Provided, further, That teachers in service who had completed less than 45 months successful teaching experience prior to May 15, 1919, and who meet the educational qualifications of the two and three and four year courses provided for in this act, shall be granted a provisional certificate in like manner and of like force and effect as are issued to graduates from courses approved subsequent to that date. This section amends section 13, Acts 1919, p. 753.

6318n. Foreign states, approved institutions, record.-14. The state teachers' training board shall keep a record of approved institutions in other states maintaining a course for the training of teachers equivalent to the two (2) and three (3) and four (4) year courses provided for in this act; and that graduates from such courses in such approved institutions in other states may be granted provisional and life state certificates from approved courses in accredited institutions in this state.

This section amends section 14, Acts 1919, p. 753.

Section 9 of the above act provides that the act be in force and effect from and after its passage.

The state teachers' training board may countersign life state certificates of teachers of other states when the holders of such certificates shall have furnished satisfactory evidence of good moral character and experience and success in teaching, as is required for life state certificates under the provisions of this act; and when so countersigned such certificates shall be valid in any of the schools of this state; Provided, That the requirements for obtaining the life certificates of other states shall be equivalent to the requirements for the same certificates in this state.

6318p. Repeal of act.-16. An act entitled "An act concerning normal schools and the training and licensing of teachers," approved March 11, 1907, be and the same is hereby repealed.

This section 6318p repeals sections 6313, 6314, 6315, 6316, 6317 and 6318 Revision of 1914.

6320. Text books, duty of state board.-1. That the state board of education shall constitute a board of commissioners for the purpose of making a selection, or procuring the compilation for use in the common schools or the State of Indiana, of a series of text books in the following branches of study, viz.: Spelling, reading, including primer, arithmetic, geography, English grammar, physiology, history of the United States, domestic science, agriculture and industrial arts, and a graded series of writing books. The matter contained in the

readers shall consist of lessons commencing with the simplest expressions of the language, and by (a) regular gradation, advancing to and including the higher styles of composition, both in poetry and prose: Provided, That none of said text books shall contain anything of a partisan or sectarian character: and Provided, further, That the foregoing books shall be at least equal in size and quality, as to matter, material, style of binding and mechanical execution to standard text books now in general use.

This act amends sections 6320 and 6326 of the Revised Statutes of 1914.

6325h. Text books, dealers and agents.-1. The county superintendent of schools in each county of the state shall appoint one (1) or more dealers or agents within the county who shall have charge of the sale and distribution of elementary and high school text books contracted for by the state board of school book commissioners, county board of education, board of school trustees, or boards of school commissioners; and it shall be the duty of each dealer or agent so appointed to carry at all times a sufficient supply of text books to accommodate the needs of the schools; and each dealer or agent shall furnish each publisher holding a text book contract in the State of Indiana, satisfactory evidence of his financial responsibility or furnish a surety bond covering the estimated amount of sales to be made by him in any year: Provided, further, That said dealer or agent shall pay cash to the contractor or publisher for all books received within sixty (60) days after the shipment of such books. It shall be the duty of said dealer or agent annually in June to ascertain the probable number of books that will be needed to supply to the schools for the ensuing year and place his orders for said books on or before the first day of July in each year.

6325i. Sale of text books by retail dealer.-2. It shall be unlawful for any retail dealer in text books, or any firm, corporation, or person to sell any school text book adopted by the state board of school book commissioners, or by any county board of education, board of school trustees, or board of school commissioners, at a price exceeding the net wholesale or net contract price, plus twenty per cent (20%) of the net wholesale or net contract price of such book; and such dealer or agent shall pay all transportation charges.

6325j. Purchase and sale of text books by school officers.-3. The board of school book commissioners, boards of school trustees, township trustees, county boards of education, or boards of school commissioners are hereby authorized to purchase text books from publishers at the net wholesale or net contract price, and sell said books to the pupils at the net wholesale or contract price, plus the cost of handling the books which shall not exceed twenty per cent (20%) of the net wholesale or net contract price.

6325k. Repeal.-4. An act entitled "An act to regulate the adoption and sale of text books and to provide optional high school texts" approved March 8, 1917, be and the same is hereby repealed.

This section repeals sections 6325a to 6325g inclusive Supplement of 1918, being act 1917, p. 539, in force May 31, 1917.

6326. Bids opened, price of books to patrons.-3. It shall be the duty of such board to meet at the time and place mentioned in such notice, and open and examine all sealed proposals received pursuant to the notice provided for in section two (2) of this act, and it shall be the further duty of such board to make a full, complete and thorough investigation of all such bids or proposals and to ascertain under which of said proposals or propositions the school books could be furnished to the people of this state for use in the common schools at the lowest price, taking into consideration the size and quality as to matter, material, style of binding and mechanical execution of such books: Provided, always, That such board shall not in any case contract with any author, publisher or publishers for the furnishing of any book, manuscript, copyright or books which shall be sold to patrons for use in the public schools of this state at a price above or in excess of the lowest contract selling price of the same book or books at any place in the United States, which prices shall include all costs and charges for transportation to the railroad or river station nearest to the several depositories in this state: Provided, That when any contractor furnishing books to be used in the public schools of Indiana under the provisions of this act shall contract to sell elsewhere the

same book or books at a lower price than the contract price in Indiana, then the said contractor shall make the said lower price apply to all future sales in Indiana: Provided, further, That if said contractor shall refuse to make such reduction in price then the governor of the state shall investigate and if he shall find that the same book is sold elsewhere under like conditions at a lower price than the Indiana contract price, he shall then have the power and it shall be his duty to order the contract with Indiana cancelled and new books advertised for as heretofore provided: Provided, further, That no book or books in which any member of the board may have any financial interest, either directly or indirectly shall be adopted by said board: Provided, further, That no contract under the provisions of this act shall be made for a period exceeding five (5) years. Nothing in this act shall be construed as affecting any contracts now existing relating to the furnishing of school books for this state: and Provided, further, That the letting of all contracts for books shall be upon full and fair competition into which any person, persons, or corporation may enter and may bid to furnish any book or books whether such book or books be at the time in use in the schools of the state under contract or not. This act amends section 6326 of the Revised Statutes of 1914.

6378. Qualifications of superintendent.-1. No person shall be eligible to or shall hold the office of county superintendents of schools who has not had three years successful teaching experience in public schools and who does not hold at the time of election a professional or life license, granted upon examination held by the state board of education; or a life state license granted by the state board of education upon a four year standard college course or a four year standard normal course; or a county superintendent's certificate granted without examination by the state board of education to a graduate of a four year standard college or a four year standard normal: Provided, That nothing in this act shall apply to disqualify anyone for election to the office of county superintendent of schools before September 1, 1921, who has qualified under section 1 of the act amended by this section, and provided further that nothing in this act shall apply to disqualify at any time any incumbent of the office of county superintendent who shall have qualified under section 1 of the act amended by this section.

This section amends section 6378 Revision of 1914.

6379. Duties of superintendent-Appeals.

If a township trustee fails to furnish transportation for children to schools when the law makes it his duty to do so, an appeal from his decision to the county superintendent need not be taken before a suit is brought to recover damages or to compel the trustee to perform his duty. 6391a. Teachers, examinations, license, fees.-1. That the county superintendent shall hold one public examination on the last Saturday of January, March, April, May, June, July, August, and October of each year, and at such examinations, shall examine by a series of questions furnished by the state board of education, all applicants for license as teachers in the common schools of the state and that no special examinations shall be held. No examination shall extend over a period of more than two days, and all examinations shall be conducted in the immediate presence of the county superintendent or his representative, pursuant to such institutions [instructions] and directions as the state board of education may provide. Before any applicant may be examined he shall produce to the county superintendent a certificate of good moral character from a school trustee of the county then in office, or other satisfactory written evidence of good moral character, which certificate or other evidence shall be marked "filed" on that date by such county superintendent and preserved as an office paper. All applicants for license in high school subjects and special branches, as hereinafter provided shall have their manuscripts sent to the state superintendent of public instruction for gradation. All applicants for license in elementary school subjects, as hereinafter provided shall have the right to elect whether they will have their manuscripts graded by the county superintendent for county license or graded by the state superintendent of public instruction for state license. Applicants for county license, shall if successful, receive license which shall be taken as qualifying the person to whom granted, so long as in force, to teach the subject or subjects indicated by the license in the elementary schools of the county wherein it is issued, and applicants for state license shall, if successful, receive license which shall be taken as qualifying the person to whom granted so long as in force, to teach the subject or subjects indicated by the license anywhere within the state: Provided however, A state license must be registered with the county superintendent of the county wherein it is to be used and indorsed by said superintendent as registered before the holder may legally contract to teach in any school corporation in the county.
