time to the duties imposed by this act, and shall at all times be subject to the orders and directions of the State Administrative Board, in the exercise of its statutory powers. The director shall appoint or hire and fix the compensation of such employes as may be necessary for the executive offices of such department, subject to the approval of the State Administrative Board. SEC. 2. The State Administrative Board shall co-ordinate and correlate the functions and projects of all of the state institutions embraced with the State Welfare Department, and each of the commissions created by this act, and the executive officers of the several state institutions thereunder, shall make such reports respecting the affairs and conduct of such institutions as shall be required by statute and by such board. All such reports shall be filed in the director's office for permanent record, and the director shall make and compile complete statistics with reference to the affairs of each of the said institutions; shall examine, analyze, abstract and put into form, all such information as may be required by the said board. Under the orders of the State Administrative Board, the director shall be responsible for the coordination of the duties and functions of the several commissions created by this act, and he may sit with any of the said commissions in an advisory capacity but without a vote thereon. The State Administrative Board shall have authority to provide for the installation of a system of vocational training, and military or other educational training in any of the correctional institutions, and to prescribe rules and regulations respecting the manner of carrying on such instruction and training. SEC. 3. There is hereby created within said State Welfare Department, a commission to be known and designated as "The State Welfare Commission," to consist of five members who shall be appointed as hereinbefore provided in section one. Such commission shall in all respects, excepting as otherwise provided in this act, be the legal successor to the corporate powers, duties and responsibilities of the Board of Corrections and Charities created by act number one hundred ninety-two of the Public Acts of eighteen hundred seventy-one, which board is hereby abolished from and after the time fixed in section eight of this act for such succession to take effect. Such State Welfare Commission shall have its office in Lansing in the office of the director, and the records, files and equipment pertaining to the Board of Correc tions and Charities shall be transferred to the office of such director. The duties devolving upon individual members of such Board of Corrections and Charities as prescribed by law, shall, upon such succession, hereafter devolve to a like extent upon the individual members of the State Welfare Commission, excepting as in this act otherwise prescribed. SEC. 4. There is hereby created within said State Wel- State hospital commission, fare Department, a commission to be known and designated duties, etc. as "The State Hospital Commission," to consist of seven members, who shall be appointed as hereinbefore provided in section one. Such commission shall in all respects, excepting as otherwise provided in this act, be the legal successor to the corporate powers, duties and responsibilities of each of the several boards of trustees and boards of control of the six state hospitals and institutions hereinafter named in this section; and each of said boards of trustees and boards of control is hereby abolished from and after the time fixed in section eight of this act for such succession to take effect. The following state institutions and hospitals are hereby placed under the jurisdiction and control of the said State Hospital Commission, namely: The Kalamazoo State Hospital; The Pontiac State Hospital; The Traverse City State Hospital; The Ionia State Hospital; The Michigan Farm Colony for Epileptics. commission, SEC. 5. There is hereby created within said State Wel- State prison fare Department, a commission to be known and designated duties, etc. as "The State Prison Commission," to consist of five members, who shall be appointed as hereinbefore provided in section one. Such commission shall in all respects, excepting as otherwise provided in this act, be the legal successor to the corporate powers, duties and responsibilities of each of the several boards of control of the three penal institutions hereinafter named in this section; and each of the said boards of control is hereby abolished from and after the time fixed in section eight of this act for such succession to take effect. The following penal institutions are hereby placed under the jurisdiction and control of the said State Prison Commission, namely: The Michigan State Prison at Jackson; The Michigan Reformatory at Ionia; The State House of Correction and Branch of the State tions commis SEC. 6. Such commission shall in all respects, excepting as otherwise provided in this act, be the legal successor to the corporate powers, duties and responsibilities of each of the several boards of guardians, trustees or control of the three correctional institutions hereinafter named in this section; and each of the said boards is hereby abolished from Pages, who chosen as. Before each session of the legislature, the director of the State Welfare Department shall recommend to the Lieutenant Governor, and to the Speaker of the House of Representatives, the names of two boys in the Industrial School for Boys, for appointment as pages in the house and senate; said boys to be chosen as a reward for high standing in deportment and school progress. SEC. 7. There is hereby created within said State Welfare Department, a commission to be known and designated as "The State Institute Commission," to consist of five members who shall be appointed as hereinbefore provided in section one. Such commission shall in all respects, excepting as otherwise provided in this act, be the legal successor to the corporate powers, duties and responsibilities of each of the several boards of trustees or of control of the five state institutions hereinafter named in this section; and each of the said boards is hereby abolished from and after the time fixed in section eight of this act for such succession to take effect. The following institutions are hereby placed under the jurisdiction and control of the said State Institute Commission, namely: The Michigan School for the Deaf, at Flint; The Michigan Employment Institution for the Blind, The State Public School, at Coldwater; The Michigan Home and Training School. SEC. 8. Each of the several boards abolished by this act shall continue to exercise their statutory powers and duties until twelve o'clock, noon, of the first day of June, of the year nineteen hundred twenty-one, at which time its successor under this act shall actively assume office. All orders, regulations and appointments made by any such board with respect to the institution under its control before such succession, shall continue in effect at the pleasure of the succeeding commission acting within its lawful authority. Each such commission shall, however, meet at the call of the Governor, before the date hereinabove fixed, for the purpose of organiz ing and preparing for its active duties under this act. Each such commission shall have the power to make rules governing its own procedure, to select a commission chairman and other officers, to make and enforce its own rules and regulations, not inconsistent with the law governing the several institutions under its control, respecting the conduct of each such institution, discipline therein, the care of property, and for hospital, who trustees of. SEC. 9. The board of trustees of the State Psychopathic Psychopathic Hospital at Ann Arbor, shall, after the passage of this act, to compose consist of four regents of the University of Michigan, as now provided by law, and of four other trustees to be selected and appointed by the Governor. The enactment of this act shall not be deemed to create any vacancies on said board of trustees, excepting as to those trustees appointed from among the several boards of control of the state hospitals. Such new trustees, when appointed, shall assume office at twelve o'clock, noon, of the first day of June, of the year nineteen hundred twenty-one. Such State Psychopathic Hospital shall be deemed to be within the State Welfare Department for the purpose of visitation and inspection, but not for the purpose of controlling the action of the board of trustees thereof, nor for the purpose of exercising any jurisdiction over the management and policy of the said hospital. perintendents, SEC. 10. The medical superintendent of each of the state Medical st hospitals, and the superintendent of the Michigan Farm etc., appointColony for Epileptics, shall, in case of vacancy in any such ment of. office, each be appointed by the Governor upon the recommendation of the State Hospital Commission. The warden of the State Prison, and of the branch thereof at Marquette, and of the Michigan Reformatory at Ionia, shall, in case of vacancy in any such office, be appointed by the Governor upon the recommendation of the State Prison Commission; the superintendent of the Michigan State Training School for Women, of the Industrial Home for Girls, and of the Industrial School for Boys, shall, in case of vacancy in any such office, be each appointed by the Governor upon the recommendation of the State Corrections Commission; the superintendent of the School for the Blind, of the School for the Deaf, of the Michigan Employment Institution for the Blind, the medical superintendent of the Michigan Home and Training School, and the superintendent of the State Public School, shall, in case of vacancy in any such office, be appointed by the Governor upon the recommendation of the State Institute Commission. In every such case of vacancy, it shall be the Names duty of the commission concerned to submit the names of candidates to fill such vacancy, from among whom the Governor may make his selection and appointment.
