AN ACT to amend section twenty-six of act number one hundred thirteen of the public acts of nineteen hundred nine, entitled "An act regulating steam vessels and vessels operated by machinery, navigating the waters within the juris diction of this state, excepting vessels which are subject to inspection under the laws of the United States, and providing penalties for the violation hereof, and to declare waters navigated by such vessels public and navigable waters of the state of Michigan," being section five thousand four hundred two of the compiled laws of nineteen hundred fifteen.

The People of the State of Michigan enact:

AN ACT to empower justices of the peace to perform official acts and exercise jurisdiction in criminal causes in any part of the county in which elected and qualified.

The People of the State of Michigan enact:

SEC. 2. A warrant for the arrest of an accused person, when issued by any justice of the peace in any township or city other than the township or city in which the justice of the peace was elected and qualified, may be returned to, and the accused brought before, such justice of the peace in the city or township in which the offense charged was committed, or at the office of such justice of the peace, in the city or township in which such justice of the peace was elected and qualified: Provided, That any such justice of the peace may in such warrant direct that the accused person be brought before another qualified justice of the peace within the same county, and in the absence of the justice of the peace, who issued the warrant, or in case of his inability to attend, the accused person may be brought before another qualified justice of the peace within the same county, which latter justice of the peace may proceed to hear or try the cause and have full jurisdiction thereof. AN ACT to regulate the hours of labor of employes in the fire departments of municipalities, and providing penalties for the violation thereof.

The People of the State of Michigan enact:

SECTION 1. It shall be unlawful for any municipality, or any officer or employe thereof, in municipalities having more than fifteen thousand inhabitants as shown by the last federal census, which maintain or may hereafter maintain an or ganized paid or part-paid fire department, to require any person in the employ of the fire department of such municipality to be on duty in such employment more than twentyfour hours, or to be off duty less than twenty-four consecutive hours out of any forty-eight hour period.

SEC. 2. The provisions of section one shall not apply (a) To the head or chief officer or his assistant officers in command of the fire department of a municipality;

(b) To employes of a fire department who are employed subject to call; nor

(c) To the members or employes of a fire department when required to remain on duty by the head or chief officer of such department, his aids or assistants, in cases of public

necessity arising from great conflagration, riot, necessary absence of regularly employed men or for discipline or other

causes.

SEC. 3. Any officer or employe or agent of such munici- Penalty for pality who shall require any employe or other person in any such fire department, save as hereinbefore excepted in section two of this act, to be on duty in such employment for a longer time than that hereinbefore provided, or to be off duty for a lesser time than that hereinbefore provided, shall be guilty of a misdemeanor and on conviction thereof shall be punished by a fine of not more than one hundred dollars or by imprisonment in the county jail for not more than three months, or by both such fine and imprisonment.

SEC. 4. All acts and parts of acts in conflict herewith are hereby repealed.

AN ACT to provide for the payment to the survivor of husband and wife, of land contracts, and of notes and other obligations secured by a mortgage, given as part of the purchase price of lands held as a tenancy by the entirety, and the vesting of the title of the mortgage or land contract in the survivor.

The People of the State of Michigan enact:

SECTION 1. In all cases where a husband and wife shall survivor of sell land held as a tenancy by the entirety and accept in part contract, payment for the purchase price the note or other obligation etc., payof said purchaser payable to said husband and wife, secured able to. by a mortgage on said land payable to husband and wife, the said debt together with all interest thereon, unless otherwise expressly stated in said mortgage, after the death of either shall be payable to the survivor, and the title to said mortgage shall vest in the survivor, and in case a contract for the sale of property owned by the husband and wife as tenants by the entirety, is entered into by them as vendors, the same provisions herein applying to the rights of the survivor in mortgages as above set forth, shall apply to the survivor of the contract.

AN ACT to make appropriations for the department of public instruction for the fiscal years ending June thirty, nineteen hundred twenty-six, and June thirty, nineteen hundred twenty-seven, for maintenance and operation.

The People of the State of Michigan enact:

SECTION 1. There is hereby appropriated from the general fund for the department of public instruction, for the fiscal year ending June thirty, nineteen hundred twenty-six, the sum of one hundred twenty-three thousand dollars, and for the fiscal year ending June thirty, nineteen hundred twentyseven, the sum of one hundred twenty-one thousand dollars, for the purposes and in the specific amounts as follows:

Each of said amounts shall be used solely for the specific purposes herein stated.

SEC. 2. The amounts hereby appropriated shall be paid out of the state treasury at such times and in such manner as is or may be provided by law.

SEC. 3. All fees or other moneys received by said department of public instruction shall be forwarded to the state treasurer each month and shall be by said treasurer deposited in the state treasury to be disbursed in such manner and for such purposes as may be provided by law.

This act is ordered to take immediate effect.

AN ACT to make appropriations for the Michigan securities commission for the fiscal years ending June thirtieth, nineteen hundred twenty-six, and June thirtieth, nineteen hundred twenty-seven, for maintenance and operation.

Each of said amounts shall be used solely for the specific purposes herein stated, subject to the general supervisory control of the state administrative board.
