House Bill No. 440 (file No. 244), entitled

A bill to amend section 1 of chapter 7 of Act No. 316 of the Public Acts of 1923, entitled "An act to codify and add to the laws relating to the laying out of drainage districts, the construction and maintenance of drains, the assessment and collection of taxes therefor; to prescribe penalties for violation of certain provisions of this act; and to repeal certain acts relating to drains,"

Was read a third time, and, the question being on its passage,

Mr. Brake moved to amend the bill by striking out of line 25 of section 1 the words "such cleaning or other improvement" and inserting in lieu thereof the words "the cleaning thereof."

The motion did not prevail and the amendment was not adopted, a majority of all the members-elect not voting therefor.

Mr. Brake moved to amend the bill by striking out of lines 27 and 28 of section 1 the words "or other such improvement to be made."

A bill to amend section 95 of chapter 16 of the Revised Statutes of 1846, entitled "Of the powers and duties of townships and the election and duties of township officers," being section 2154 of the Compiled Laws of 1915, as last amended by Act No. 57 of the Public Acts of 1921,

Was read a third time.

Mr. Beam asked to be excused from voting on the passage of the bill, for the reason that he is a supervisor, and, therefore, directly interested.

Mr. Culver asked to be excused from voting on the passage of the bill, for the reason that he is a supervisor, and, therefore. directly interested.

The bill was then passed, a majority of all the members-elect voting therefor, by yeas and nays, as follows:

A bill to define the crime of breaking and entering and entering without breaking, with intent to commit a felony, and to provide a penalty therefor, and to repeal sections 10, 11, 12, 13 and 14 of chapter 154 of the Revised Statutes of 1846, entitled "Of offenses against property," being sections 15290, 15291, 15292, 15293 and 15294 of the Compiled Laws of 1915, and Act No. 34 of the Public Acts of 1899, entitled "An act to make the breaking and entering, or entering without breaking, any barn, granary or other outbuilding, in the night time, with intent to commit the crime of murder, rape, robbery or any other felony or larceny, a felony, and to provide a penalty therefor," being section 15337 of the Compiled Laws of 1915,

Was read a third time, and, the question being on its passage,

Mr. McLain moved to amend the bill by inserting in line 2 of section 1 after the word "house" the word "tent."

The motion prevailed and the amendment was adopted, a majority of all the members-elect voting therefor.
