Resolved, That the temporary assignment of W. N. Tubbs, foreman, to the position of clerk to the division superintendent, department of public works, at Syracuse, be and hereby is approved for a period not to exceed one month.

Promotion of special agents, Department of public works

Resolved, That the promotion of H. M. Hulsapple and William D. Odell, special agents in the department of public works, from $1400 to $1600 per annum, be and hereby is approved under the provisions of civil service rule XIV, section 9, for the reasons stated in the communication of Superintendent Partridge under date of December 12, 1901.

Alleged violation of civil service law at Willard state hospital

Whereas, The Commission is in receipt of communications from William Hill, New York city, dated December 14 and 17, 1901, alleging that James X. Williams, appointed to the posi tion of bookkeeper at the Williard state hospital, is performing duties as acting steward at said institution in violation of the civil service law; therefore, be it

Resolved, That the secretary be directed to communicate with the superintendent of the Willard state hospital informing him of the complaint presented to the Commission and asking for a statement of the facts, and also to direct the attention of the superintendent to the provisions of section 13 of the law which prohibits the employment of a person under a title not appropriate to the duties to be performed, and to the provi sions of civil service rule XXII, section 6, relative to the duty of the Commission to refuse certification in the case of a person appointed to or employed in any position other than that for which he was examined and certified.

Stenographers, Civil Service Commission

A communication from Flattie B. Warner, dated December 16, 1901, tendering her resignation as stenographer in the office of the Commission to take effect December 31, 1901, was read. On motion the following resolutions were adopted:

Resolved, That the resignation of Mrs. Warner be accepted and placed on file and that the Commission place upon its records its appreciation of the industry, intelligence and faithfulness displayed by Mrs. Warner during her six years term of employment, and its regret at the loss of a valued employee.

Resolved, That Mabel E. Paterson, stenographer in the office of the Commission, be and hereby is promoted to the position made vacant by the resignation of Mrs. Warner, to take effect January 1, 1902, at a salary of $900 per annum.

Transfer denied, Department of public works

A communication from John N. Patridge, superintendent of public works, dated December 19, 1901, requesting the consent of the Commission to the transfer of Frank Langwig from the position of messenger to that of special agent, was read. On motion the request of the superintendent was denied, for the reason that it does not appear that the positions referred to are similar or that Mr. Langwig has qualified in a competitive examination for the position to which transfer is sought. (December 21, 1901.)

Expert, State commission in lunacy

A communication from T. E. McGarr, secretary state commission in lunacy, dated December 19, 1901, relative to the temporary employment of F. F. MacIver as an expert in the matter of cost of ferryboats, charges for maintenance, etc., was read. On motion the following resolution was adopted:

Resolved, That F. F. MacIver, employed by the state commission in lunacy, be and hereby is excepted from examination

under the provisions of civil service rule VIII, section 9, it appearing that Mr. MacIver is a person engaged in private business and that the services to be rendered are technical and expert and of an occasional and exceptional character; provided, however, that the compensation of Mr. MacIver shall not exceed the sum of $100.

Consulting engineer, State architect

Resolved, That Percival R. Moses, employed by the state architect as consulting engineer "in the preparation of specifications and advice as to the comparative merits of ice making and refrigerating apparatus at the Middletown state hospital," be and hereby is excepted from examination under the provisions of civil service rule VIII, section 9, it appearing that Mr. Moses is a person engaged in private business and that the services to be rendered are professional, technical and expert and of an occasional and exceptional character; provided, however, that the compensation of Mr. Moses shall not exceed the sum of $350.
